AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
16 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
MONDAY, 25 JANUARY 1 999.
PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBER JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM
H. JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W.
JOHNSON. NO ONE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE
I I JANUARY 1 999, REGULAR MEETING. SECONDED BY COUNCILMEMBER
PUCKETT, MOTION PASSED UNANIMOUSLY.
MAYOR NIX ANNOUNCED THAT SHEP SHEPARD PASSED 25 JANUARY
1 999. MAYOR NIX ALSO EXPRESSED THAT SHEP AND ERMA SHEPHARD
ATTENDED CITY COUNCIL MEETINGS REGULARLY.
MAYOR NIX PRESENTED EMPLOYEE BOB LUNSFORD WITH A PLAQUE
FOR HIS LOYALTY AS AN EMPLOYEE. MR. LUNSFORD WILL RETIRE JANUARY
29, 1999.
THE BALDWIN COUNTY ELECTRIC MEMBERSHIP CORPORATION ANNUAL
BUSINESS LICENSE CHECK WAS DELIVERED TO MAYOR NIX PRIOR TO THE
COUNCIL MEETING. THE CHECK IN THE AMOUNT OF $ 1 0,448.59,
REPRESENTS A PERCENTAGE OF BCEMC'S BUSINESS REVENUES IN THE
POLICE JURISDICTION.
TWO 3-YEAR TERM ON THE PARKING AUTHORITY BOARD.
COUNCILMEMBER DUCK MOVED TO REAPPOINT MR. BEN BARNHILL .
SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO Fitt DR. SHEROLD POPE (DECEASED)
SEAT AT THE NEXT REGULAR MEETING. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.
MAYOR NIX APPOINTED THE STREET COMMITTEE TO RESEARCH THE
SPEEDING ON SOUTH MOBILE AVENUE AND REPORT BACK TO THE COUNCIL
AT THE NEXT REGULAR MEETING.

COUNCILMEMBER FORD INTRODUCED IN WRITING, AND MOVED FOR
THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY
COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
RESOLUTION NO: 621B-99
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor James P. Nix is hereby authorized to provide funding for the
installation of sewer lines along Scenic Highway 98 and County Road One. It is
recommended by the Engineer, Volkert & Associates to accept the low bid of James
Brothers Excavating, Daphne, Alabama, for the construction of the low pressure
system. The bid amount is $567,466.50. The City Operating Funds will be reimbursed
of all cost occured on the installation of the sewer lines, after receiving a bond issue to
finance this project.
Duly Approved and Adopted this 25`h Day of January 1999.

MR. RICHARD PRUITT (OWNER/OPERATOR OF POOR RICHARD'S RIDE)
ADDRESSED THE COUNCIL REQUESTING PERMISSION TO OPERATE HIS TRAIN
RIDE DURING THE 1 999 ARTS AND CRAFTS SHOW MR. PRUITT IS ALSO
REQUESTING PERMISSION TO OPERATE A FARRIS WHEEL. MR. PRUITT WOULD
SET UP BOTH RIDES NEXT THE FAIRHOPE'S COMMUNITY PARK. MAYOR NIX
COMMITTED THAT THE CHAMBER OF COMMERCE IS RESPONSIBLE FOR
SELECTING THE DIFFERENT VENDORS TO TAKE PART IN THE ANNUAL SHOW,
AND THAT THE CITY WOULD BE SETTING A PRECEDENCE IF MR. PRUITT WAS
GIVEN PERMISSION BY THE COUNCIL TO OPERATE DURING THE ANNUAL
SHOW. MAYOR NIX ALSO REINTEGRATED THAT PREVIOUSLY THE CITY WAS
ADVISED, IN AN ATTORNEY GENERAL OPINION, NOT TO TAKE PART IN
SELECTING OR ALLOWING VENDORS TO TAKE PART IN THE ANNUAL ARTS AND
CRAFTS SHOW. COUNCILMEMBER JONES MOVED TO REFER MR. PRUITT
BACK TO THE CHAMBER OF COMMERCE FOR FURTHER NEGOTIATION.
SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO GRANT THE UNITED CEREBRAL
PALSY REQUEST TO HOLD A CENTURY RIDE AND USE THE FAIRHOPE PIER
AREA FOR REGISTRATION. THE EVENT WILL TAKE PLACE SATURDAY,
1 7 APRIL 1 999, FROM 6:30 AM TO 5:00 PM. SECONDED BY
COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
MAYOR NIX ANNOUNCED THAT EMPLOYEE ED NOLTE WAS UNABLE TO
BE PRESENT TONIGHT; THEREFORE, MR. NOLTE WILL BE RECOGNIZED AT
THE NEXT REGULAR MEETING.
STREET SUPERINTENDENT, Tim KANT REPORTED THAT ONE OF THE
GIRLS SOFTBALL FIELDS AT THE FOUNDERS PARK SHOULD BE COMPLETED
SOON, AND THAT ALL THE FIELDS SHOULD BE COMPLETE BY THE
END OF FEBRUARY.
THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED
AT 6:50 P.M.
