PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND CITY CLERK GENIECE W. JOHNSON. COUNCILMEMBER WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE WERE ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE 1 4 SEPTEMBER 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. RESOLUTION NO. 607-98 BE IT RESOLVED by the Mayor and Council of the City of Fairhope, Alabama that the proposed Budget presented and reviewed this 28`s Day of September, 1998, be hereby approved and adopted for FY 1998- 1999; And BE IT FURTHER RESOLVED that the Annual Salaries of City Personal shall be as shown on a list entitled "Annual Salaries of ALL CITY Personnel - Resolution No. 607-98 "; said list filed in the Office of the Mayor, of the City Clerk, and of the Personnel Director; And BE IT FURTHER RESOLVED that the Mayor be authorized to enter into a contract with the Eastern Shore Chamber of Commerce to promote the City of Fairhope. The contract shall be for one year, 1 October 1998 - 30 September 1999, but may be canceled at any time. Contract shall call for a payment to the Eastern Shore Chamber of Commerce of $125.00 per month from the General Fund and $125.00 per month from each of the Utility Funds; or $6,000.00 for the one year term. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. 2210 28 SEPTEMBER 1 998 RESOLUTION VACATING A PUBLIC RIGHT-OF-WAY BETWEEN SATSUMA AND KUMQUAT STREETS RESOLUTION NO. 608-98 WHEREAS we the undersigned; Charles D. Carpenter, a single man, R.J. Gregroius and Eva Gregorius, husband and wife, Sydney Olander and Lee Olander, husband and wife, Lucille C. Griffith, widower, Jennie Lee, widower, Jack H. Logsdon and Lucille Logsdon, husband and wife, Mary Jane Fisher, trustee, being all of the abutting property owners of a 20-feet Right -of Way known as Pinecrest Lane, located in Fairhope, Alabama as hereinafter described, which said Right - of -Way is not now in use nor will it ever be used as such, being located and described, as follows: All of that portion of a 20-foot Public Right -of -Way known as Pinecrest Lane running East and West between Satsuma and Kumquat Streets, through Block 11 of Magnolia Beach additional to the Town of Fairhope as per Plat of Records filed in miscellaneous Book 1 at Page 331, Probate Records of Baldwin County, Alabama. WHEREAS, the said owners desire that the same be vacated and have by these presents filed said Declaration of Vacation with the Mayor and City Council of the City of Fairhope, Alabama, and, WHEREAS, the City of Fairhope, has accepted and said Declaration of Vacation and have determined that the said Right -of -Way is not now in use nor will it ever be in use as a Right -of - Way. NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of Fairhope, do by these presents assent to such Declaration of Vacation, and it be, and the same is hereby vacated in accordance with Title 23-4-20 of the 1975 Code of Alabama as amended. MAYOR NIX EXPRESSED THAT HE WAS PROUD OF THE CITY EMPLOYEES FOR THEIR HARD WORK DURING HURRICANE GEORGES. ALL STREETS ARE OPEN AND ALL POWER WITHIN THE CITY HAS BEEN RESTORED.
