The City Council, City of Fairhope, met in regular session at
6:00 p.m.; Fairhope Municipal Complex Council Chamber;
161 North Section Street, Fairhope, Alabama 36532; on
Monday. 09 July 2001.
Present were Mayor Timothy M. Kant, Councilmembers: Robert C. Gentle,
Michael A. Ford, Debbie W. Quinn, Pauline Anders, and Cecil Christenberry, and City
Clerk Geniece W. Johnson. City attorney Marion E. Wynne was absent.
There being a quorum present, Mayor Kant called the meeting to order. The
Pledge of Allegiance was recited, and the invocation was given by Wayne Smith,
Purchasing Agent. Councilmember Quinn moved to approve minutes of the 25 June
2001, regular meeting. Seconded by Councilmember Anders, motion passed
unanimously.
Councilmember Quinn moved for final adoption of Ordinance No. 1129. An
ordinance to exercise the power to issue building permits within the Police Jurisdiction,
effective October 1, 2001. This ordinance was introduced June 11, 2001. Seconded by
Councilmember Anders, motion for final adoption of Ordinance No. 1129 passed by the
following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, Christenberry. NAY -None.
A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 557. Councilmember Gentle introduced in writing Ordinance No.
1130. The Planning & Zoning Commission recommended approval of this ordinance.
An ordinance to Re -zone Juanita Griffing's property from RA -Residential Agriculture to
R2- Medium Density Single Family Residential. The property is located at 9101 Morphy
Avenue. No one present was opposed to the amendment. In order to take immediate
action, Councilmember Anders moved for immediate consideration. Seconded by
Councilmember Quinn, motion for immediate consideration passed unanimously by the
following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -
none. Councilmember Gentle then moved for final adoption of Ordinance No. 1130.
Seconded by Councilmember Christenberry, motion for final adoption passed
unanimously by the following votes: AYE -Gentle, Ford, Quinn, Kant, Anders, and
Christenberry. NAY -none.

A Public Hearing was held as advertised on a proposed ordinance to amend the
Zoning Ordinance No. 557. Councilmember Gentle introduced in writing Ordinance No.
1131. The Planning & Zoning Commission recommended approval of this ordinance.
An ordinance to address Freestanding Commercial Buildings. No one present was
opposed to the amendment. In order to take immediate action, Councilmember Quinn
moved for immediate consideration. Seconded by Councilmember Anders, motion for
immediate consideration passed unanimously by the following votes: AYE -Gentle, Ford,
Quinn, Kant, Anders, and Christenberry. NAY -none. Councilmember Christenberry
then moved for final adoption of Ordinance No. 1131. Seconded by Councilmember
Gentle, motion for final adoption passed unanimously by the following votes: AYE -
Gentle, Ford, Quinn, Kant, Anders, and Christenberry. NAY -none.
Councilmember Gentle introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Ford, motion passed unanimously.
RESOLUTION NO. 771-01
WHEREAS, The City has recently adopted a new Comprehensive Plan. This plan is a
visionary document that has significant community and input.
WHEREAS, In order to ensure that the development in Fairhope agrees with the City's
new Comprehensive Plan, the development requirements must be examined.
WHEREAS, The Planning Commission has realized that our current subdivision
regulations do not actively put on the ground the principles set forth in the
Comprehensive Plan.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to enter
into a contract between the City of Fairhope and Gould, Evans, Goodman Associates,
LC, Kansas City, Missouri, to provide professional planning services to rewrite the City's
Subdivision Regulations.

Councilmember Anders introduced in writing, and moved for the adoption of the
following resolution. Seconded by Councilmember Quinn, motion passed unanimously.
RESOLUTION NO. 772-01
WHEREAS, the City of Fairhope is desirous of having the noise level by the Air Blowers
at the City's Water Reclamation facility (WWTP) reduced.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT Mayor Timothy M. Kant, is hereby authorized to execute a contract
and a Task Agreement No. 2 between the City of Fairhope and Volkert & Associates,
Inc. for providing professional services for the design of a wall around the Air Blowers
that will absorb, and redirect the sound level to a lesser level. The Contract establishes
the terms and conditions and the Task Agreement is the scope of work and fee for the
project.

Councilmember Anders moved to deny the request from G. Geoffrey Cain for the
Marietta Johnson Museum requesting to waive the rental fee for the Civic Center for the
museum's community dance on September 15, 2001. Seconded by Councilmember
Christenberry, motion passed unanimously.
Thomas Reid addressed the City Council and read a letter written by himself. Mr.
Reid expressed his comments regarding Gayfer Road and County Road 13 intersection.
Mr. Reid expressed how dissatisfied he was with the Governing Body's action with
regards to speeding in Fairhope. Mr. Reid also expressed that he holds the City
responsible for the death of Christopher Boyett. The Boyett's lost their son, Christopher
Boyett, in a car accident on Monday, 28 May 2001, at the intersection of Gayfer Road
and County Road 13. Mayor Kant thanked Mr. Reid for his comments and asked Officer
Christopher Browning to give a police report on this intersection.

Councilmember Anders commended the Police Department, and expressed that
the Gayfer Road and County Road 13 intersection is in the County, not the City. The
City Council authorized Mayor Kant to write a letter to the County (29 May 2001)
requesting that something be done at this intersection.
Councilmember Gentle, Chairperson of the Street Committee, reported on the
request of Cindy Meichner and Helen Price, requesting a traffic control light at the
intersection of U.S. Highway 98 (Greeno Road), Middle Street and Spring Run Drive.
Upon completion of the Police Traffic Study Officer Browning recommended to the
Street Committee to install a traffic light at this intersection. Officer Browning stated
that this intersection is a unique intersection as drivers are having to cross five lanes of
traffic, and the traffic has increased at this intersection due to the increase of businesses
in this area. Councilmember Gentle moved to petition the state for a traffic light at this
intersection. Seconded by Councilmember Anders, motion passed unanimously.
Councilmember Gentle moved to accept the low bid of James Brothers
Excavating, Inc., of Daphne, AL, provided all specifications are met. Seconded by
Councilmember Ford, motion passed unanimously.
Sherry Sullivan and others responsible for the 4`h of July festivities were thanked
for an excellent 41h of July celebration.
Greg Cunningham and Jeff Cabana addressed the City Council expressing their
concerns about the flooding in Fairfield Subdivision, and asked what could be done to
divert some of the water running across Fairfield Subdivision. Mayor Kant stated that
during the development of Fairfield Subdivision it was in the County's jurisdiction. This
property was annexed into the City last year (4/2000). Mayor Kant also expressed that he
and Councilmember Quinn had met with the engineer and they are looking into what can
be done to resolve this problem.
Mr. Cabana presented a video to the City Council to view the water problems in
Fairfield Subdivision.
Councilmember Gentle moved to pay bills as presented. Seconded by
Councilmember Ford, motion passed unanimously.
There being no further business to co a before the City Council the meeting was
duly adjourned at 6:06 p.m.
