PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, WILLIAM H.
JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W.
JOHNSON. NO ONE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO
ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE
28 SEPTEMBER 1 998, REGULAR MEETING AND 6 OCTOBER 1 998, SPECIAL
MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED
UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED
ORDINANCE TO AMEND THE ZONING ORDINANCE. COUNCILMEMBER DUCK
INTRODUCED IN WRITING ORDINANCE NO. 1038. THE PLANNING & ZONING
COMMISSION RECOMMENDS APPROVAL OF THIS ORDINANCE. THE ORDINANCE
WILL RE -ZONE TRISHA LOPORTO PROPERTY LOCATED AT 720 MIDDLE STREET
FROM M- I BUSINESS AND PROFESSIONAL OFFICE TO B-2 GENERAL BUSINESS.
NO ONE PRESENT WAS OPPOSED TO THE AMENDMENT. IN ORDER TO TAKE
IMMEDIATE ACTION COUNCILMEMBER JONES MOVED TO SUSPEND THE RULES.
SECONDED BY COUNCILMEMBER QUINN MOTION TO SUSPEND THE RULES
PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN,
NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK THEN
MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1038. SECONDED BY
COUNCILMEMBER FORD, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY
BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND
JONES. NAY -NONE.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED
ORDINANCE TO AMEND THE ZONING ORDINANCE. THE PLANNING & ZONING
COMMISSION RECOMMENDS APPROVAL OF THIS ORDINANCE. THIS ORDINANCE
WOULD SET OUT SPECIFICS ON THE SPECIAL GREENSPACE RESERVATION AND
TREE PROTECTION ZONES. COUNCILMEMBER QUINN EXPRESSED THAT FIFTY
(50) FEET BOUNDARIES WERE NEEDED FOR RESIDENTIAL PROPERTY, BUT
TWENTY (20) FEET BOUNDARIES WOULD BE SUFFICIENT FOR COMMERCIAL

PROPERTY. COUNCILMEMBER FORD EXPRESSED THAT FIFTY (50) FEET
BOUNDARIES ARE TOO MUCH AND WOULD LIKE TO SEE THE BOUNDARIES SET
AT TWENTY (20) FEET. COUNCILMEMBER FORD ALSO EXPRESSED THAT THE
FOLLOWING STATEMENT IS TOO VAGUE. NO VEGETATION WITHIN SUCH ZONES
SHALL BE REMOVED EXCEPT UPON A SUBMISSION TO A ACCEPTANCE BY THE
CITY OF A CLEAR AND CONCISE PLAN DEMONSTRATING FULL COMPLIANCE WITH
OTHER LANDSCAPING REQUIREMENT OF ORDINANCE 557. AFTER A LENGTHY
DISCUSSION COUNCILMEMBER FORD MOVED TO AMEND THE PROPOSED
ORDINANCE, AND TO CONTINUE THE PUBLIC HEARING AT THE NEXT REGULAR
MEETING. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER JONES INTRODUCED IN WRITING ORDINANCE NO
1039. AN ORDINANCE TO AMEND ORDINANCE NO. 955, THE PERSONNEL
RULES, POLICIES AND PROCEDURES ORDINANCE. THE ORDINANCE WOULD
CHANGE THE PRESENT BLUE CROSS & BLUE SHIELD GROUP HEALTH
COVERAGE TO A PMD PLAN AND ADD GROUP DENTAL INSURANCE. IN ORDER
TO TAKE IMMEDIATE ACTION COUNCILMEMBER PUCKETT MOVED TO SUSPEND
THE RULES. SECONDED BY COUNCILMEMBER QUINN, MOTION TO SUSPEND
THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK,
FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER
JONES THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1039.
SECONDED BY COUNCILMEMBER PUCKETT, MOTION FOR FINAL ADOPTION
PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN,

DESIGNATION OF APPLICANT'S LOCAL AGENT
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE ,
ALABAMA, that PHILLIP RUTHERFORD, General Superintendent, 334/928-2136,
Post Office Drawer 429, Fairhope, Alabama 36533, is hereby authorized to execute for
and in behalf of the City of Fairhope, a public entity established under the laws of the State
of Alabama, this application and to file it in the appropriate State office for the purpose of
obtaining certain Federal financial assistance under the Disaster Relief Act (Public Law
100-707) or otherwise available from the President's Disaster Relief Fund. That the City
of Fairhope, a public entity established under the laws of the State of Alabama, hereby
authorized its agent to provide to the State and to the Federal Emergency Management
Agency (FEMA) for all matters pertaining to such Federal disaster assistance the
assurances and agreements as required.

AT 805 SOUTH MOBILE STREET. COUNCILMEMBER PUCKETT MOVED TO
APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER
JONES, MOTION PASSED UNANIMOUSLY.
COUNCIL REVIEWED AN APPLICATION FOR A RESTAURANT LIQUOR

HABITAT FOR HUMANITY OF BALDWIN COUNTY REQUEST THAT THE
COUNCIL WAIVE THE CITYS PERMITTING FEES ON A HABITAT HOME THAT IS
BEING BUILT WITHIN THE CORPORATE LIMITS. COUNCILMEMBER FORD MOVED
TO GRANT THE REQUEST. SECONDED BY COUNCILMEMBER DUCK, MOTION
PASSED UNANIMOUSLY.

A CONCERN RESIDENT ASKED IF A TRAFFIC LIGHT COULD BE INSTALLED
AT U.S. HIGHWAY 98 AND SECTION STREET. THE MAYOR INFORMED THE
INDIVIDUAL THAT U.S. HIGHWAY 98 WAS A STATE HIGHWAY, AND THAT SEVERAL
REQUEST HAS BEEN MADE REGARDING THIS MATTER, BUT HE WOULD MAKE THE
REQUEST AGAIN.
