COUNTY OF BALDWIN )(
The City Council met in an Agenda Meeting at 5:30p.m.,
Delchamps Room, 161 North Section Street,
Fairhope, Alabama 36532, on Monday, 11 August 2014.
Present were Council President Pro Tern Michael A. Ford, Councilmembers:
Rich Mueller, Diana Brewer, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. Council President Jack
Burrell was absent.
Council President Pro Tern Michael A. Ford called the meeting to order at
5:06p.m. The City Council reviewed and discussed the agenda for their meeting to
be held today at 6:00 p.m. Agenda Items Number 6 and Number 7 were briefly
discussed.
Agenda Item Number 8: a resolution to reject all bids for the Fairhope Soccer
Fields (Bid No. 003-14) for the Recreation Department was discussed.
Councilmember Boone commented he would be abstaining on this agenda item
because he works for the company.
City Attorney Wynne explained the options for the City Council with regards to this
bid; and read the following from the Code of Alabama 1975:
Section 39-2-6(b) -If no bids or only one bid is received at the time stated in the
advertisement for bids, the awarding authority may advertise for and seek other
competitive bids, or the awarding authority may direct that the work shall be done
by force account under its direction and control or, with the exception of the
Department of Transportation, the awarding authority may negotiate for the work
through the receipt of informal bids not subject to the requirements of this section.
Where only one responsible and responsive bid has been received, any negotiation
for the work shall be for a price lower than that bid.
Mayor Kant said if we reject the bids and negotiates the amount; it would have to be
lower than the one bidder's amount. If we reject the bids and rebid, we would have to
pay the engineer to redesign. Andy Bobe, our engineer of record for this project,
stated it would be hard to get the price down even with prices cut; and it would still
be over budget. Councilmember Mueller questioned why this project went from $2.0
million to $5.4 million. He said that Preble-Rish did what they were asked to do and
did not add other stuff. Mr. Bobe and Ms. Sullivan both replied that changing the
design of the project and moving entrance to the other road caused it to go up a great
deal.

Mayor Kant said the Council needs to decide how much they want to spend on this
project. The Soccer Complex project total amount is needed; and a recommendation
needs to be brought to the City Council. We need a master plan for the total project.
Councilmember Mueller replied we also need alternate plans if an issue arises.
Gary Gover addressed the City Council regarding boxes left by companies not
in use; and suggested allowing short-term rentals that have been in place to be
grandfathered in.
There being no further business to come before the City Council, the meeting
was duly adjourned at 5:45 p.m.
