E. McFarland, Clerk, Fairhope, Ala. Gentlemen: - The chances are I will not be able to get over to your town council meeting on the evening of 12th inst., which I regret. However, I look upon you people as being fair minded and eo will not worry about what may or may not be your action as to what you may deem fair for me under existing conditions of the water question as it is now showing up. Relative to the speed of the pump, I would say, that if the new wells will stand continuous pumping with only 28 or 30 strokes to the minute, it will really be better for the pump, and if the pump will not speed up to more than 32 strokes to the minute when on the open wells while water is plentiful in them, it would not be possible under any conditions to speed the pump up any more on the new wells unless you had a larger discharge line, as it is you are running at the full capa- city of your pump, hence it looks to me as though I have fulfilled my contract. It shall be unlawful for any person to dump tin cans, or rubbish, or garbage of any kind upon any of the streets of the Town or in any other private or public place, except such place or places as may be designated by the mayor as dumping place 5 and no person shall throw away any tin can without perforating it so that it will not hold water. There any dumping place 0 desig- nated shall be over the edge of any bank or into any gulley, ort any depression, it shall be unlawful for any person to so dump other than over such bank6r into such gulley or depression, or so as to prevent any ot..er person dumping from ¢eady access to the . edge of such bank or gulley to throw Mhe material he may be dump- ing over such bank or into such gulley or depression. Any person violating any of the provisions of this ordinance shall, upon con- viction, be fined not less than one dollar nor more than fifty dollars. 7 Jan. 19,1920. To the Honorable Msyor and Town Council, Gentlemen: - By action of the Council of our Corporation at its reg- 0 ular meeting it was voted to have t':e trash cleared up tIVough- ly at the dumping ground on Section street, opposite the come - notice requiring tery and that your body be requested to nost a persons dumping trash there to throw same over the bank, so as not to interfere with next comer doing the same. It was also voted, if town approveseto change the plat of Colony land, 'in "Division Three" to make Oak street, a uniform width of 66 feet from Section street west, instead Al of widening toward the bay, one foot and a half fcr each sixty- bix foot lot on the north side of the street. Ifyou will note your copy of the plat filed by the S.T.Corporation An Sept. 13,1911, you will see that it shows the Bowman lot (lot l,blk.2, div. 3) extending out into the street, which was because the cowman leaso had been granted according to an earlier plat and the Corporation had not yet completed agree- ment with Mr. Powen for a change of the plat. The change now pro- posed would out off' about fifteon feet at the southeast corner of the Bowen lot as at present enclosed and would at the southwest corner be about three feet south of the present fence corner. This chlnce is agreeable to Mr. Bowman, and, if approved by V17 you, the S.T-.Corporation, will, at once, move the fences of Mr. Powman to conform to the new platting on all sides, moving the garage back on the lot so as to be out -of the line of vis- ion down the street from the front of the lots to the east. The change will leave i:r. Powman's cOtt -•ge about 15 feet from Oak street at the nearest point. AIA.,12/31/19 Dear Sir: - The amendment granting relief to 42 cities and towns in Alabama seems,to have been adopted by the voters in Alabama. In some of these cities, if not in all of them, some part of the increased revenues probably has been plan- ned for schools, and mainly for teachers' salaries. We are writing you to know what your plans pro- vide, and we would like to know: (1) Do you plan to call an electio� soon asking for increased revenues? (2) For what purposes will you ask the increased revenues? In answering kindly suggest in mills for School buildings, teachers' salaries, streets, or what- ever purposes each part of the increased revenues may go. (3) How do you regard the situation in your city or town, as to school buildings, salaries of teachers, pum- ber of teachers, training and equipment of your teachers? (4) From ,your observation and knowledge of the situation, ` what do you think is a fair raise in the salaries of teachers? Would it be fair to place a minimum say of $1000 for teachers salaried.: payable in ten instalments, beginning with the school session, the last instalments depending on completing the school term, i.e., teachers not finishing the term would not be entitled to draw for months following close of school? (5) Is $1500 too much for a normal graduate to expect, with three year ¢essf ul experience following graduation? Would yo r a scale ranging from $1000 to $1500 based normal school graduation and successful expo ence? You will understand that this paper will handle your answers without using your name, unless you ask that it be used. We do desire to compile the answers for an article to appear soon dealing with the salary situation in Alabama. We want the inter- ested layman-s view. At tho request of the Mayar-I left -airhope teat Monday evening, Sept. 3rd, for Montgomery, in the interest of bills pending before the legitlature in which the Town is . interested, because of larger bonding capablty prposed for public improvements and improved conditions regarding bond is- sues which it was believed would make it much easier for towns to find buyers for their bonds. Taking a night train out of Mobile I was in Montgom- ery early in the morning. I got in touch as soon as I could with Senator Brooks, of this district, who had the bills in charge in the senate and with our representative, Dr. Hodgson. Senator Brooks reported that he had found no opposition to the bills and felt confident of a favorable report on them by the senate committee to which they had been referred. Reprocenta- tive Folmes assured no that lie mould do all that he could to secure their passage through the house. Neither house nor senate was in session nor was any meeting slated of the senate commitee to which the bills had been referred. I embraced every opportunity to urge favorab'_o action on the bills by individual members whom I could neat. I was unable to locate Mr. Totten, of nirmingliam, who had corresponded with the Mayor regarding the bills and Tednesde.y morning telephoned to his office at nirmingham finding that he was not there but had boon expected to be in Montgomery the day previous. I could not learn from the of- fice of anybody in Montgomery especially having the matter in charge. CIVIL CODE OFFICERS. Section 2. —The oficers of the Town of Fairhope, in addition to the Mayor and Town Cloth, shall be a Treasurer, a Health Officer and a Town Attorney. These oficers to be appointed by the Mayor, subject to the approval of the theeCouncil, and to hold office iron the time of such app il the expiration of the term of the Mayor by whom appoini"'i nnleas sooner removed by order of the Mayo=.i Likewisl. the same terms and conditions, a Town Marshal and such ll ' ties as may, from time to time be found neeessary. TREASURER. Section 3. The Treasurer shall be the custodian of all funds of the Town, which shall be paid over to him as soon as practicable by the Town Clerk. Ile shall pay out the same only upon warrants signed by the Mayor and Town Clock, and shall give bond for the faithful performance of his duties in such sum as the Council may from time to time require, which bond, until otherwise provided, shall be Five Hundred dollars. He shall receive for his services Twenty -Five dollars per am anal, payable at the end of each quarter. MAYOR'S SALARY. Scotian 4. The salary of the Mayor shall be One Hundred dollars per annual, payable quarterly. TOWN CLERK. Section 5. The duties of the Town Clerk, in addition to those described by Article 11 of the Code of Alabama of 1907, shall be to attend to the assessment and collection of taxes, as provided by law, and to act as clerk to the Recorder's Court, and for his services he shall receive a salary of One Hundred dollars per annum, payable monthly. TOWN MARSHAL. Section 6. The Town Marshal and his deputies, with such regular or special policemen as may be from time to time ap- pointed, shall preserve order, peace and quiet, and enforce the laws and ordinances throughout the Town. They shall have power to arrest all persons in the Town found in the act of violating any law or ordinance, all dangerous and suspicious characters, and all persons found under suspicious circum- stances, and take such to the police station to be committed to the town lockup unless they give bond according to law. They shall have the power and authority to serve and execute warrants or other process for the apprehension and commit- ment of persons charged with the commission of any crime, misdemeanor, or violation of any law or ordinance of the town, and shall execute such civil process, means or final, as the Recorder or Clerk is authorized to issue, and while making the arrest, or executing any warrant or process, state or mu- nicipal, shall be vested with all the powers and authority con- ferred on lawful officers of the State by the Code and Laws of Alabama. It shall be the duty of the Marshal to collect all fines imposed by the Recorder and, after such fines have been im- posed, unless the same be immediately paid, or adequately se- cured, said Marsha] shall at once take the defendant into cus- tody and shall compel said defendant to perform hard labor an the streets or other public works of said Town, until the alternate sentence of hard labor shall have been complied with; and, whenever the Recorder shall impose a fine, he shall also impose an alternative sentence of hard labor. The Marshal shall receive for his services fees as provided for similar services for the Sheriff of Baldwin County, TOWN ATTORNEY. Section 7. FELS AVENUE. Section 12. The street grade of Fels Avenue is hereby established to conform as nearly as practicable to the sur- face of the land through which it runs. Between Liberty Street and Church Street the top of the hill is to be reduced not to exceed two (2) feet. The sidewalks of Fels Avenue are hereby established to be sixteen (16) feet in width on each side. DESIGNATED DEPOSITORIES. Section 13. The City Bank & Trust Company of Mobile and the Bay Minette Bank of Bay Minette are designated de- positories of all monies of the Town of Fairhope. BUILDING RESTRICTIONS, Section 14. No building shall be erected within the cor- porate limits of the Town of Fairhope after August 1st, 1909, except in accordance with the following provisions and re- striations: 1. In any block in which other buildings are now in ex- istence no building shall be erected nearer to the street on which it is to front than the average distance from said street of the buildings already on said block. U. In blocks where there are no buildings, none shall be Oforled uoaror than thirty feet from the sidewalk except W1d111w erected for mercantile purposes. R. CRIMINAL CODE RECORDER'S COURT. Section 15. The Recorder's Court shall be, held daily. Sundays and legal holidays excepted, in such building na the Council shall designate for the purpose, at such hour as the Recorder may appoint. The Town Clerk shall set ns Clerk of the Recorder's Court with authority to approve bonds, take affidavits and sign all processes, civil and crim inal. The procedure in the Recorder's Court shalt be, ns nearly as practicable, that before Justices of the Peace in analogous cases. The Recorder may reduce or retail any fine or sentence, or pardon any person convicted of violating any Town ordinance upon proper cause shown to him. FINF9 AND FORFEITITRES. Section 16. All fines, costs, penalties, forfeitures of hall and appearance bonds and other amounts required to be paid into the Town Treasury by and through proceedings in the Recorder's Court, and on appeals therefrom, shall he kept in a separate fund called the Fine and Forfeiture Fund, !,it or which the 4larshal's fees and expenses in criminal matl.erc are to be paid. At the end of each fiscal year, any balance on hand in said fiend after the payment of auy amounts due tlm Marshal and his deputies, shall be paid into the general Treasury of the Town. COSTS OF TRIALS. Section 17. The costs of proceedings before the Reeordcr shall be in substance these prescribed for before the Recorder of the City of Mobile and set forth in the Mobile C-ty Code of 1907 on pages 334 to 339, inclusive; but variations not of Sol) - .stance shall not impair the validity of the proceedings. PENALTY NOT PRESCRIBED. Section 18. Whenever any ordinance pronoannea nu of- fense, but provides no penalty, the penalty shall be a file nt the discretion of the Recorder not to exceed Fifty dollars, with imprisonment or hard labor not exceeding Fifty days, in default of payment. Any person who at any time washes his hands, fare, or feet, in any public fountain or drinking place in the Town, or obstructs the flow of water into the same, or, in any manner, tampers with or abuses such fountain, em drinking plate, evater tank, or well, or its fixtures, shall be fined in such n as the Recorder may impose, not exceeding Fifty dollars. DESTROYING PROPERTY. Section 25. Any person who shall injure, break down, destroy, or carry away, any fence, gate, step, or door of a house in the Town, or take down the force, or carry away any sign- board, plate, or card which indicates the name or occupation of any person doing business in the Town, or who breaks, cuts or injures any shade or ornamental tree; or hydrant, wit on public or private property, or who defiles or In!t any public er private wharf, boathouse, or bathhouse, or breaks or injures any street lamp erected for the benefit of the Town, or breaks or defaces any show window, or newly painted work, by malinionaly cutting or scratching the same, or otherwis, damages public or private property, shall, ,poll eomiet!ou, be fined by the Recorder not more than Fifty dollars. FALSE ARREST. Section 26. DISPUTES BETWEEN PROPERTY OWNERS. Scotian 30. In all eases where any dispute shall arise as In the necessity of repair, or its extent, or the sum of money to be paid by either party for the erection, building, or re- pairing of any partition fence or wall, the party aggrieved amv complain to the Recorder, and, thereupon, the Recorder +hall appoint three respectable citizens of the Town as inspea lore, whose duty it shall be forthwith to examine into said natter and report to the Recorder the sum to be paid and Ill whom and by whom. Thereupon, the Recorder shall make an order requiring the delinquent, within the term of ten dnya, to pay to the person to whom the same may be due, the anm so reported by a majority of ill' inspectors', and two dol- lara to each inspector; and, if the delinquent shall neglect or refuse, after due notice of this order to pay said sum of money, he shall be fined. in such sum as the Recorder may im- pose, not exceeding Fifty dollars. INJURING TREES. Section 31. No one shall, without the consent of the Downer, hitch or otherwise fasten any horse or other animal to a sidewalk tree, m• use, cut, or otherwise injure any such I ree, except as herein above allowed. No one shall cut, fell, ring, bark, break, or damage in any manner, any tree, plant is or abrob which planted in any walk, square, street, road or other public place in the Town of Fairhope. Any violation of this section shall be pnnkhod by a fine not exceeding Fifty dollure. 11 TRESPASSING ON BOATS. Section 32. Any person boarding a boat after being warned by the captain, mate, or other person in charge, and any person persisting in interfering with the orderly discharge of business at the boat landing, shall be punished by a fine not exceeding Fifty dollars. DISORDERLY HOUSES. Section 33. To keep a house of ill fame, or for gaming, and act. of drunkenness, lewdness, indecent exposure of ongs person, or other disorderly conduct in the Town of Fairhope, are each declared to be unlawful, and every person guilty of such offenses shall, upon conviction. be fined in a sum not more than One Hundred dollars, or imprisoned, tor sentenced to hard labor for the Town not exceeding One Hundred days. RIOTS, AFFRAYS, ASSAULTS, FTC. Section 34. Riots, unlawful assemblies, affrays, assaults, (� assaults and batteries, drunkenness, lewdness, or other disor-derly ennduct and breaches of the peace, are hereby declared unlawful and every person, upon conviction before the Mayor, shall be fined in any sun., not In., than Five dollars, nor more than One Hundred dollars, or imprisoned, or sentenced to hard labor fortheTown not exceeding One Hundred days. DISCHARGING FIREARMS Section 35. It shall be mdawfud for any person to dis- charge any gum, pistol, or other fire arme within the cor- porate limits of the Town of Fairhope; without a special permit from the Mayor for each and every occasion, except, it he far the protection of person or property. Any person convicted he or before the Mayor of violating this ordinance shall he fined in any sum not exceeding Fifty dollars, or, a sentence of not more than Fifty days hard labor for the Town. LIQUOR SELLING Section 36. It shall be unlawful for any person, or per- sons, to sell, have for sale, ar offer for sale, or otherwise dis- pose of, any spirituous, vinous or malt liquors, or intoxicating bitters, or other intoxicating drinks of any kindwithin the n corporate limits of said Town. Provided, that this ordinance 12 .hall not be construed to prevent the use of wine for Sacra- mental purposes, or the social or domestic use of liquors in private families. Any person or persons who will violate, or atlompt to evade, the provisions of this ordinance shall be domed guilty Iof a misdemeanor, and, upon conviction thereof, Shall he fined not less than Fifty dollars nor more than One hmdred dollars, and may also be imprisoned or sentenced to bard labor for the Town for a tern not exceeding Sis menthe. THROWING MISSILES. Section 37. RECKLESS DRIVING. Section 38. Whoever shall wilfully and intentionally, or recklessly, drive any animal in the streets of Fairhope so as Igo Ounce said animal or vehicle attached thereto to come in contact with or strike another object or person, or drive an animal that is disqualified for service by reason of lameness, marked signs of poverty, or other inability to perform Snell work, or shall inhumanly or cruelly beat, injure, or otherwise abuse any dumb animal, Shall, upon conviction, be fined not Iexx than Five dollars nor more than Fifty dollars. DEAD ANIAfALS. Section 39. The owner of any dead animal who shall knowingly permit the same to remain unburied within the Town limits or within half a mile thereof, more than eighteen hours after the death of said animal, Shall be fined not less than One dollar nor more. than Ten dollars for each offense, and rgch day after the first eighteen hours shall constitute a separate offense. Any person digging up any of the streets or ewalks of the Town of Fairhope, or erecting any structure `` 15 or obstruction thereon without first abstaining permission of the Council, shall he fined not less than Five dollars nor more than Fifty dollars, or imprisoned not exceeding Ten days; provided, however, that no legitimate and proper work in con- structing and repairing streets and roads shall be considered a violation of this ordinance. All work wherein the streets or sidewalks shall be dug up, or any obstruction placed therein, after permission shall be granted therefor by the Council, shall be conducted under such reasonable regulations as to lighting at night, length of time in which said excavation or obstruction shall remain and other provisions intended for the benefit of the Town and the safety of the population as the Council shall provide. OBSTRUCTING WHARF. Section 45. Northrop and W. H. Roberta in interest of the Town of Fairhope, March 24-27, 1930. TUSKEGEE INSTITUTE, Tuekegee, Ala. System consisting of the following: Raw sewage strainer, Sand trap, Imhoff tank, Syphon tank and chlorine apparatus, Redimentatlon tank and Sludge bed. This system was installed in 1918 and is now taking care of approximately six tenths of the Institution which consists of 2000 students, 300 faculty and employees and their families. The tank has been in continuous operation and has given no trouble with one exception. In 1921 it was necessary to pump out the tank and remove a brick that had become lodged under a sludge valve. Some time ago, chlorination of the effluent from the Imhoff tank was discontinued and since that time maintainance has been practically nil. Standing directly upon the Imhoff tank, one could detect sewer gas being emitted from the gas pockets. Apparently this gas is quickly dissipated into the atmosphere for, standing off a distance of about 50 feet opposite from the direction of the wind the gas could not be detected. At the time of the visit there was about two inched of dried sludge on the sludge bed, having been drawn off more than e month previous. This sludge has no odor and because it contains a small amount of plant food, it is used about the grounds of the Institute as a fertilizer. A small amount of fresh sludge drawn off forinspection indicated no offensive odor. The final effluent from the sedimentation tank was clear and odorless water. This water passes into a small brook. GRORGIA WESLYAN COLLEGE, Macon, Ga. System installed 1928 consisting of the following: Imhoff tank, Syphon tank, Filtration bed and Sludge bed. The tank is serving a college of 250 students and nearly as many faculty and employees. No trouble of any kind has been experienced since installation. The to is ept�1 exce��lep' condition and no chlorine treatment is used nthe firia� after' tests better than 98% free from cola bacilli and is crystal clear. No odor was detected from any part of the system. Since the tank has been in operation, not more than two cubic yards of sludge have been removed. A small quantity of fresh sludge removed for inspection gave no signs of offensive odor. TOWN OF DONALDSONVILLE, Ga. System installed 1929 consisting of the following: Modified Imhoff tank and Sludge bed. This system is serving Donaldsonville, a town of about 1500 population. There was -no odor whatever. It is believed however that this tank is not functioning properly because of the absence of the usual cruet on the raw sewage hopper. The sludge bed indicated that no sludge has ever been drawn off. The effluent passes directly from the tank to a small brook.
