AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;

MONDAY, 1 4 SEPTEMBER 1 998.
PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, AND WILLIAM H. JONES; CITY
ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W. JOHNSON.
COUNCILMEMBER JEANETTE PUCKETT WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO
ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE 24
AUGUST 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER QUINN,
MOTION PASSED UNANIMOUSLY.
A LETTER OF APPRECIATION WAS PRESENT TO MAYOR NIX AND THE
COUNCIL, FROM THE ADMINISTRATION, ATHLETIC DEPARTMENT AND STUDENT
OF THE FAIRHOPE HIGH SCHOOL. THE LETTER EXPRESSED APPRECIATION
FOR THE NEWLY INSTALLED LIGHTS ON THE PRACTICE FIELDS.
COUNCILMEMBER FORD INTRODUCED IN WRITING ORDINANCE NO. 1037.
AN ORDINANCE TO PROVIDE PROTECTION FOR TREES AND TO SET OUT
LANDSCAPE REQUIREMENTS. IN ORDER TO TAKE IMMEDIATE ACTION
COUNCILMEMBER DUCK MOVED TO SUSPEND THE RULES. SECONDED BY
COUNCILMEMBER JONES, MOTION TO SUSPEND THE RULES PASSED
UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, AND
JONES. NAY -NONE. COUNCILMEMBER FORD THEN MOVED FOR FINAL
ADOPTION OF ORDINANCE NO. 1037. SECONDED BY COUNCILMEMBER
DUCK, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING
VOTE: AYE -DUCK, FORD, QUINN, NIX, AND JONES. NAY -NONE.

COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
JONES, MOTION PASSED UNANIMOUSLY.
RESOLUTION NO. 605-98
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that the City of Fairhope elects to come under the provisions of
Section 6 and Section 7 of Act 272 of the regular session of the 1998 Legislature.
The City of Fairhope agrees to provide all funds necessary to the Employee's Retirement
System to cover the cost of the increase as provided for by said Act for those eligible
pensioners and beneficiaries of pensioners who retired from the City of Fairhope with the
aforementioned increase being effective with the October 1998 benefit payments.
ADOPTED THIS 14TH DAY OF SEPTEMBER, 1998.

ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.
RESOLUTION NO. 606-98
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
FAIRHOPE, ALABAMA, that the City of Fairhope elects to come under the provisions of
Section 2 of Act 272 of the regular session of the 1998 Legislature.
The City of Fairhope agrees to provide all funds necessary to the Employee's Retirement
System to cover the cost of the increase as provided for by said Act for those eligible
employees who participated in the Employees' Retirement System of Alabama and retired
from the City of Fairhope or their eligible beneficiaries with the aforementioned increase
being effective with the October 1998 benefit payments.

LICENSE BY RICHARD T. BENNETT, DBA MEAN PIERRE CAFE, LOCATED AT 302
DE LA MARE AVENUE. COUNCILMEMBER JONES MOVED TO APPROVE THE
ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER QUINN, MOTION
PASSED UNANIMOUSLY.
COUNCIL REVIEWED AN APPLICATION FOR A RESTAURANT LIQUOR
LICENSE BY BOB W. POPE, DBA YARDARM RESTAURANT, LOCATED AT
FAIRHOPE MUNICIPAL PIER. COUNCILMEMBER DUCK MOVED TO APPROVE THE
ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER QUINN, MOTION
PASSED UNANIMOUSLY.
COUNCIL REVIEWED AN APPLICATION TO DOWNGRADE FROM A CLUB
LIQUOR LICENSE TO A SPECIAL RETAIL LICENSE BY EDWARD E. NELSON, DBA
THE GRILL AT QUAIL CREEK, INC., LOCATED AT 1 984 1 QUAIL CREEK DRIVE.
COUNCILMEMBER JONES MOVED TO APPROVE THE ISSUANCE OF THE
LICENSE. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED
UNANIMOUSLY.
COUNCIL REVIEWED AN APPLICATION TO DOWNGRADE FROM A CLUB
LIQUOR LICENSE TO A RESTAURANT LIQUOR LICENSE BY ROBIN LAMBERT, DBA
OLD BAY STEAMER, LOCATED AT 3 1 2 FAIRHOPE AVENUE. COUNCILMEMBER
DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY
COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
COUNCIL REVIEWED AN APPLICATION TO DOWNGRADE FROM A CLUB
LIQUOR LICENSE TO A RESTAURANT LIQUOR LICENSE BY JAMES B. MARSHALL,
DBA RENAISSANCE CAFE, LOCATED AT 10 1/2 NORTH SECTION STREET.
COUNCILMEMBER FORD MOVED TO APPROVE THE ISSUANCE OF THE LICENSE.
SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO APPROVE THE REQUEST FOR
CHANGE ORDER # I , BY J & P CONSTRUCTION CO., INC., ADDITIONAL FILL AT
THE CLARIFIES, (PHASE IV UPGRADE TO THE WWFr). AN INCREASE OF
$3 1,950.00. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO APPROVE INSURANCE COVERAGE ON
THE KENDALL WHITE, AND DELETE DEIDRA BAGGETT. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.

THE COUNTY COMMISSION REQUEST THAT THE COUNCIL APPROVE TO
PAY 1 0% ($40,000.00) IN MATCHING FUNDS FOR A GRANT APPLICATION
FOR $400,000.00. THIS GRANT WOULD BE USED TO PROVIDE SEWER
SERVICES IN THE NEW ERA COMMUNITY. COUNCILMEMBER DUCK MOVED TO
DENY THE REQUEST, BUT ENCOURAGED THE COUNTY TO PURSUE WITH THIS
PROJECT. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED
UNANIMOUSLY.
THE FAIRHOPE HIGH SCHOOL P.T.O., PRESIDENT, MR. D. BRUCE
MURRAY ADDRESSED THE COUNCIL REQUESTING PERMISSION TO SELL SOFT
DRINKS AT THE MUNICIPAL PIER PARK. THIS WOULD BE A FUND RAISER THAT
WOULD TAKE PLACE AT THE CONCLUSION OF THE FAIRHOPE HIGH SCHOOL
HOMECOMING PARADE ON I OCTOBER 1 998. COUNCILMEMBER JONES
MOVED TO GRANT THE REQUEST. SECONDED BY COUNCILMEMBER QUINN,
MOTION PASSED UNANIMOUSLY.
MR. JOE REIMER, DIRECTOR OF THE BALDWIN COUNTY COMMUNITY
POPS BAND ADDRESSED THE COUNCIL REQUESTING THE CITY'S APPROVAL AND

SYNCHRONIZED. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER JONES, CHAIR PERSON OF THE STREET COMMITTEE,
REPORTED ON THE REQUEST TO MAKE BISHOP ROAD AND GAYFER AVENUE A
4-WAY STOP. COUNCILMEMBER JONES AND HIS COMMITTEE REPORTED THAT
THE INTERSECTION IS OUTSIDE THE CITY LIMITS, BUT MOVED TO RECOMMEND
TO THE COUNTY TO PLACE A CAUTION LIGHT, OR A SCHOOL CROSSING AT THIS
INTERSECTION. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED
UNANIMOUSLY.
