HomeMy WebLinkAbout06-22-2015 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council , City of Fairhope , met in regular session at 6:00 p.m., Fairhope Municipal Comple x Council Chamber, 161 North Section Street, Fairhope , Alabama 36532 , on Monday, 22 June 2015. 6765 Present were Council President Jack Burrell , Councilmembers : Rich Mueller, Diana Brewer, Michael A. Ford , and Kevin Boone , Mayor Timothy M. Kant, City Attorney Marion E. Wynne , and City Clerk Lisa A. Hanks. There being a quorum present , Council President Burrell called the meeting to order. The invocation was given by Councilmember Boone and the Pledge of Allegiance was recited. Councilmember Brewer mo ved to approve minutes of the 8 June 2015 , regular meeting ; minutes of the 8 June 2015 , work session ; and minutes of the 8 June 2015 , agenda meeting. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Mayor Kant addressed the City Council and requested City Clerk Lisa Hanks to join him. Mayor Kant stated that last week the Alabama Municipal Clerks held their Summer Conference in Downtown Fairhope with City Clerk Hanks hosting the event as AAMCA President. He announced that at this event Lisa Hanks was named "Alabama Municipal Clerk of the Year " by the Alabama Association of Municipal Clerks and Administrators (AAMCA). We want to congratulate Ms. Hanks for a job well done. City Clerk Hanks addressed the City Council and thanked Mayor Kant, City Councilmembers , and citizens of Fairhope for allowing her the opportunity to obtain the education needed and to represent the City of Fairhope. Dan McCrory addressed the City Council and gave the results of the Fecal Sample Analysis Report from Dr. Feng with Auburn University. Mr. McCrory stated the test results show no DNA for humans , but two of the DNA markers did test positive to for birds : sea gull , Canada geese , duck , and chicken. Mr. McCrory also stated that 85 percent of the bird markers were Canada geese. A copy of the report is on file in the City Clerk 's office. Council President Burrell stated that Agenda Item Number 14 , an Executive Session, was pulled at the request of City Attorney Wynne. Council President Burrell stated there was a need to add on an agenda item after Agenda Item Number 13; a motion to authorize Mayor Timothy M. Kant to purchase three ("3") 10 Ton HVAC Unit s for the Civic Center with a cost not to exceed $48,700.00 which included roofing and structural. 6766 22 June 2015 Councilmember Brewer moved to add on the above mentioned item not on the printed agenda. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Councilmember Ford addressed the City Council and gave an update on the recently held Recreation Board meeting. He stated that pickle ball was the main issue discussed. Tennis and facilities were also discussed along with new committee members. Council President Burrell addressed the City Council regarding his attendance at the Paris Air Show where he represented the City of Fairhope and the Fairhope Airport Authority. He mentioned Baldwin County Economic Development Alliance, Mobile Airport Authority, Mobile Chamber of Commerce, and representatives from Mobile and Baldwin County also attended this event. We have some potential businesses looking at our airport. Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing signees of all City of Fairhope Accounts. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. RESOLUTION NO. 2371-15 WHEREAS, two signatures are required on all monetary transactions of the City of Fairhope; and WHEREAS, travel is sometimes required of the Mayor and of the Treasurer and provisions should be made to cover monetary requirements of the City in the absence of one or both ; THEN, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that all Financial Depositories where monies of the City are deposited , whether in checking, savings, or other type accounts, currently or in the future; be and hereby are advised that any two of the following signees are authorized to sign any monetary transaction between said Depositories and the City of Fairhope, Alabama. Hanks are hereby authorized to use a facsimile signature for routine checks and paperwork: Sample: Sample: BE IT FURTHER RESOLVED that Mayor Timothy M. Kant is hereby authorized to use computer generated signature for routine checks under One Thousand Dollars ($1 ,000.00). All monetary transactions must have at least one true signature. Sample: BE IT FURTHER RESOLVED that a certified copy of this resolution be sent to all Depositories as authorization of, and as a record of, above signee signatures. Kant to execute a Temporary Construction Easement between City of Fairhope and Patricia A. and David D. Schultze for the sole purpose of the construction and maintenance of a bio retention swale on the western 20 feet of said property ; over, on, upon, under, through and across certain real property of Grantors in Baldwin County, Alabama described in the easement. RESOLUTION NO. 2373-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope has voted to approve a Three Year Lease of Mailing Machine for the City the type of mailing machine needed is on the Alabama State Department of Purchasing bid list and therefore does not have to be let out for bid ; and [2] The following is the Alabama State Department of Purchasing contract information : Bid Number: T311 Three-Year Lease for Mailing Machine Cost is $510.88 per mo. Seconded by Councilmember Boone, motion passed unanimously by voice vote. RESOLUTION NO. 2374-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope did request , receive, and open bids for an Articulating Rough Mower for Quail Creek Golf Course (Bid Number 023-15) at 555 South Section Street in the City ofFairhope offices , Fairhope , Alabama. [2] At the appointed time and place , the following bids were opened and tabulated as follows: Please see attached Bid Tabulation for Articulating Rough Mower for Quail Creek Golf Course [3] After evaluating the bid proposals with the required bid specifications, Specialty Turf Supply, Inc., with the total bid proposal of an approximate cost of$15,200.00 to allow for freight cost variations at ship time , is now awarded the bid for an Articulating Rough Mower for Quail Creek Golf Course. Councilmember Brewer introduced in writing , and moved for the adoption of the following resolution , a resolution to Award Bid for Quail Creek Sidewalks Project Phases 1 and 2 (Bid No . 022-15) to Asphalt Services , Inc. with a total bid proposal of $63 ,243.20 for these phases; and to Award Bid for Quail Creek Sidewalks Project Phases 3 and 4 (Bid No . 022-15) to Arrington Curb and Excavation, Inc. with a total bid proposal of $42 ,782.50 for these phases. Kant to terminate the contract with ADP for Professional Services for Time clock Services per terms and conditions of the referenced contract, specifically Item 7. Seconded by Councilmember Mueller, motion passed unanimousl y by voice vote. 6773 22 June 2015 RESOLUTION NO. 2376-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: [1] That the City of Fairhope did execute a contract with ADP for Professional Services to replace the current time/attendance software and approve the monthly fee for software and terminals for the City of Fairhope on September 27, 2012. [2] Per the terms and conditions of the referenced contract, specifically Item 7, which allow the City to terminate this contract for "subject to the terms of any Price Agreement, entered into by ADP and Client, ADP or Client may terminate this Agreement or any Service(s) provided hereunder without cause upon at least ninety (90) or thirty (30) days, respectively , prior written notice," and by giving written notice to the Provider ; it is recommended that the contract for Professional Services with ADP be terminated. Adopted on this 22nd day Attest: ~-¥~ isa A. ank , MMC City Clerk Councilmember Brewer introduced in writing , and moved for the adoption of the following resolution, a resolution to Reject Bid for a Three Quarter Ton Truck for the Gas Department (Bid Number 026-15); only one bidder responded to bid. The motion was seconded by Councilmember Mueller. Dan Ames, Purchasing Manager, addressed the City Council and explained the bid issues. He stated that the bidder was now approved for the contract by the State and now could be accepted. After further discussion, Councilmember Brewer rescinded her motion to reject the bid. Councilmember Ford moved for the adoption of the following resolution, a resolution to Award Bid for a Three Quarter Ton Truck for the Gas Department (Bid Number 026-15) to Wade Ford with a total bid $25 ,189.00. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. 6774 22 June 2015 RESOLUTION NO. 2377-15 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows : [ 1] That the City of Fairhope did request, receive, and open bids for a Three Quarter Ton Truck for the Gas Department (Bid Number 026-15) at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama. [2] At the appointed time and place , the following bids were opened and tabulated as follows: Please see attached Bid Tabulation for Three Quarter Ton Truck for the Gas Department [3] After evaluating the bid proposals with the required bid specifications, Wade Ford, with the total bid proposal of $25,189.00, is now awarded the bid a Three Quarter Ton Truck for the Gas Department. Councilmember Boone , motion passed unanimously by voice vote. 6775 Fairhope Police Seconded by City Council re v iewed an application for a Restaurant Liquor License by Rick Gambino , for Shux, LLC , d/b /a Shux on the Pier located at 1 Fairhope Avenue , Fairhope, Alabama. Councilmember Mueller moved to approve the issuance of the license. Seconded by Councilmember Ford , motion passed unanimously by voice vote. Councilmember Brewer moved to authorize Mayor Timothy M. Kant to purchase three ("3") 10 Ton HVAC Units for the Civic Center with a cost not to exceed $48 ,700.00 which included roofing and structural.
