MONDAY, 9 NOVEMBER 1 998.
PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM H.
JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W.
JOHNSON. NO ONE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO
ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE
26 OCTOBER 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER JONES MOVED TO APPROVE THE REQUEST FROM
MOBILE BAY NATIONAL ESTUARY PROGRAM TO SUPPORT THE IMPROVEMENT
AND PROTECTION OF WATER QUALITY AND ENHANCE LIVING RESOURCES. ALL
THE CITIES BORDERING THE BAY ARE BEING ASKED TO SUPPORT THIS
PROJECT. THE CITY OF FAIRHOPE IS ASKED TO PAY $ 2, 750.00.
SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
MR. JAMES D. BOOTHE, JR., PRESIDENT OF BAY QUEEN
ENTERPRISES, INC. ADDRESSED THE COUNCIL. MR. BOOTHE ASKED IF HE
COULD DISCUSS HIS LAWSUIT AGAINST THE CITY. MR. MARION E. WYNNE, CITY
ATTORNEY ADVISED MR. BOOTHE THAT THE COUNCIL WOULD NOT BE ABLE TO
DISCUSS A CASE THAT IS IN LITIGATION. SEVERAL TIMES MR. BOOTHE
CONTINUED TO DISCUSS THE CASE, ON EACH OCCASION MR. BOOTHE WAS
MADE AWARE THAT THE CITY COUNCIL MEETING WAS NOT THE PLACE TO
DISCUSS THIS, AND THAT ALL POINTS SHOULD BE MADE THROUGH HIS
ATTORNEY.
COUNCILMEMBER FORD MOVED TO UPDATE THE VOLUNTEER FIRE
ROSTER BY DELETING JOHN WADE. SECONDED BY COUNCILMEMBER JONES,
MOTION PASSED UNANIMOUSLY.

ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
FORD, MOTION PASSED UNANIMOUSLY.

WHEREAS, THE FOLLOWING BIDS HAS BEEN AWARDED FOR TWO FIRE TRUCKS
AS SPECIFIED IN BID REQUEST DATED FOR AND OPENED ON 23 OCTOBER
1 998 GO TO THE LOWEST BIDDER MEETING SAID SPECIFICATIONS, NAMELY
SUNBELT FIRE APPARATUS, FAIRHOPE, ALABAMA, AND
WHEREAS, MAYOR JAMES P. NIX IS HEREBY BE AUTHORIZED TO EXECUTE A
LEASE PURCHASE AGREEMENT BETWEEN THE CITY AND SUNBELT FIRE
APPARATUS, FAIRHOPE, ALABAMA, IN THE AMOUNT OF $ 1 86,96 1 .00 FOR A
1 250 CLASS "An PUMPER COMBINATION FIRE APPARATUS , AND IN THE
AMOUNT OF $499,983.00 FOR 100' AERIAL APPARATUS. THE TERM OF
THESE LEASE PURCHASE AGREEMENTS SHALL BE FOR TEN (1 0) YEARS, AND
BE ff FURTHER RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, THAT MAYOR JAMES P. NIX IS HEREBY AUTHORIZED TO PURCHASE
EQUIPMENT NEEDED FOR THE 1 2250 PUMPER AT $ 19,37 1 .00 AND
EQUIPMENT NEEDED FOR THE 100' AERIAL APPARATUS TRUCK AT
$ 1 8,307.50.

In summarizing this evaluation, we the Fairhope Volunteer Fire Department Truck Committee find that the specifications on the
chassis and aerial device particularly have been virtually ignored. The products proposed in response to the specifications do
not meet the requirements of the specifications and contain no certifications of capability either as proposed or as specified.
No exceptions or description of deviations is included in the bid as required. This bid should be non -compliant with the
specifications and non -responsive to the terms and conditions of these specifications and to recommend Emergency One as
they met or exceeded the specifications as defined.

An ALTERNATE PROPOSAL was submitted by NAFECO and many of the specifications stated within the bid were not met
by the vendor. It was clearly stated within the bid package that Alternate Bids would not be considered.

MRS. SUE MASON ADDRESSED THE COUNCIL ASKING IF THE COUNCIL
WOULD AUTHORIZE THE AIRPORT BOARD TO LOOK INTO THE CONCEPT OF
PLACING A CORPORATE HANGER AT THE FAIRHOPE MUNICIPAL AIRPORT. MRS.
MASON ALSO AS IF THE COUNCIL WOULD AUTHORIZE THE MAYOR TO HIRE AN
APPRAISAL TO ESTABLISH A RENT AMOUNT FOR THE GROUNDS OF THE
AIRPORT. COUNCILMEMBER PUCKETT MOVED TO GRANT THE REQUEST.
SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER JONES SO MOVED TO APPROVE THE REQUEST OF THE
EASTERN SHORE OPTIMIST CLUB TO USE THE LOT ON SECTION STREET, NEXT
TO REGIONS BANK FOR THEIR ANNUAL CHRISTMAS TREE SALE. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
