AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
1 6 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
WEDNESDAY, 22 MARCH 1 999.
PRESENT WERE MAYOR NAMES P. Nix; COUNCILMEMBER JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM
H. JONES; AND CITY CLERK GENIECE W. JOHNSON. CITY ATTORNEY MARION
E. WYNNE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE
O MARCH 1 999, REGULAR MEETING. SECONDED BY COUNCILMEMBER
JONES, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD INTRODUCED IN WRITING ORDINANCE NO.
047. AN ORDINANCE TO LICENSEE AND REGULATE VEHICLE WRECKER OR
TOWING SERVICES. IN ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER
DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER
QUINN, MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE
FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES.
NAY -NONE. COUNCILMEMBER PUCKETT THEN MOVED FOR FINAL ADOPTION
OF ORDINANCE NO. 1 047. SECONDED BY COUNCILMEMBER JONES,
MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING
VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE.
COUNCIL REVIEWED AN APPLICATION FOR A BEER/WINE OFF PREMISES
LICENSE BY DARRYLYNE BRACY, DBA S & D STORE, LOCATED AT THE
CORNER OF SECTION STREET AND TWIN BEECH ROAD. COUNCILMEMBER
DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY
COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY.

THE COUNCIL REVIEWED TWO PROPOSALS ON THE OLD ADULT
RECREATION CENTER (352 MORPHY AVENUE). THE CHILDREN OF THE
WORLD PROPOSE TO USE THE BUILDING AS THEIR NEW LOCATION. THIS IS
AN ORGANIZATION THAT TAKES IN ORPHANS. THE BUILDING WOULD BE
LEASED FOR 20 YEARS AT ONE DOLLAR ($ 1 .00) PER YEAR. THE SECOND
PROPOSED IS BY THEATER 98. THEATER 98 PROPOSES TO USE THIS
LOCATION FOR STORAGE AND TO TURN THE SITE INTO A 250 SEAT THEATER
IN THE FUTURE. COUNCILMEMBER FORD MOVED TO DENY THE TWO
PROPOSALS AT THIS TIME, UNTIL IT CAN BE DETERMINED IF THE CITY NEEDS
THIS BUILDING FOR STORAGE. SECONDED BY COUNCILMEMBER JONES,
MOTION PASSED UNANIMOUSLY.
MR. RODNEY MCDONALD, PRESIDENT OF SOUTH ALABAMA BRITISH
CAR CLUB ADDRESSED THE COUNCIL REQUESTING PERMISSION TO HAVE
THEIR 9TH ANNUAL BRITISH CAR FESTIVAL ON THE NORTH END OF
FAIRHOPE BEACH, ON SATURDAY, OCTOBER 2, 1 999, FROM 7:00 A.M.
UNTIL 4:00 P.M. COUNCILMEMBER DUCK MOVED TO GRANT THE REQUEST.
SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.
MAYOR NIX REQUEST SETTING UP A COMMITTEE TO INVETERATE EACH
REQUEST FOR RIGHT-OF-WAY PARKING VARIANCES. (ORD. 1046). ALL
REQUESTS WILL BE REFERRED TO THE COMMITTEE PRIOR TO GOING BEFORE
THE COUNCIL, INCLUDING THE FIVE REQUESTS LISTED ON THE AGENDA. THE
FOLLOWING WILL SERVE ON THIS COMMITTEE: BUILDING OFFICIAL,
CHRISTOPHER BAKER, CHIEF OF POLICE, JERRY ANDERSON, PUBLIC
WORKS DIRECTOR, Tim KANT, AND STREET COMMITTEE CHAIR,
COUNCILMEMBER WILLIAM (BILL) JONES. COUNCILMEMBER QUINN MOVED TO
ESTABLISH THE PARKING VARIANCE REQUEST COMMITTEE. SECONDED BY
COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER JONES MOVED UP -DATE THE RESERVE OFFICER
ROSTER BY ADDING JONATHAN FORSMAN AND DELETING FRED W. KING.
SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.
MAYOR NIX OPENED THE FLOOR FOR NOMINATIONS TO THE LIBRARY
BOARD TO REPLACING BUBBA SPELL (RESIGNED). THIS TERM WILL END
APRIL 2000. COUNCILMEMBER JONES NOMINATED SUZANNE BARNHILL.
COUNCILMEMBER QUINN MOVED TO CLOSE THE NOMINATION AND APPOINT MS.
BARNHILL. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED
UNANIMOUSLY.

COUNCILMEMBER PUCKETT MOVED TO RESCHEDULE THE NEXT
REGULAR COUNCIL MEETING TO THURSDAY, APRIL 1 5, 1 999. SEVERAL
COUNCILMEMBER WILL BE ATTENDING THE ALABAMA LEAGUE CONVENTION IN
HUNTSVILLE, ALABAMA. SECONDED BY COUNCILMEMBER DUCK, MOTION
PASSED UNANIMOUSLY.
COUNCILMEMBER JONES ADDRESSED THE COUNCIL INQUIRING ABOUT
THE REBUILDING OF PIERS ALONG MOBILE BAY ON PUBLIC PROPERTY FOR
PRIVATE PURPOSES. AFTER DISCUSSION, COUNCILMEMBER JONES REQUEST
THAT THE CITY ATTORNEY, MARION (TUT) WYNNE RESEARCH THIS ISSUE AND
REPORT BACK AT THE NEXT REGULAR COUNCIL MEETING.
THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED
