AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
16 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
MONDAY, 24 MAY 1999.
PRESENT WERE MAYOR PRO TEM BILL JONES; COUNCILMEMBERS
JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN; AND ACTING CITY
CLERK BETTY RIVENBARK. ABSENT WERE: MAYOR JAMES P. NIX,
COUNCILMEMBER JEANETTE PUCKETT, CITY ATTORNEY TUT WYNNE AND
CITY CLERK GENIECE JOHNSON.
THERE BEING A QUORUM PRESENT, THE MAYOR PRO TEM CALLED
THE MEETING TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE
THE MINUTES OF THE 5 MAY 1999, REGULAR MEETING. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED
ORDINANCE TO AMEND THE ZONING ORDINANCE TO ZONE ROCK CREEK
PARTNERS PROPERTY TO ESTABLISH R I RESIDENTIAL PUD ZONING ON
APPROXIMATELY 97.91 ACRES CONCURRENT WITH ANNEXATION
(LOCATED TO THE EAST OF THE EXISTING ROCK CREEK). CHRISTOPHER
BAKER EXPLAINED TO THE COUNCIL THIS INVOLVED PHASES V & VI
CONTAINING 200 LOTS, THAT THIS HAD BEEN RECOMMENDED BY THE
PLANNING COMMISSION WITH A 60 FT RIGHT OF WAY ACCESS TO
CLUBHOUSE DRIVE AND RECOMMENDED OTHER ACCESS ON BEAVER
DAM ROAD THROUGH MONTROSE WOODS. TREY CORTE SPOKE
REITERATING WHAT MR. BAKER SAID AND SAID THEY WOULD NOT BE
AGAINST CLUB HOUSE DRIVE ACCESS TO BERGLIN PROPERTY AND CITY
ALREADY HAS DEEDED ACCESS AT BEAVER DAM ROAD. DISCUSSION
FOLLOWED BETWEEN COUNCIL, MR. CORTE MEMBERS OFTHE AUDIENCE
AND ALLEN CHASON, ATTORNEY REPRESENTING MRS. BERGLIN, WHO
WAS REQUESTING ANOTHER ACCESS ATTHE EAST END OF SOUTH DRIVE.
COUNCIL MEMBERS QUESTIONED WHETHER OR NOT ROCK CREEK
PARTNERS WOULD DEED ANOTHER ACCESS TO SOUTH DRIVE ON THE
EAST END, AS REQUESTED, CONNECTING WITH BERGLIN PROPERTY
STATING CONCERN ABOUT GROWTH AND ABILITY TO SERVE 200 NEW
LOTS AS WELL AS FUTURE GROWTH. MR. CORTE DID NOT AGREE WITH
THIS SUGGESTION

DEVELOPMENTS THAT THEY WOULD NOT HAVE ANY CONTROL OVER.
FURTHER DISCUSSION LED TO COUNCILMEMBER QUINN INTRODUCING IN
WRITING ORDINANCE 1055 WITH STIPULATION BEAVER DAM ROAD
ACCESS BE OPENED BY MR. CORTE IN CONJUNCTION WITH PHASE V AS
IT GOES INTO MONTROSE WOODS, DEEDED RIGHT OF WAY GIVEN TO CITY
AT WEST END OF SOUTH DRIVE RUNNING TO HWY 98 AND PLANNED ROAD
AT CLUB HOUSE DRIVE TO CLUB HOUSE CIRCLE BE INSTALLED WITH
PHASE VI. MR CORTE INDICATED HE HAD NO PROBLEM WITH THIS. IN
ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER DUCK MOVED TO
SUSPEND THE RULES. SECONDED BY COUNCILMEMBER QUINN, MOTION
TO SUSPEND PASSED BY THE FOLLOWING VOTE: AYE -DUCK, QUINN,
JONES NAY- FORD. COUNCILMEMBER DUCK THEN MOVED FOR FINAL
ADOPTION OF ORDINANCE 1055. SECONDED BY COUNCILMEMBER
QUINN, MOTION FOR FINAL ADOPTION PASSED BYTHE FOLLOWING VOTE:
AYE -DUCK, QUINN, JONES NAY -FORD.
A REPORT WAS GIVEN BY CHRISTOPHER BAKER, DIRECTOR OF
PLANNING & BUILDING, REGARDING A DANGEROUS AND UNSAFE
BUILDING LOCATED ON MIDDLE STREET. MR. BAKER SHOWED PICTURES
OF THIS STRUCTURE AND RECOMMENDED REMOVAL OF SAME.
COUNCILMEMBER DUCK MOVED TO ASK THE PROPERTY OWNER, RUBY
DALE, TO APPEAR BEFORE US ATTHE NEXT REGULAR MEETING 1 4 JUNE
1999, COUNCILMEMBER QUINN SECONDED AND MOTION CARRIED
UNANIMOUSLY.
A REQUEST FROM BALDWIN COUNTY HOMEBUILDERS ASSOCIATION
TO PUT UP DIRECTIONAL SIGNS FOR THEIR ANNUAL PARADE OF HOMES
SCHEDULED FOR JUNE 19, 20 & 26, 27, 1 999 WAS CONSIDERED.
COUNCILMAN FORD MOVED TO ALLOW THEM TO PUT THEM UP PROVIDED
THEY REMOVE THEM IMMEDIATELY AFTER THE SHOW IS OVER.
COUNCILMAN DUCK SECONDED MOTION AND IT PASSED UNANIMOUSLY.
MR VINCE VALENTIM ASKED IF THE COUNCIL HAD CONSIDERED HIS
PROPOSAL FROM LAST MEETING REGARDING DONATING CITY SURPLUS TO
THE HEART CLINIC. THE COUNCIL RESPONDED THEY HAD NOT
CONSIDERED IT YET. MR. VALENTTM ALSO ASKED ABOUT THE HUMMING
NOISE COMING FROM THE SEWER PLANTAND DAN McCRORY RESPONDED
HE IS WORKING ON IT. HE WAS ASKED TO REPORT BACK AT NEXT
MEETING ON WHAT HE HAS DONE.

COUNCILMEMBER QUINN SAID SHE WOULD LIKE TO REQUEST
CHRISTOPHER BAKER LOOK AT SETTING UP A COMMITTEE TO STUDY
CITY'S COMPREHENSIVE PLAN AND REPORT BACK AT NEXT MEETING.
THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE
COUNCIL THE MEETING WAS DULY ADJOURNED AT 7: 1 5 P.M.
