TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE
22 NOVEMBER 1 999, REGULAR MEETING. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
A PROTEST MEETING (PUBLIC HEARING) WAS HELD AS ADVERTISED ON
THE 1 999-2000 PUBLIC IMPROVEMENT ASSESSMENTS PROJECT. MR.
JOHN AVENT, WITH ENGINEERING DEVELOPMENT SERVICES LLC, PRESENTED
THE FOLLOWING ESTIMATED COST FOR COUNTRY WOODS SUBDIVISION:
COUNTRY WOODS SUBDIVISION - 34 LOTS AT $9,9 1 9.06/LOT, OR
APPROXIMATELY $337, 248.00. THE PROPERTY OWNERS PRESENT
GREED TO GO AHEAD WITH THE IMPROVEMENT.

A RESOLUTION CONFIRMING IMPROVEMENT ORDINANCE NO. 1074, ADOPTED
NOVEMBER 22, 1999.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA,
as follows:
Section 1. That upon evidence presented to and considered by it, the City Council does
hereby make a finding and determination of the following facts:
(A) At a regular meeting of the City Council of the City of Fairhope held on the 22"d day of
November, 1999. Improvement Ordinance No. 1074 was adopted and notice of the
adoption of said ordinance in the Fairhope Courier, a newspaper published in and of
general circulation in the City of Fairhope, which said ordinance stated that the City of
Fairhope in the issues of November 271h and December 41h , which said ordinance stated
that the City Council of the City of Fairhope would meet on the 131h day of December,
1999, at 5:30 o'clock p.m., in the City Council Chambers to hear any objections,
remonstrances and protests that might be made against and improvements, the manner
of making the same, or the character of the materials to be used.
(B) A copy of said Improvement Ordinance No. 1074 was sent by registered mail, postage
prepaid, to each of the persons last assessed for City taxation the property proposed to
be assessed for said improvements, at their last known addresses; said notice having
been mailed on the 291h day of November, 1999.
(C) No protest, objections or remonstrance against said improvements, the manner of
making the same, or the character of the materials to be used have been filed in writing
with the City Clerk or in that office or have been made at this meeting.
Section 2. That said Ordinance No. 1074, entitled "AN ORDINANCE TO PROVIDE
FOR CERTAIN IMPROVEMENTS IN COUNTRY WOODS SUBDIVISION IN THE
CITY OF FAIRHOPE" is hereby in all things ratified and confirmed.

RESOLUTION NO. 672-99
A RESOLUTION PROVIDING FOR NOTICE AND ADVERTISEMENT FOR BIDS FOR PUBLIC WORK
WITH REFERENCE TO IMPROVEMENTS DESCRIBED IN IMPROVEMENT ORDINANCE NO. 1074,
ADOPTED 22, DAY OF NOVEMBER, 1999.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA as follows:
Section 1. That notice shall be given, asking for bids for public work in making the improvements described in
Improvement Ordinance No. 1074, adopted on the 22"d day of November, 1999, (as modified, amended and
confirmed by Improvement Ordinance No. 1074, adopted on the 13`h day of December, 1999) as provided in section
11-48-11 of the 1975 Code of Alabama.
Section 2. That the following notice shall be published once a week for two consecutive weeks in the Fairhope
Courier, a newspaper published and of general circulation in the City of Fairhope:
NOTICE TO CONTRACTORS
Sealed proposals will be received by the City of Fairhope, Alabama, at the City Hall, until 2:00 o'clock am, CST, on
the 5`h day of January, 2000, after which time no bids will be received, and then publicly opened and read, for
furnishing all labor, materials, tools, and equipment for the complete construction of certain improvement, including
the construction of a gravity sewer collection system to serve the residence of the Country Woods Subdivision . This
work will include all gravity sewer lines, laterals, pumping station, and force main. Installation will be performed by
open trench and directional bore as shown in the construction plans. Plans, specifications and contract documents
are open to public inspection in the office of Engineering Development Services, LLC, 23210 U.S. Highway Number
98, Suite B-1, Fairhope, Alabama 36532, and may be obtained form the office of said Engineer Finn for a fee of
$50.00 per set. Please make checks payable to Engineering Development Services, LLC. No plans and
specifications will be issued to contractors later then Twenty-four (24) hours prior to the time indicated above for
receiving bids.
The right is reserved to reject any or all bids and to waive informalities and technicalities.
No bid may be withdrawn after the schedules closing time for receipt of bids for at least thirty days. Only proposals
submitted by bidders duly licensed as required by the Alabama Code of 1975, Section 34-8-1 et seq., will be
considered.
A certified check or bid bond in the amount of five percent (5%) of the total bid price must accompany each
proposal, the payee of such check or the obligee of such bond to the City of Fairhope, Alabama.
The successful bidder must furnish a surety bond for the faithful completion of the work in the amount of 100% of
the bid price, executed by a bonding company licensed to do business in the State of Alabama.
Section 3. The City Council will meet on the 10`h day of January, 2000, at 5:30 p.m., CST, for the purpose of
tabulating the bids and awarding the contract.

A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED
ORDINANCE TO AMEND THE ZONING ORDINANCE 557. AN ORDINANCE TO
REZONE CRAIG DYAS' PROPERTY FROM R3-PATIO GARDEN HOMES TO B4-
BUSINESS AND PROFESSIONAL OFFICE, LOCATED JUST NORTH OF ROCK
CREEK ON HIGHWAY 96 AND SOUTH OF MONTROSE WOODS. CHRISTOPHER
BAKER EXPLAINED THAT THIS PROPOSED ORDINANCE COMES TO THE CITY
COUNCIL AFTER RECEIVING A TIE VOTE OF 3 TO 3 DURING THE PLANNING
AND ZONING MEETING, AND NO RECOMMENDATION FROM THE PLANNING AND
ZONING COMMISSION, BUT OFFER A STAFF RECOMMENDATION OF DENIAL;
BECAUSE, IT DOES NOT CONFORM WITH THE COMPREHENSIVE PLAN. CRAIG
RYAS ADDRESSED THE CITY COUNCIL EXPRESSING THAT INITIALLY HE DID NOT
THINK THAT THERE WERE ANY OPPOSITION WITH THE REZONE, BUT
UNDERSTAND THAT THERE ARE SOME OPPOSITION. MR. RYAS ALSO
EXPRESSED THAT HE WOULD AGREE NOT THE PUT IN AN INGRESS\EGRESS AT
THE ENTRANCE OF THIS PROPERTY, IF TRAE CORTE WAS GIVEN AND INGRESS
\EGRESS ON HIS PROPERTY JUST SOUTH OF THIS PARCEL.
MR. FRANK WOODSON, PRESIDENT OF THE MONTROSE WOODS ASSOCIATION
ADDRESSED THE COUNCIL. MR. WOODSON STATED THAT HE OBJECTS TO
THE REZONING OF THIS PROPERTY, BUT DID NOT OBJECT TO THE R-3PGH
ZONING, BUT WERE AFRAID OF WHAT MAY HAPPEN IN THE FUTURE WITH THE
ZONING CHANGES. THIS PROPERTY WAS ZONED R3PGH CONCURRENT WITH
ANNEXATION JANUARY 22, 1 996. MR. WOODSON FURTHER STATED THAT
THE FIRST RESIDENTS ENTERING MONTROSE WOODS WILL HAVE TO CONTEND
WITH LOOKING OUT OF THEIR DOOR ONTO A STRUCTURE. MR. DYAS STATED
THAT THERE WOULD BE APPROXIMATELY 30 FT BUFFER IN PLACE, THE
PARCEL WOULD BE HEAVY LANDSCAPED, AND WOULD BE QUITE NICE. MR.
WOODSON OTHER CONCERNS ARE: (1) MONTROSE WOODS, WOULD LIKE
TO STAY A RESIDENTIAL NEIGHBORHOOD AND NOT SERVICE THE COMMERCIAL
PUD COMING IN AND OUT OF ROCK CREEK. (2) THERE ARE CONCERNS IF
THE PROPERTY IS SOLD, AND (3) THE BIGGEST CONCERN IS THE TRAFFIC,
AND THE KIDS IN THE MONTROSE WOODS NEIGHBORHOOD.
AFTER CONTINUOUS DISCUSSION, COUNCILMEMBER FORD MOVED TO
SEND THIS ITEM BACK TO THE PLANNING AND ZONING FOR FURTHER STUDY
AND A RECOMMENDATION. SECONDED BY COUNCILMEMBER PUCKETT,
MOTION PASSED BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX,
PUCKETT, AND JONES. NAY -NONE.

THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY

Resolution No. 673-99
WHEREAS, the Owners of Rock Creek Phase V desire to have all public streets and rights -of -
way dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama
as Instrument Number 503467 and recorded in Real Book Pages 01909-B, 01910-A, 01910-B,
and 01911-A and all utilities located in easements and in rights -of -ways accepted for
maintenance by the City of Fairhope, Alabama, and;
WHEREAS, the developer has provided a Performance Bond which guarantees that the public
improvements will be constructed to City standards, and;
WHEREAS, the City of Fairhope, Alabama has received notice from the engineers of the
project that the design and capacity of the public improvements have been designed in
conformance with City requirements as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama is not and in no manner will be responsible for the
maintenance of common areas in the subdivision as indicated on the recorded plat, and;
WHEREAS, the City of Fairhope, Alabama has received from the owners of Rock Creek Phase
V a maintenance bond for the public improvements constructed for a period of 2 years from the
date of the approval of this Resolution, and;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA that the public improvements for Rock Creek Phase 5 are hereby
accepted for public maintenance subject to the bond posted.

MR. HARLAN FURTHER STATED THAT WEST VOLANTA STREET IS ONE OF THE

REQUESTING PERMISSION TO HAVE A THREE MILE RUN AND WALK-A-THON
MARCH 25, 2000, AT 9:00 AM. THIS WILL BE ECUMENICAL MINISTRIES
FIRST FUNDRAISER WHICH WILL HELP RAISE MONEY FOR OUR SOCIAL
SERVICE PROGRAMS INVOLVING THE EASTERN SHORE AND SOUTH BALDWIN
SERVICE AREAS. THE RUN AND WALK-A-THON WILL START AT BAYVIEW
STREET AND FAIRHOPE AVENUE, NORTH TO BAYVIEW TO NORTH AVENUE,
SOUTH ON SUMMIT STREET TO ST JAMES, SOUTHWEST ON ST NAMES, WEST
ON WHITE AVENUE, SOUTH ON SOUTH MOBILE STREET TO THE MUNICIPAL
PIER, AND NORTH ON BEACH DRIVE TO THE END. COUNCILMEMBER DUCK
MOVED TO GRANT THE REQUEST. SECONDED BY COUNCILMEMBER PUCKETT,

WANTED TO KNOW WHY RESIDENTS OF SUBDIVISIONS ARE NOT REQUIRED TO
PAY THE SAME ADDITIONAL COST. MAYOR NIX ASSIGNED THIS ISSUE TO THE
GAS, WATER/SEWER DEPARTMENT COMMITTEE. COUNCILMEMBER DUCK IS
THE CHAIR ALONG WITH COUNCILMEMBER QUINN AND JONES. MR
ALEXANDRE HAS A NEW HOME UNDER CONSTRUCTION AT 683 MIDDLE
STREET.
