HomeMy WebLinkAbout09-08-2014 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 6:00 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 8 September 2014. 6565 Present were Council President Jack Burrell, Councilmembers: Rich Mueller, Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. There being a quorum present, Council President Burrell called the meeting to order. The invocation was given by Dr. Jerry Henry, Pastor at First Baptist Church, and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve minutes of the 21 August 2014, regular meeting; minutes of the 21 August 2014, work session; and minutes of the 21 August 2014, agenda meeting. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Mayor Kant addressed the City Council regarding the following items: 1) Mentioned the proposed budget has been presented to the City Council; 2) A Budget Meeting has been scheduled for September 22, 2014 at 3:00p.m.; 3) Juana Murray, a City employee, saved someone at the Recreation Center and we should say thank you the next time you see her; and 4) A prayer service will be held in front of the Police Station on September 11, 2014 at 9:00a.m. Council President Burrell addressed the City Council and thanked Mayor Kant and staff for presenting the budget in a timely manner; and said this is a very good draft. He stated the budget is more than a rough draft and hopefully we can adopt before the beginning of the fiscal year. He mentioned the Alabama Community of Excellence meeting held for strategic planning. He said it is tougher to become an "Alabama Community of Excellence" when we already have an excellent community. It is difficult to have consensus and we had over 100 participants with great ideas. A Public Hearing was held as advertised on a proposed ordinance to amend Zoning Ordinance No. 1253. Councilmember Brewer introduced in writing Ordinance No. 1518, an ordinance to rezone the property of Bobby L. Faust from R-6 Mobile Home Park District to R-4 Low Density Multi-Family Residential. This property is generally located on the northeast comer of Bishop Road and Morphy Avenue, Fairhope, Alabama. Parcel contains 3.02 acres more or less; 05-46-05-16-0- 000-028.518. The Planning Commission gave a favorable recommendation of this ordinance. 6566 8 September 20 14 Planning Director Jonathan Smith briefly explained the proposed ordinance . He stated the Planning Commission is recommending and it does not conflict with the Comprehensive Plan. The drainage for the retention pond will be built for a 100 year event. Council President Burrell opened the Public Hearing at 6:20 p .m. No one present opposed the proposed ordinance , the Public Hearing closed at 6 :21p.m. In order to take immediate action, Councilmember Brewer moved for immediate consideration. Seconded by Councilmember Mueller, motion for immediate consideration passed unanimously by the following voice votes: AYE -Burrell , Mueller, Brewer, Ford, and Boone. NAY -None . Councilmember Brewer then moved for final adoption of Ordinance No. 1518. Seconded by Councilmember , motion for fmal adoption passed by the following voice votes : AYE -Burrell, Mueller, Brewer, Ford, and Boone . NAY-None. Councilmember Brewer introduced in writing Ordinance No. 1519, an ordinance to declare that certain real property ( 451 Pecan A venue property) of the City of Fairhope is not needed for public or municipal purposes in response to an offer to lease property from September 2, 2014 through September 18 , 2014. In order to take immediate action, Councilmember Brewer moved for immediate consideration. Seconded by Councilmember Mueller, motion for immediate consideration passed unanimously by the following voice votes: AYE -Burrell , Mueller, Brewer, Ford, and Boone. NAY -None . Councilmember Brewer then moved for final adoption of Ordinance No. 1519. Seconded by Councilmember Mueller, motion for final adoption passed by the following voice votes: AYE - Burrell , Mueller, Brewer, Ford , and Boone. NAY -None. Councilmember Ford introduced in writing , and moved for the adoption of the following resolution , a resolution authorizing Mayor Timothy M. Kant to execute an Agreement with the State of Alabama, acting by and through the Alabama Department of Transportation relating to a Transportation Alternatives project with partial funding by the Federal Highway Administration; U.S. 98 and Alabama 104 Multi-Use Path; Project No . TAPAA-TA14(919). Seconded by Councilmember Boone , motion passed unanimously by voice vote. * * 6567 8 September 2014 RESOLUTION NO. 2256-14 BE IT RESOLVED, BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE AS FOLLOWS: 1. That the City of Fairhope, Alabama enters into an agreement with the State of Alabama, acting by and through the Alabama Department of Transportation relating to a Transportation Alternatives project with partial funding by the Federal Highway Administration, which agreement is before this Council; 2. That the agreement shall be executed in the name of the City of Fairhope, by its Mayor Timothy M. Kant, for and on its behalf. 3. That the agreement shall be attested by the City Clerk, Lisa A. Hanks , and the seal of the City of Fairhope affixed thereto. BE IT FURTHER RESOLVED, that upon the completion of the execution of the agreement by all parties, that a copy of such agreement be kept on file by the City Clerk. Adopted and Approved this 8th day of September, 2014 Attest: ~L City Clerk Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution to purchase 216 Neptune Gas Electronic Radio Transceivers Units ("ERTS") for the Gas Department. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Council President Burrell stated these items are being purchased for a "Sole Source" vendor. 6568 8 September 2014 RESOLUTION NO. 2257-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to purchase 216 Neptune Gas Electronic Radio Transceiver Units (ERTS) for the Gas Department and authorizes procurement based on the option allowed by the Code of Alabama 1975, Section 41-16-51(b)(7). These will be used for gas meter change out and the cost will be $15 ,984.00. Adopted on this 8th day of September, 2014 Attest: ~ City Clerk Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution to reject all Bids for Jail Inmate Meals (Bid No. 018-14) for the Fairhope Police Department; and to authorize Procurement through the SAP A buying group. Seconded by Councilmember Boone, motion passed unanimously by voice vote. RESOLUTION NO. 2258-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope did request, receive, and open bids for Jail Inmate Meals for the Fairhope Police Department (Bid Number 018-14) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. [2] At the appointed time and place, the following bids were opened and tabulated as follows: 8 September 2014 Please see attached Bid Tabulation for Jail Inmate Meals for the Fairhope Police Department 6569 [3] After evaluating the bid proposal with the required bid specifications, it was determined that the bid response was incomplete. Therefore, we request that all bids be rejected for Jail Inmate Meals (Bid No. 018-14); and to authorize procurement through the SAP A buying group. Kant to execute a Contract with Music Garden, Inc. for the band known as "Fly-by-Radio" for the New Year's Eve Downtown Celebration with a cost not to exceed $5,000.00. Seconded by Councilmember Boone , motion passed unanimously by voice vote. RESOLUTION NO. 2259-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute a Contract with Music Garden, Inc. for the band known as "Fly-by-Radio" for the New Year's Eve Downtown Celebration (Wednesday, December 31, 2014) with a cost not to exceed $5 ,000.00. DULY ADOPTED THIS 8TH DAY OF SEPTEMBER, 2014 Attest: ~~ City Cler 6571 8 September 2014 City Council reviewed an application for a Non-Profit Tax Exempt License (Alcoholic Beverage License) by Jennifer Nylander, Fairhope Educational Enrichment Foundation, Inc., for "Phantasy of the Arts 2014," located at 161 North Section Street, Fairhope, Alabama on October 11, 2014 from 6:00p.m. to 11:00 p.m. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. City Council reviewed an application for a Non-Profit Tax Exempt License (Alcoholic Beverage License) by Blair Bullen, American Cancer Society, Inc., for "The Black Out Cancer Ball," located at 161 North Section Street, Fairhope, Alabama on September 26, 2014 from 6:00p.m. to 11:00 p.m. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. City Council reviewed an application for a Restaurant Liquor License by A. Pete Blohme, Sunset Pointe, LLC, d/b/a Sunset Pointe, located at 831 N. Section Street, Fairhope, Alabama. Councilmember Brewer moved to approve the issuance of the license. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Councilmember Ford questioned if loud music would be at the new restaurant. Mr. Blohme replied the restaurant will be family oriented with a variety of seafood choices; and is aware of the issues with the noise and loud music. Councilmember Mueller moved to adjourn the meeting. Seconded by Councilmember Boone, motion passed unanimously by voice vote. There being no further business to come before the City Council, the meeting was duly adjourned at 6:44 p.m.
