THE CITY COUNCIL, CITY OF FAIRHOPE, MET IN REGULAR SESSION
AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
1 6 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
WEDNESDAY. 1 O MARCH 1 999.
PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBER JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM
H. JONES; AND CITY CLERK GENIECE W. JOHNSON. CITY ATTORNEY MARION
E. WYNNE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER JONES SO MOVED TO APPROVE MINUTES OF
THE 22 FEBRUARY 1 999, REGULAR MEETING. SECONDED BY
COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.
MS. CLAUDIA MULLINS, ASSISTANT SOFTBALL COACH ADDRESSED THE
CITY COUNCIL THANKING THE MAYOR, COUNCIL, AND FAIRHOPE SINGLE TAX
CORPORATION FOR THEIR SUPPORT OF THE LADY PIRATES SOFTBALL
PROGRAM.
COUNCILMEMBER DUCK MOVED FOR FINAL ADOPTION OF ORDINANCE
No. 1 046. THIS ORDINANCE WILL RESTRICT PARKING OF VEHICLES UPON
THE PUBLIC STREET RIGHT -OF -WAY OF THE CITY. AFTER DISCUSSION,
SECONDED BY COUNCILMEMBER JONES, MOTION FOR FINAL ADOPTION
PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN,
NIX, PUCKETT, AND JONES. NAY -NONE.
COUNCILMEMBER FORD INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
PUCKETT, MOTION PASSED UNANIMOUSLY.

"Bay Area Earth Day"

WHEREAS, the City of Fairhope realizes that the land surrounding our bay is a precious natural
resource which supports the economy, society, and daily lies of our citizens; and,
WHEREAS, we want to support the efforts of citizens, businesses, and organizations to celebrate the
beauty and wonder of the land, skies, and water in the bay area; and,
WHEREAS, we recognize our dependence upon the Earth and upon one another for our common
existence, well-being, and development; and,
WHEREAS, we further recognize our interdependence with other local governments for the protection
of the bay area; and,
WHEREAS, we are committed to work for the preservation and protection of our natural resources in
the Mobile bay area; and,
WHEREAS, we encourage all citizens to attend the Bay Area Earth Bay Celebration to be held Sunday,
April 18' at the Fairhope Municipal Pier from 12:00 to 5:00 p.m.
NOW THEREFORE, the Mayor the City Council of the City of Fairhope do hereby proclaim April 18,
1999, as BAY AREA EARTH DAY in the City of Fairhope and in the spirit of commitment encourage
our citizens, businesses, and organizations to participate in this celebration and accept responsibility to
protect the integrity of the Earth, our home.

COUNCIL REVIEWED AN APPLICATION FOR A ON/OFF PREMISES LICENSE
BY PATRICK J. BAILEY, DBA PIZZA HUT, LOCATED AT 24 1 SOUTH GREENO
ROAD. COUNCILMEMBER PUCKETT MOVED TO APPROVE THE ISSUANCE OF
THE LICENSE. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED
UNANIMOUSLY.

COUNCIL REVIEWED AN APPLICATION OF A BEER/WINE OFF PREMISES
LICENSE BY GARY C. COX, DBA GAS-N-GO # 1 03, LOCATED AT 22772
Hwy 98. COUNCILMEMBER DUCK MOVED TO APPROVE THE ISSUANCE OF
THE LICENSE. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER QUINN MOVED TO UPDATE THE VOLUNTEER FIRE
DEPARTMENT ROSTER BY APPROVING INSURANCE COVERAGE ON ED HALL,
BOBBY ERWIN, AND GUY BAUER. SECONDED BY COUNCILMEMBER JONES,
MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER QUINN MOVED TO ADD THE FOLLOWING ITEMS TO THE
AGENDA. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED
UNANIMOUSLY.
MS. Joy HILLEY, EXECUTIVE DIRECTOR OF THE CHILDREN OF THE
WORLD, INC., LOCATED IN FAIRHOPE, ADDRESSED THE COUNCIL OFFERING A
PROPOSAL ON THE OLD ADULT RECREATION CENTER (352 MORPHY
AVENUE) AS THEIR NEW LOCATION. MAYOR STATED THAT HE HAD ALSO
RECEIVED A SECOND PROPOSAL FROM JODI CLARK WITH THEATER 98 TO
USE TO BUILDING AS STORAGE. AFTER DISCUSSION COUNCILMEMBER
PUCKETT MOVED TO TABLE THESE ITEMS UNTIL THE COUNCIL IS ABLE TO
REVIEW THE PROPOSALS. SECONDED BY COUNCILMEMBER QUINN, MOTION
PASSED UNANIMOUSLY.
MAYOR NIX STATED THAT THE ALABAMA DEPARTMENT OF
TRANSPORTATION RECEIVED A REQUEST FROM A CITIZEN, REQUESTING A
TRAFFIC SIGNAL AT THE INTERSECTION OF U.S. 98 AND SPRING RUN
DRIVE/MIDDLE STREET, FAIRHOPE, ALABAMA. IN ORDER TO DETERMINE IF
THIS INSTALLATION IS JUSTIFIED, A TRAFFIC ENGINEERING STUDY MUST BE
CONDUCTED, AND A MUNICIPALITY MUST COMMIT TO FUND HALF OF THE
INSTALLATION COST AND ALL OF THE MAINTENANCE AND OPERATIONAL COST.
THE COST TO INSTALL A TRAFFIC SIGNAL AT THE ABOVE REFERENCED
INTERSECTION IS $40,000.00 WITH THE CITY'S SHARE BEING
20,000.00. NO ACTION WAS TAKEN BY THE COUNCIL.
