The City Council met in a Work Session at 4:30 p.m.,
Delchamps Room,161 North Section Street,
Fairhope,Alabama 36532,on Monday,14 December 2015.
Present were Council President Jack Burrell,Councilmembers:Rich Mueller,
Michael A. Ford, and Kevin Boone, and City Clerk Lisa A. Hanks.Councilmember Diana
Brewer Mayor Timothy M. Kant, and City Attorney Marion E. Wynne were absent.
Council President Burrell called the meeting to order at 4:30 p.m.
The following topics were discussed:
• David Pantovic,owner of Point Clear Tennis Academy,addressed the City Council
regarding a proposed Franchise Agreement to give tennis lessons. He stated the
lessons would be mainly in the afternoons.The Recreation Board voted to
recommend this Franchise Agreement to the City Council. Recreation Director Tom
Kuhl said using the tennis courts must be booked ahead of time. Councilmember
Ford commented this would be an addition to the area.The consensus of the City
Council is to go forward with the Franchise Agreement. Council President Burrell
requested this item to be put on the next City Council agenda.
• Council President Burrell brought up the discussion of the proposed Franchise
Agreement for Accommodations Afloat.Chief Petties stated that Airbnb website
shows the boat being rented. Chief Petties also stated that he had met with Brian
Injaian regarding the rental of the boat with no licenses, agreements, etc.; and Mr.
Injaian said it would not happen anymore.General Superintendent James Gillespie
said he has not obtained the business license.
Bob Riggs,Chairmanof the Harbor Board,addressed the CityCounciland requested
that the operator must have a CoastGuard License;and an assurancethat the boat is
sea worthy.We also need liability to the ownerif the boat sinks.Councilmember
Boone said he does not have a warm fuzzy; and he does not trust him.
Councilmember Ford commented he had already been caught once and this is not
good.Councilmember Mueller commented hehas issues withthis sinceothersmust
have a franchise agreement.
•Councilmember Ford gave an update of the Recreation Board and Recycling
Committee. He said the franchise agreement has already been discussed. The
RecyclingCommittee is stillwaitingon cansfor singlestream.
•Councilmember Boone commented that the Personnel Board recommendation to
reappoint DianeThomas wason the agendatonight.
•Councilmember Mueller mentioned the Fairhope Environmental Advisory Board is
requesting "Do Not Feed the Ducks"at the Duck Pond area.He also mentioned the
Historic Preservation Commission Ordinance has been reviewed by a City Attorney;
and now he will review with the Historic Preservation Committee and bring back to
the City Council.

Council President Burrell gave an update on the Fairhope Air Authority regarding the
appointment on the City Council agenda tonight, ground lease for new hangar with
two other entities waiting; and the Continental Motors renovation.
Matthew Brown,member of the State Board of Education,addressed the City
Council and stated he represented seven Counties. Mr. Brown commented he was
here for the City of Fairhope and Baldwin County if we needed anything.
Dan Ames, Purchasing Manager, addressed the City Council regarding the Education
Advisory Committee and the consultantsfor the Study Presentation. They both have
20 minutes for their presentations; one was already presented on December 9,2015
and the next presentation is scheduled for December 16,2015.Bob Riggs, member
of the Education Advisory Committee, commented both groups are qualified to do
the study.Council President Burrell questioned if this was just another stab for a
separate school system. Mr. Riggsrepliedthe focus ison what the top 10 schoolsare
doing and what Fairhope needs to do.
• Public Works Director Jennifer Fidler addressed the City Council regarding the
pavingprojectsand the ATRIPProjectandthe CE&I services neededfor same.
• Dan McCrory,Water and Sewer Superintendent,addressed the City Council
regarding the Ribbon Cutting scheduled for the Waste Water Treatment Plant and
needing a consensus on a date.
• Jonathan Smith, Planning Director,addressed the City Council regarding Planning
Commission items that will soon be coming to the City Council for approval; and the
Comprehensive Plan revisions.
•Bobby Hall,Director of Golf,addressed the City Council regarding a patron who
bought hamburgersand hotdogsfor the wholestaffto saythank you.
• Chief Joe Petties addressed the City Council and gave an update on the Short-Term
Rental Projectthat the PoliceDepartmenthasbeenconducting.
There being no further business to come before the City Council,the meeting was
duly adjourned at 5:22 p.m.
