POSTED e/aa/11 ~Alt~ SIGNATURE STATE OF ALABAMA COUNTY OF BALDWIN )( )( The City Council met in a Work Session at 5 :25 p.m., City Hall, Delchamps Room, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 28 March 2011. Present were: Present were Council President Lonnie L. Mixon, Councilmembers: Debbie W. Quinn, Daniel Stankoski, Michael A. Ford, and Rick Kingrea, and City Clerk Lisa A . Hanks. Mayor Timothy M. Kant and City Attorney Marion E. Wynne were absent. Council President Mixon called the meeting to order at 5:25 p.m. The following topics were discussed: 1) The Noise Ordinance: • Councilmember Stankoski mentioned the decibel level is too high; and he did not understand the 200 ', 300', 400' limits. Does the clientele need it at 85 db(a)? • Jim Homer said we need a new ordinance. You can hear music inside the house and on decks . He mentioned health related issues: heart problems and stress related problems. Our ordinance makes excessive noise legal. • Patricia Havard stated on March 19, 2011, at 9:00 p.m., the police came and took four readings. The noise was plainly audible, but was only 60 db(a). She looked at six other cities' ordinances and none are higher than 85 db(a). No amplifiers or base should be outside. • Tricia Niemeyer stated no one would be satisfied. The government should not be involved. The language of the zoning supports Fly Creek Cafe. We are not going to agree on this ordinance . Amplification and bass should be allowed. The ordinance has not been in place long enough to decide if it is working or not. • Mark Polon said it depends on where you live. In the Central Business District, there is The Windmill and two bars near each other. It is unfortunate that we live down wind of noise and we should have a model of cities similar to Fairhope, not Mobile. • Clay Havard stated there is a Law of Nuisance; pursue enjoyment of home and life. The sound stops at the comer of my house. He wants his rights accepted too. 2) Historic Preservation "Draft" Ordinance: • Ralph Theyer mentioned that the draft ordinance follow state and federal laws relating to Historic Preservation Districts. It needs to be simple and clear. We ask that you read and make comments. He thinks ordinance is a good one . Work Session Monday, 28 March 2011 Page-2- • Billie Carlisle spoke on the noise ordinance; she said live and let live. Fly Creek Cafe is a family-oriented place. • Gary Gover stated that we need to refine the Strategic Plan and get inputs from Departments for the plan ; work through cycles .
