PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBER JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W. JOHNSON. NO ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE 8 FEBRUARY 1 999, REGULAR MEETING. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER JONES INTRODUCED IN WRITING AN ORDINANCE RESTRICTING PARKING OF VEHICLES UPON THE PUBLIC STREET RIGHT-OF-WAY OF THE CITY. COUNCILMEMBER FORD MOVED TO AMEND THE ORDINANCE. SECONDED BY COUNCILMEMBER JONES, MOTION TO AMEND PASSED BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. THE ORDINANCE WILL BE GIVEN FINAL CONSIDERATION AT THE NEXT REGULAR MEETING. COUNCILMEMBER DUCK INTRODUCED IN WRITING ORDINANCE NO. 1045. AN ORDINANCE DECLARING APPROXIMATELY 2.066 ACRES OF FOUNDERS PARK NO LONGER NEEDED FOR MUNICIPAL PURPOSES. IN ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER FORD MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1045. SECONDED BY COUNCILMEMBER JONES, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER PUCKETT MOVED TO ACCEPT APPROXIMATELY 2. 1 78 ACRES FROM FAIRHOPE SINGLE TAX CORPORATION AT THE FOUNDERS PARK. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. 2267 22 FEBRUARY 1 999 COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. RESOLUTION NO. 626-99 WHEREAS, THE OWNERS OF SPRING LAKE DESIRE TO HAVE THE 50 FOOT RIGHT-OF-WAY DEDICATED TO THE CITY OF FAIRHOPE, ALABAMA AS INDICATED ON THE PLAT FILED FOR RECORD IN THE PROBATE RECORDS OF BALDWIN COUNTY, ALABAMA AS SLIDE NUMBER 187 1 -A AND ALL UTILITIES LOCATED IN THE 1 5 FOOT EASEMENT AT THE PRIVATE STREET FRONTAGE OF EACH LOT FOR ACCEPTANCE FOR MAINTENANCE BY THE CITY OF FAIRHOPE, ALABAMA, AND; WHEREAS, THE GENERAL SUPERINTENDENT OF THE CITY OF FAIRHOPE, ALABAMA REPRESENTS THAT THE PORTION DEDICATED TO THE CITY OF FAIRHOPE, ALABAMA (SAID 50 FOOT RIGHT-OF-WAY) AND SAID UTILITIES LOCATED IN SAID UTILITY EASEMENTS HAVE BEEN INSTALLED IN SUBSTANTIAL CONFORMITY WITH THE CITY OF FAIRHOPE, ALABAMA REQUIREMENTS, AND; WHEREAS, THE CITY OF FAIRHOPE, ALABAMA IS NOT AND WILL IN NO MANNER BE RESPONSIBLE FOR THE MAINTENANCE OF COMMON AREAS OR STREETS IN SAID SPRING LAKE, AND; WHEREAS, ALL STREETS ARE PRIVATE AND OTHER COMMON AREAS ARE NOT DEDICATED TO THE CITY OF FAIRHOPE, ALABAMA AS PER THE RECORDED PLAT, AND; WHEREAS, THE CITY OF FAIRHOPE, ALABAMA CITY CLERK HAS RECEIVED FROM THE OWNERS OF SPRING LAKE A MAINTENANCE BOND FOR THE AFOREMENTIONED 50 FOOT RIGHT-OF-WAY AND UTILITIES IN EASEMENTS PROVIDED ALONG THE PRIVATE STREET FRONTAGE OF EACH LOT AS INDICATED ON THE PLAT, AND; NOW, THEREFORE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA THAT THE AFOREMENTIONED 50 FOOT RIGHT-OF-WAY AND UTILITIES IN EASEMENTS DESCRIBED ABOVE HEREBY ARE ACCEPTED FOR PUBLIC MAINTENANCE SUBJECT TO THE BOND POSTED. THIS RESOLUTION ACCEPTANCE SHALL NOT OBLIGATE THE CITY OF FAIRHOPE, ALABAMA TO MAINTAIN ANY UTILITY OR DRAINAGE FACILITIES NOT EXPRESSLY STATED IN THIS RESOLUTION. ADOPTED, OF FEBRUARY 1999. COUNCILMEMBER FORD MOVED TO GRANT THE REQUEST OF THE MAKE - A -WISH FOUNDATION TO HOLD THEIR ANNUAL PETTING ZOO AT 1 03 NORTH SECTION STREET (LOT NEXT TO REGIONS BANK), DURING ARTS & CRAFTS FESTIVAL. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. 2268 22 FEBRUARY 1 999 COUNCILMEMBER DUCK MOVED TO GRANT THE REQUEST OF ALABAMA ENVIRONMENTAL COUNCIL JUBILEE CHAPTER TO USE THE SOUTH PARK AT THE PIER FOR THEIR ANNUAL EARTH DAY CELEBRATION ON APRIL 1 8, 1999. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER PUCKETT MOVED TO RESCHEDULE THE NEXT REGULAR COUNCIL MEETING TO 10 MARCH 1 999. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. Identification: Truck - Electric Dept. COUNCILMEMBER JONES, CHAIR PERSON AND HIS COMMITTEE RECOMMENDS THE FOLLOWING WITH REGARDS TO THE SPEEDING ALONG SOUTH MOBILE STREET: • INCREASE POLICE PRESENT ALONG THIS AREA • POST ADDITIONAL SPEED LIMIT SIGNS. • REVIEW THIS AREA AGAIN DURING THE SUMMER THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 6:0 1 P.M.
