The City Council, City of Fairhope, met in regular session at
6:00p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 23 February 2015.

Present were Council President Jack Burrell, Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Associate Pastor Chris Peters of Trinity
Presbyterian Church and the Pledge of Allegiance was recited. Councilmember
Brewer moved to approve minutes of the 9 February 2015, regular meeting; minutes
of the 9 February 2015, work session; and minutes of the 9 February 2015, agenda
meeting. Seconded by Councilmember Boone, motion passed unanimously by voice
vote.
Mayor Kant addressed the City Council and mentioned the "State of the City"
which was held Sunday is online for viewing. He said we made it through Mardi
Gras, but will be addressing some KOER issues.
Councilmember Mueller addressed the City Council and mentioned the
Fairhope Environmental Advisory Board needs more participation.
Councilmember Brewer addressed the City Council and stated the reason she
was not able to attend the State of the City was due to her working at the Mobile
Symphony.
Council President Burrell addressed the City Council regarding the Knoll Park
Maintenance Plan and mentioned the debate on the burning of the interior. The
burning promotes wild flowers; native species. He said the plan emphasizes burning;
and we unanimously voted for the plan not for maintenance. The plan does specify
three different options for the park. The expert says we need to bum and residents
will not be harmed. The burning will be done with the utmost care. Hopefully, this
will be the direction we move.
Councilmember Brewer moved for final adoption of Ordinance No. 1532, an
ordinance to rezone the property of Anez Investments, Inc. from R-A Residential I
Agriculture District to B-4 Business and Professional District. This property is
generally located at 20252 State Highway 181, Fairhope, Alabama. Parcel No. 05-
46-06-14-0-000-001.502. (Introduced at the February 9, 2015 City Council Meeting)

Seconded by Councilmember Boone, motion for final adoption passed by the
following voice votes: AYE-Burrell, Mueller, Brewer, Ford, and Boone. NAY-
None.
Councilmember Brewer moved for final adoption of Ordinance No. 1533, an
ordinance to approve an Application from Glide N.E.W. LLC d/b/a Glide the Gulf for
a Franchise Agreement to operate Guided Segway Tours on streets and sidewalks as
specified on the attached map; and with the tours beginning from Emma's Bay House
at 202 South Mobile Street. (Introduced at the February 9, 2015 City Council
Meeting) Seconded by Councilmember Ford, motion for final adoption passed by the
following voice votes: AYE -Burrell, Mueller, Brewer, Ford, and Boone. NAY -
None.
Councilmember Boone introduced in writing, and moved for the adoption of
the following resolution, a resolution that Mayor Timothy M. Kant is hereby
authorized to execute an extension of the Contract with Water and Waste Specialties,
LLC for Supply of Hydrofluorosilicic Acid (Bid No. 014-14) for the Water
Department for an additional one year as per the terms and conditions of the original
contract. The cost of the products will be $330.00 per 55 gallon drum. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
RESOLUTION NO. 2329-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to
execute an extension of the Contract with Water and Waste Specialties, LLC for
Supply ofHydrofluorosilicic Acid (Bid No. 014-14) for the Water Department for an
additional one year as per the terms and conditions of the original contract. The cost
of the products will be $330.00 per 55 gallon drum.

Council President Burrell commented this recommendation by the Harbor
Boards was discussed in the Agenda Meeting and needs to state as funding becomes
available. Councilmember Boone moved to approve the Harbor Board
Recommendation requesting from the City Council to approve funding for the
following top three priorities for the City of Fairhope marina and docks: (1) cleanout
and/or scoop the slips and stalls; (2) 100 feet of bulkhead beginning on the North end
with 60 feet in phase with the parking lot upgrades; and (3) gravel and grate the
parking lot as funding becomes available. Seconded by Councilmember Brewer,
motion passed unanimously by voice vote.
Councilmember Brewer moved to appoint Kahley Malloy to the Recycling
Committee for a four-year term which will expire February 2019. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
Councilmember Brewer moved to appoint Allison Chang and to reappoint
Paul Fontenot and Skip Jones to the Tree Committee for a three-year term which will
expire February 2018. Seconded by Councilmember Mueller, motion passed
unanimously by voice vote.
Councilmember Brewer moved to grant the request of Erin Hendricks -
Fairhope Public Library Foundation-requesting permission to hold the Annual "Hoot
Scoot" 5K Race and 1-mile Fun Run on April 24, 2015 from 6:30p.m. to 8:00p.m.;
and the use of City streets. Seconded by Councilmember Boone, motion passed
unanimously by voice vote.
Councilmember Ford moved to grant the request of Lois Boykin and
Elizabeth Rockwell, on behalf of the Montrose Garden Club, requesting permission to
erect a marker to honor all Veterans designating a Blue Star Memorial Highway for a
portion of Scenic Highway 98 from the Daphne City Limits south to State Highway
104; and the marker to be placed on the rights side (east) of Scenic Highway 98. The
motion was seconded by Councilmember Boone. Ms. Boykin and Ms. Rockwell
addressed the City Council regarding the Blue Star Memorial Highway signage. Ms.
Boykin commented the Blue Star Memorial Highway project began by National
Garden Clubs in 1942. The Montrose Garden Club has found a complimenting place
for the sign near Veterans Drive. The signage and highway will honor all veterans
and the dedication ceremony will be held on April 18, 2015 at the Knights of
Columbus. After further discussion, motion passed unanimously by voice vote.
City Council reviewed an application for a Non-Profit Tax Exempt License
(Alcoholic Beverage License) by Teddy J. Faust, Jr. for Fairhope Sunset Rotary Club
Charity, Inc., for the Fairhope BBQ and Brew located at 701 Volanta Avenue (the
green space north of the Fairhope Municipal Pool), Fairhope, Alabama on March 14,
2015 from 10:00 a.m. to 3:00p.m.

Councilmember Brewer moved to approve the issuance of the license. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
City Council reviewed an application for a Non-Profit Tax Exempt License
(Alcoholic Beverage License) by Heiko Einfeld for Eastern Shore Chamber
Foundation, for the Annual Arts and Crafts Festival located at 161 North Section
Street, Fairhope, Alabama on March 20, 2015 from 12:00 p.m. to 10:00 p.m.
Councilmember Brewer moved to approve the issuance of the license. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
City Council reviewed an application for a Non-Profit Tax Exempt License
(Alcoholic Beverage License) by Clay Swanzy for the Eastern Shore Art Association,
Inc., for "Puttin' on the Gritz," a fundraiser to help the art center with its education
programs, exhibits, and public art projects, located at 161 North Section Street,
Fairhope, Alabama on April 11, 2015 from 7:00p.m. to 11:00 p.m. Councilmember
Brewer moved to approve the issuance of the license. Seconded by Councilmember
Mueller, motion passed unanimously by voice vote.
Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Boone, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:31 p.m.
