The City Council , City of Fairhope , met in regular session at
6 :00p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532 , on
Thursday, 12 November 2015.

Present were Council President Jack Burrell , , Diana Brewer and Michael A.
Ford, Mayor Timothy M. Kant, City Attorney Marion E. Wynne , and City Clerk Lisa
A. Hanks. Councilmembers: Rich Mueller and Kevin Boone .
There being a quorum present , Council President Burrell called the meeting to
order. The invocation was given by Father Donald M. Smith from St. James
Episcopal Church, and the Pledge of Allegiance was recited. Councilmember Brewer
moved to approve minutes ofthe 26 October 2015, regular meeting; minutes ofthe 26
October 2015, work session; and minutes of the 26 October 2015 , agenda meeting.
Seconded by Councilmember Ford , motion passed unanimously by voice vote.
Water and Sewer Superintendent Dan McCrory and Dr. Barry Boothe
addressed the City Council regarding the Water Department's Water Fluoridation
Quality Award. Mr. McCrory commented this award was announced by the State of
Alabama Public Health and given by the U. S. Centers for Disease Control and
Prevention. The award recognizes a year of consistent fluoride levels for optimum
oral health. Dr. Boothe commented on the Poppies for Veteran event and
commended the City for all of its support. He thanked the City Council for the
consideration and funding for the signage for the cemetery project. He commented
water fluoridation is one of the 10 great public health achievements in the 20th
century. Dr. Boothe said that he did not know any dental professionals that want
fluoride left out of the water.
Public Works Director Jennifer Fidler and Nancy Anderson (Chairman of the
Recycling Committee) addressed the City Council regarding America Recycles Day
on Saturday with community shredding and electronic recycling. This will be held at
the South Beach Park from 9:00a.m. to 2:00p.m. Ms. Anderson said they will have
a booth at this event for the Recycling Committee. She said the City of Fairhope
based on her grading system is an "AB " moving towards an "A+."
Councilmember Ford said Nancy Anderson as chairman of the Recycling
Committee does a wonderful job ; and she is a great volunteer.
Council President Burrell stated we had a great event at the memorial service
yesterday with approximately 500 attendees. He commented how great the handmade
ceramic poppies looked too.

Council President Burrell mentioned that all of the Councilmembers except
Councilmember Ford attended the National League of Cities Convention which was
held in Nashville this year. He stated that this convention was beneficial to everyone
who attended.
Councilmember Brewer moved for final adoption of Ordinance No. 1552, an
ordinance to amend and add to Chapter 21 Utilities and Services, Article II, Electric,
Additional Labor Cost Adjustment (LCA) Factor, Fairhope Code of Ordinances.
(Introduced at the October 26, 2015 City Council Meeting) Seconded by
Councilmember Ford, motion for final adoption passed by the following voice votes:
AYE-Burrell, Brewer, and Ford. NAY -None.
Councilmember Brewer moved for final adoption of Ordinance No. 1553, an
ordinance to amend and add to Chapter 21 Utilities and Services, Article V, Gas,
Additional Labor Cost Adjustment (LCA) Factor, Fairhope Code of Ordinances.
(Introduced at the October 26, 2015 City Council Meeting) Seconded by
Councilmember Ford, motion for final adoption passed by the following voice votes:
AYE-Burrell, Brewer, and Ford. NAY-None.
Councilmember Brewer moved for final adoption of Ordinance No. 1554, an
ordinance to amend and add to Chapter 21 Utilities and Services, Article III, Water,
Additional Labor Cost Adjustment (LCA) Factor, Fairhope Code of Ordinances.

Councilmember Ford, motion for final adoption passed by the following voice votes:

Councilmember Brewer moved for final adoption of Ordinance No. 1555, an
ordinance to amend and add to Chapter 21 Utilities and Services, Article IV, Sewers,
Additional Labor Cost Adjustment (LCA) Factor, Fairhope Code of Ordinances.
(Introduced at the October 26, 2015 City Council Meeting) Seconded by
Councilmember Ford, motion for final adoption passed by the following voice votes:
AYE-Burrell, Brewer, and Ford. NAY-None.
Councilmember Brewer introduced in wntmg an ordinance to Provide
Standards for the keeping of Domestic Poultry in Single-Family Residential Zones in
the City of Fairhope. Planning Director Jonathan Smith explained the ordinance and
answered any questions. Councilmember Brewer stated this was good work on the
ordinance and it has been well received.
Due to lack of a motion for immediate consideration, this ordinance will layover until
the November 23,2015 City Council meeting.

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution , a resolution that the City Council approves the selection of
Compliance Support Associates , LLC for Professional Consulting Services for ADA
Compliance for RFQ No. PSOO 1-16 ; and hereby authorizes Mayor Timothy M. Kant
to negotiate the fee schedule. Seconded by Councilmember Ford , motion passed
unanimously by voice vote. Council President Burrell commented this is required
legislation for ADA compliance.
RESOLUTION NO. 2445-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the City Council approves the selection of
Compliance Support Associates , LLC for Professional Consulting Services for ADA

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution , a resolution that the City of Fairhope authorizes submission
of a FY2016 Alabama Coastal Area Management Program ("ACAMP ") provided by
National Oceanic Atmospheric Administration Grant Application to ADCNR
requesting $15 ,000.00 in grant funds and authorizes the Mayor to sign the required
grant application on behalf of the City; and if the grant is funded , the City will
provide the required matching funds of $15 ,000 .00 either cash or in-kind services.
Seconded by Councilmember Ford , motion passed unanimously by voice vote.

RESOLUTION NO. 2446-15
AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION
TO THE ALABAMA DEPARTMENT OF CONSERVATION
AND NATURAL RESOURCES

WHEREAS, there is a need for the City of Fairhope to develop a Beach Management
Plan for the City of Fairhope ; and
WHEREAS, there is grant funding available for said coastal planning in the Alabama
Coastal Area for FY20 16 Alabama Coastal Area Management Program ("A CAMP ")
provided by National Oceanic and Atmospheric Administration Grant funds
administered by the Alabama Department of Conservation and Natural Resources
(ADCNR); and
WHEREAS, the total project cost estimate is $30 ,000 .00 , and the grant requires a
50% match in either cash or in-kind contributions ;
THEREFORE, BE IT RESOLVED BY THE CITY OF FAIRHOPE, IN
REGULAR SESSION ASSEMBLED , that by this Resolution the City of Fairhope
authorizes submission of a FY20 16 Alabama Coastal Area Management Program
("ACAMP") provided by National Oceanic and Atmospheric Administration Grant
Application to ADCNR requesting $15 ,000.00 in grant funds and authorizes the
Mayor to sign the required grant application on behalf of the City.

Councilmember Brewer introduced in writing , and moved for the adoption of
the following resolution , a resolution that Mayor Timothy M. Kant is hereby
authorized to execute an Agreement concerning a Transportation Planning Process for
the Eastern Shore Urbanized Area between the County of Baldwin and the
Municipalities of Daphne , Fairhope , Spanish Fort , and Loxley and the State of
Alabama (acting by and through the Alabama Department of Transportation).
Seconded by Councilmember Ford , motion passed unanimously by voice vote.
RESOLUTION NO. 2447-15
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE , that Mayor Timothy M. Kant is hereby authorized to execute an

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution , a resolution that the City Council hereby repeals Resolution
No. 1775-11 ; and approves and adopts the recommended fees associated with
rental/maintenance of the City of Fairhope Recreation Parks. Seconded by
Councilmember Ford , motion passed unanimously by voice vote.

RESOLUTION NO. 2448-15
WHEREAS , on April 25, 2011 the City Council adopted Resolution No. 1775-11 for
fees associated with rental of the City of Fairhope Recreation Parks; and
WHEREAS , the Recreation Board is desirous for the City Council to revise the fees
for field/rental maintenance as recommended below:
$50.00 per field per day
$30.00 per hour per man hour for personnel support per day
$500.00 for use of W. C. Majors Field
$100.00 clean-up fee.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the City Council hereby repeals Resolution No.
177 5-11; approves and adopts the recommended fees associated with
rental/maintenance ofthe City of Fairhope Recreation Parks:

Councilmember Ford moved to appoint Lee Faulk and Ralph Webster to the
Recycling Committee for a four-year term which will expire November 2019.
Seconded by Councilmember Brewer, motion passed unanimously by voice vote.
City Council reviewed an application for a Beer/Wine Off Premises Licenses
by Dhruvesh Amin, JSN Enterprise LLC, d/b /a Food Mart 104, located at 9990 State
Highway 104, Fairhope, Alabama. Councilmember Brewer moved to approve the
issuance of the license. Seconded by Councilmember Ford, motion passed
unanimously by voice vote.

Councilmember Brewer moved to grant the request of the Lee Tapscott on
behalf of the Fairhope K-6 Parent Teacher Corporation requesting permission to close
the streets in downtown Fairhope on Saturday , January 23 , 2016 from 6:00 a.m. to
10:00 a.m. for a 5K Run and 1 Mile Fun Run ("The Pirate Dash ") to raise money for
the educational needs of the Fairhope Elementary and Fairhope Intermediate Schools.
Seconded by Councilmember Ford , motion passed unanimously by voice vote.
Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Ford , motion passed unanimously by voice vote.
There being no further business to come before the City Council , the meeting
was duly adjourned at 6:29p.m.
