The City Council , City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 13 April2015.

Present were Council President Jack Burrell, Councilmembers: Rich Mueller,
Diana Brewer, Michael A. Ford, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Burrell called the meeting to
order. The invocation was given by Gray Strickland, Pastor of The Way Community
Church, and the Pledge of Allegiance was recited. Councilmember Brewer moved to
approve minutes of the 23 March 2015 , regular meeting; minutes of the 23 March
2015, work session; and minutes of the 23 March 2015 , agenda meeting. Seconded
by Councilmember Mueller, motion passed unanimously by voice vote.
Mayor Kant addressed the City Council regarding the following items:
1) Earth Day scheduled for Saturday from 10:00 a.m. to 7:00p.m.;
2) Scale Back Alabama with the City having 38 teams to participate;
3) Greg Burroughs is retiring from the City after 30 years of service;
4) Attended the Gold Awards at the Grand Hotel as the Fairhope Library received its
Award ;
5) Hoot Scoot will be on April 24 , 2015 at 6:00 p.m.; and
6) Ray Hicks is on the agenda as my recommendation to complete the term of Howard
Hadley on the Airport Authority.
Commander Wayne Stacey addressed the City Council and recognized Doug
Mannsman who on March 19, 2015 saved a young person from being hit by a vehicle.
He gave Mr. Mannsman a Certificate of Accommodation and the Medal or Heroism.
Chief Petties with the Fairhope Police Department also recognized Mr. Mannsman
and presented him with a Plaque from the Police Department along with a gift.
Councilmember Brewer addressed the City Council regarding City Sketches
and commended Sherry Sullivan and her staff on the new format and how
professional it looks. She also mentioned that the Downtown Merchants Association
has commended the Police Department on its responsiveness and like the officers
walking in downtown. The Association thanked the City for its financial support.
Councilmember Ford addressed the City Council and mentioned the Mayor's
Golf Tournament for FEEF announcing that the Mayor's team won. He also said
when the Mayor returns would like for him to explain the status of the house on
Cedar Street.

Council President Burrell addressed the City Council regarding the following
items:
I) Puttin' on the Gritz for the Eastern Shore Art Center was held on April 11, 20 15;
2) Attended the Legislative Advocacy Session presented by the Alabama League of
Municipalities which was worthwhile with speakers, i.e. Governor Bentley, David
Bronner, and State Representative and Senators;
3) The Homeowner 's Insurance initiative is still working on rates.
Councilmember Boone introduced in writing, and moved for the adoption of
the following resolution, a resolution that the City Treasurer is hereby authorized and
directed to review the possibility of retiring a portion of the City's Utilities Revenue
Warrants, Series 2005 , and refunding , at a lower interest rate , the balance of the
Series 2005 Warrants , to discuss the matter with prospective lenders and bond
counsel and to report to the City Council the results of such review and discussion .
The motion was seconded by Councilmember Mueller. The City will refinance $1.7
million with an approximate savings of $800,000.00. After further discussion,
motion passed unanimously by voice vote .
RESOLUTION NO. 2347-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, that the City Treasurer is hereby authorized and directed to review the
possibility of retiring a portion of the City's Utilities Revenue Warrants, Series 2005,
and refunding, at a lower interest rate, the balance of the Series 2005 Warrants, to
discuss the matter with prospective lenders and bond counsel and to report to the City
Council the results of such review and discussion.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award Bid for Demolition and Replacement
of Community Park Aquatic Playground (Bid No. 005-15) for the Recreation
Department in the amount of $95,784.85. Seconded by Councilmember Boone,
motion passed unanimously by voice vote.
RESOLUTION NO. 2348-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Demolition and
Replacement of Community Park Aquatic Playground for the Recreation Department
(Bid Number 005-15) at 555 South Section Street in the City of Fairhope offices,
Fairhope, Alabama.
[2] At the appointed time and place, the following bids were opened and tabulated as
follows:
Please see attached Bid Tabulation for
Demolition and Replacement of Community Park Aquatic Playground
for the Recreation Department
[3] After evaluating the bid proposals with the required bid specifications, J. A.
Dawson & Company, with the total bid proposal of $95,784.85, is now awarded the
bid for Demolition and Replacement of Community Park Aquatic Playground for the
Recreation Department.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution that Mayor Timothy M. Kant is hereby
authorized to execute a Contract for Professional Consulting Services for the City of
Fairhope with Cavanaugh Macdonald Consulting, LLC (RFQ No. PS006-15) to
prepare the Actuarial Valuation of "other post employment benefits" for the Fiscal
Year Ending September 30, 2014 with a cost not to exceed $7,000.00. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.

RESOLUTION NO. 2349-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute a Contract for Professional
Consulting Services for the City of Fairhope with Cavanaugh Macdonald Consulting, LLC to prepare
the Actuarial Valuati on of 'other post employment benefits ' for the Fiscal Year Ending September 30,
20 14 ; RFQ No . PS006-15 with a cost notto exceed $7 ,000 .00.

the following resolution, a resolution that the City Council approves the selection of
Hutchinson, Moore & Rauch, LLC for Professional Engineering Services for Project
No. PW004-15 , Drainage Restoration by Treatment Plant; and hereby authorizes
Mayor Timothy M. Kant to negotiate the fee schedule; and due to the NRCS grant
time constraints, authorizes the Mayor to execute the associated Contract if a not to
exceed figure of less than $25 ,000.00 can be established. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.
RESOLUTION NO. 2350-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the City Council authorizes Mayor Timothy M. Kant
to execute · a Contract with Hutchinson, Moore & Rauch, LLC for Professional
Engineering Services for the Woodlands "EWP" Drainage Restoration Project
(PW003-15), thro ugh the United States Department of Agriculture National
Resources Conservation Service ("NRCS") for Project No. F AI -14-002, with a cost
not to exceed $58,200.00.

Councilmember Boone introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award Bid for Scenic 98 -Hwy 104 Gas
Pipeline Bore and Install 2015 (Bid No. 0 19-15) for the Gas Department in the
amount of $78,000.00. The motion was seconded by Councilmember Ford. Council
President Burrell commented that the funds for the gas pipeline will come from an
excavator that was budgeted that can wait until next year. After further discussion,
motion passed unanimously by voice vote .

RESOLUTION NO. 2352-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[1] That the City of Fairhope did request, receive, and open bids for Scenic 98-Hwy
104 Gas Pipeline Bore and Install 2015 (Bid Number 0 19-15) for the Gas Department
at 555 South Section Street in the City of Fairhope offices, Fairhope, Alabama.
[2] At the appointed time and place , the following bids were opened and tabulated as
follows:

[3] After evaluating the bid proposals with the required bid specifications, Pat Taylor
Construction Company, Inc., with the total bid proposal of $78,000.00, is now
awarded the bid Scenic 98 -Hwy 104 Gas Pipeline Bore and Install 2015 (Bid
Number 0 19-15) for the Gas Department.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution, a resolution to Purchase two (2) Kubota F2690 Front
Mowers for the Public Works Department and requested item is available for direct
procurement through the National Intergovernmental Purchasing Alliance with an
approximate amount of $39,888.30 to allow for freight cost variations at ship time.
Seconded by Councilmember Boone, motion passed unanimously by voice vote.

RESOLUTION NO. 2353-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
(1] That the City of Fairhope has voted to purchase Two (2) Kubota F2690 Front
Mowers for the Public Works Department and the type of equipment needed is on the
National Intergovernmental Purchasing Alliance ("National IP A"); and therefore does
not have to be let out for bid. The total cost is approximately $39,888.30 to allow for
freight cost variations at ship time .

Councilmember Ford moved to appoint and reappoint the following
individuals to the Fairhope Airport Authority: Howard "Ray" Hix, Jr. to complete the
term for Howard Hadley which will expire in March 2019; and to reappoint Jack
Burrell and Joe McEnerney for a six-year term which will expire March 2021.
Seconded by Councilmember Boone , motion passed unanimously by voice vote.
Council President Burrell recognized Joe McEnerney who was in the audience and
said he serves as our Treasurer.
Council President Burrell announced that Agenda Item No. 14 was pulled
from the agenda at the request of Councilmember Boone to allow the Harbor Board to
review and make a recommendation.
Councilmember Brewer moved to appoint Wayne Brunson to the Museum
Advisory Board for a three-year term which will expire April 2018. Seconded by
Councilmember Ford, motion passed unanimously by voice vote.

Ci ty Council reviewed an application for a Beer/Wine Off Premises License
by Lawrence Gatta , Jr. for Dolgencorp , LLC d/b/a Dollar General Store # 15459
located at 9782 County Road 32 , Fairhope , Alabama. Councilmember Brewer moved
to approve the issuance of the license. Seconded by Councilmember Boone, motion
passed unanimously by voice vote.
Planning Director Jonathan Smith addressed the City Council to explain the
Site Plan Review of property owned by Ja y Steven Mobley; represented by his agent
The Broadway Group , LLC, located on the south side of Morphy A venue just east of
U.S. Highway 98 , Fairhope , Alabama for a proposed New Retail Store.
Councilmember Brewer moved to approve the Site Plan property owned by
Jay Steve Moble y listed above subject to the Planning Commission's
recommendations. Seconded by Councilmember Boone, motion passed by the
following votes: AYE -Burrell , Mueller , Brewer, Ford , and Boone. NAY -None.
The following individuals addressed the City Council during Public
Participation for Non-Agenda Items:
I) Francis Paul Ripp, 22985 High Ridge Road , addressed the City Council regarding his
concerns with Tamara Wintzell barbecuing at her residence and neighbors'
complaints.
Councilmember Boone moved to adjourn the meeting. Seconded by
Councilmember Brewer, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was dul y adjourned at 6:35 p.m.
