The City Council, City of Fairhope , met in regular session at
6:00p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532 , on
Thursday, 6 March 2014 .

Present were Council President Jack Burrell, Councilmembers : Rich Mueller,
Diana Brewer, Michael A. Ford , and Kevin Boone , Mayor Timothy M . Kant, City
Attorney Marion E. Wynne , and City Clerk Lisa A. Hanks .
There being a quorum present , Council President Burrell called the meeting to
order. The invocation was given by Chief Joseph Petties and the Pledge of
Allegiance was recited .
Councilmember Brewer mo ved to amend the City Council Agenda by
removing Agenda Item No. 11 : a resolution to purchase two (2) Chevrolet Caprice
Sedans for the Police Department with a total cost of $52 ,209.96. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote .
Councilmember Brewer moved to approve minutes of the 24 February 2014 ,
regular meeting ; minutes of the 24 February 2014 , work session; and minutes of the
24 February 2014, agenda meeting. Seconded by Councilmember Boone, motion
passed unanimously by voice vote .
Mayor Kant addressed the City Council regarding the National League of
Cities ' 2014 Congressional City Conference in Washington, D.C. next week; and
commented they would be meeting with legislators to get help on grants for the
Triangle property.
Council President Burrell addressed the City Council and reminded everyone
of the Arts and Crafts Festival ne xt week . He announced Grant Enfinger, NASCAR
driver from Fairhope who won the ARCA Racing Series season opener at Daytona,
will be presented a key to the City by Mayor Kant on Sunday, March 16 , 2014 , at
10 :15 a.m. next to the Fairhope Museum.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to reject all bids for Phosphate Chemical Supply
and Corrosion Testing for the Water Department (Bid No. 010-14); and authorize to
rebid. Seconded b y Councilmember Ford , motion passed unanimously by voice vote.

RESOLUTION NO. 2184-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Phosphate
Chemical Supply and Corrosion Testing for the Water Department (Bid Number 010-
14) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place, only one bid response was received.
[3] After evaluating the bid proposal with the required bid specifications, it was found
not responsive and we request that all bids be rejected for Bid No. 010-14 and
authorizes to rebid.

the following resolution, a resolution to award bid for Uniforms for the City of
Fairhope (Bid No. 007014) in the amount of$654.50 per set (Men/Women pants, SL
and LS shirts); total of unit costs. Seconded by Councilmember Mueller, motion
passed unanimously by voice vote.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follow s:
[1] That the City of Fairhope did request, receive , and open bids for Uniforms for the
City of Fairhope (Bid Number 007-14) at 555 South Section Street in the City of
Fairhope offices , Fairhope, Alabama.
[2] At the appointed time and place ; the following bids were opened and tabulated as
follows:
Please see attached Bid Tabulation for
Uniforms for the City of Fairhope
[3] After evaluating the bid proposals with the required bid specifications, At Work
Sales Corporation, in the amount of $654.50 per set (Men/Women pants, SL and LS
Shirts); total of unit costs , is now awarded the bid for Uniforms for the City of

Councilmember Mueller introduced in writing, and moved for the adoption of
the following resolution, a resolution to reject all bids for Jail Inmate Meals for the
Fairhope Police Department (Bid No. 001-14); and authorize to negotiate a contract
with the one bidder. Seconded by Councilmember Brewer, motion passed
unanimously by voice vote.
RESOLUTION NO. 2186-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Jail Inmate Meals
for the Fairhope Police Department (Bid Number 001-14) at 555 South Section Street
in the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:
Please see attached Bid Tabulation for Jail Inmate Meals
for the Fairhope Police Department
[3] After evaluating the bid proposals with the required bid specifications, only one
valid bid was received and we request that all bids be rejected for Bid No. 001-14;
and authorize to negotiate a contract with the one bidder, pursuant to the Code of
Alabama 1975, Section 39-2-6(b).

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open a rebid for Lift Station
Odor Control Chemicals for the Sewer Department (Bid Number 009-14) at 555
South Section Street in the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:
Please see attached Bid Tabulation for
Lift Station Odor Control Chemicals for the Sewer Department
[3] After evaluating the bid proposals with the required bid specifications, Biomagic,
Inc., with the total bid proposal of $6.15 per metered gallon, for an annual cost of
$215,496.01, is now awarded the bid for Lift Station Odor Control Chemicals for the
Sewer Department.

Councilmember Ford introduced in writing, and moved for the adoption of the
following resolution, a resolution to purchase Gas Meters, Connections, and
Regulators for the Gas Department's Inventory with a total cost of $23,118.00.
Seconded by Councilmember Boone , motion passed unanimously by voice vote.
RESOLUTION NO. 2188-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope has voted to purchase Gas Meters, Connections, and
Regulators for the Gas Department's Inventory; and authorizes procurement based on
the option allowed by the Code of Alabama 1975 , Section 41-16-51(b)(7). The total
cost is $23,118.00.

request, receive, and open bids for Fairhope Avenue Sidewalk Project from Idlewild
Drive to State Highway 181.
[2] At the appointed time and place, the following bids were opened and tabulated as

the following resolution, a resolution that certain items are declared surplus and the
Mayor and City Treasurer are hereby authorized and directed to dispose of personal
property owned by the City of Fairhope by receiving bids and being sold to the

RESOLUTION NO. 2190-14
WHEREAS , the City of Fairhope , Alabama, has certain items of personal property
which are no longer needed for public or municipal purposes ; and ·
WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the
municipal governing body to dispose of unneeded personal property;
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF
FAIRHOPE, ALABAMA, AS FOLLOWS :
SECTION 1. That the following personal property owned by the City of Fairhope,
Alabama, is not needed for public or municipal purposes , and hereby declared
surplus:

SECTION 2. That the Mayor and City Treasurer are hereby authorized and directed
to dispose of the personal property owned by the City of Fairhope , Alabama,
described in Section 1, above , by receiving bids for such property . All such property

have the authority to reject all bids when , in its opinion, it deems the bids to be less
than adequate consideration for the personal property.

Councilmember Boone moved to amend Agenda Item No. 13 by striking the
"Fairhope Planning Commission 11.52.11 Review and the Public Awareness
Meeting" from the Non-Participating Project -Project B which changes the total
from "not to exceed $90 ,800.00" to "not to exceed $80,800.00." Seconded by
Councilmember Brewer, motion passed unanimously by voice vote.

Councilmember Boone introduced in writing , and moved for the adoption of
the following resolution as amended, a resolution that Mayor Timothy M. Kant is
hereby authorized to execute a Contract for Geotechnical Consulting Services for the
A TRIP Phase 3 Resurfacing Fairhope A venue from Section Street to State Highway
181 with Thompson Engineering, Inc . with a total cost not to exceed $80,800.00.
Seconded by Councilmember Brewer, motion passed unanimously by voice vote.
RESOLUTION NO. 2191-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to
execute a Contract for Geotechnical Consulting Services for the ATRIP Phase 3
Resurfacing Fairhope Avenue (CR 48) from Section Street to State Highway 181 with
Thompson Engineering, Inc . with a total fee proposal not to exceed $80 ,800.00 which
includes the following:
A TRIP Participating Project -Project A: $66,800.00
Non-Participating Project-Project B:
Improvements Design & Permitting $ 7,000.00
Bancroft Ave to Greeno Median Planning & Design $ 7 ,000 .00

Clay Adams with Wolcott Adams Vemeuille addressed the City Council
regarding Fairhopers Community Park Renovations . Mr. Adams said they had
community input for the renovations ; a new fence is already in place, and the old
equipment has served its time . He said the park will be more visible for the children
to be seen on the equipment.

Mr. Adams showed the City Council and the audience the new park design which will
be ADA compliant; even wheelchair accessible. Mr. Adams said the pavilion bid was
·done separately and came in around $33,000.00. Mayor Kant thanked the City
Council because now we have a facility for all of our children. He mentioned that we
did not have a park for special needs children and even parents. Mayor Kant said he
wanted to thank the Council for making this happen. Council President Burrell
responded to Mayor Kant and said he was being too modest and a lot of credit goes to
the work you did with the Governor of Alabama to release the funds that we had; and
to get them spent on this . He told the Mayor he was being humble and he should take
a lot of credit for that.
Councilmember Mueller introduced in writing, and moved for the adoption of
the following resolution, a resolution to award bid for Fairhopers Community Park
Renovations for the Recreation Department (Bid No . 008-14) and Project No.
PW005-13) with a total bid proposal of $378 ,870.00. Seconded by Councilmember
Brewer, motion passed unanimously by voice vote.
RESOLUTION NO. 2192-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follo w s:
[1] That the City of Fairhope, by and through Walcott Adams Vemeuille, Project Engineer,
did request, receive , and open bids for Fairhopers Community Park Renovations (Equipment
and Splash Pad) for the Recreation Department (Bid No . 008-14 and Project No. PWOOS-13).
[2] At the appointed tim e and place, the following bids were opened and tabulated as follows :

Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Boone, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:23 p .m .
