COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Thursday. 15 February 2018.
Present were Council President Jack Burrell, Councilmembers: Jay Robinson,
Jimmy Conyers, Robert Brown, and Kevin Boone, Mayor Karin Wilson, City
Attorney Marcus E. McDowell, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Burrell called the meeting to
order at 6:09 p.m. The inyocation was giyen by Reverend William Parsons, Pastor of
Redeemer Lutheran Church, and the Pledge of Allegiance was recited.
Council President Burrell said that Agenda Item Number 5 is a dead issue
now and no longer needed to be on the agenda. He said that Agenda Item Number 27
was pulled at the request of Mayor Wilson.
Council President Burrell stated there was a need to amend the agenda by removing
Agenda Item Number 5: Final adoption of an Ordinance Directing the Transfer of an
Acre of Land to Fairhope Single Tax Corporation and Declaring said property to be
Surplus and not needed for Public or Municipal Purposes; Property is for the
Tatumville Subdivision; introduced at the January 22, 2018 City Council Meeting;
and Agenda Item Number 27: A resolution that the City of Fairhope authorizes
submission of a pre-application to the National Fish and Wildlife Foundation
(NFWF) requesting an FY 2018 Gulf Coast Conservation Grant Program (GCCGP)
grant with a cost estimate of $250,000.00 (no matching funds are required); and
authorizes the Mayor to sign the required grant application on behalf of the City . He
said we needed to add on an agenda item after Agenda Item Number 31: a resolution
that the City of Fairhope has voted to purchase a 50 GPM Aplex Mud Pump for the
Vermeer 24 x 40 Directional Drill for the Electric Department; from Vermeer
Southeast Sales and Services, Inc. as Sole Source Distributor in Alabama; and
authorizes procurement based on the option allowed by the Code of Alabama 1975,
Section 41-16-51(13). The cost will be $12,679.58.
Councilmember Conyers moved to add on the above-mentioned item (s) not
on the printed agenda. Seconded by Councilmember Boone, motion passed
unanimously by voice vote.
Councilmember Robinson moved to approve minutes of the 22 January 2018,
regular meeting; minutes of the 22 January 2018, work session; and minutes of the 22
January 2018, agenda meeting. Seconded by Councilmember Conyers, motion
passed unanimously by voice vote.

Councilmember Brown introduced in writing, and moved for the adoption of
the following resolution, a resolution that the City Council hereby approves and
authorizes the City of Fairhope to execute a Memorandum of Understanding between
The Fairhope Arts and Crafts Festival Foundation and the City of Fairhope. The
motion was seconded by Councilmember Robinson and stated all were involved in
the discussions; and he is grateful for the Eastern Shore Chamber of Commerce.
However, the Foundation and the Chamber could not agree. Judge Floyd said he
spoke with the Chamber and Ms. Williams. Casey Gay Williams addressed the City
Council and said she did what she would to repair it; and several discussions were
held. Ms. Williams said prior to the MOU this was a 50/50 partnership; and thought
this was a one-year MOU with the Foundation. She said the Chamber made a
proposal and it was denied; and it was not worth going to battle. Ms. Williams said
she and the Chamber said they want the best for the City, so we let this go forward
and bowed out. Councilmember Robinson thanked Ms. Williams for her passion.
Councilmember Conyers said he wished things could have been worked out. He said
this is a three-year deal and we will give it a chance. He also commented both are
great entities. Council President Burrell said he met with both parties to try to work
things out. He said we talked about money and terms; and worked on a three-year
MOU. Mayor Wilson said she does not know why it is an exclusive MOU; and we
have a new director for Chamber and new director for Eastern Shore Art Center.
After further discussion, motion passed unanimously by voice vote.
RESOLUTION NO. 2976-18
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the City Council hereby approves and authorizes the
City of Fairhope to execute a Memorandum of Understanding between The Fairhope
Arts and Crafts Festival Foundation and The City of Fairhope.
