PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W. JOHNSON. NO ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER PUCKETT MOVED TO APPROVE MINUTES OF THE 1 3 APRIL 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. MAYOR NIX SKIPPED THE SECOND ITEM ON THE AGENDA UNTIL THE ARRIVAL OF ATTORNEY DAVID SHEPHARD TO ADDRESS THE DEMOLITION OF THE BUILDING LOCATED AT 5 1 NORTH SECTION STREET AND MAGNOLIA AVENUE. COUNCIL REVIEWED AN APPLICATION FOR BEER OFF -PREMISES AND WINE OFF -PREMISES LICENSES BY STUART M. MORGAN, DBA RITE AID, AT 10 1 GREENO ROAD (NEW LOCATION). NO ONE PRESENT WAS OPPOSED TO THE LICENSE. THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMEMBER DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK MOVED TO APPROVE AN APPROPRIATION OF $4,000.00 TO THE VOLUNTEER FIRE DEPARTMENT TO SEND FIREMEN TO THE FIRE COLLEGE THIS YEAR. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER JONES ARRIVED. 2153 27 APRIL 1 998 COUNCILMEMBER JONES MOVED TO APPROVE THE REQUEST OF THE EASTERN SHORE CHAMBER OF COMMERCE TO HOLD THEIR ANNUAL ARTS AND CRAFTS SHOW ON MARCH 1 9, 20, AND 2 1, 1999. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. THE FOLLOWING STREETS WILL BE USED: MAGNOUAAvENUE FROM BANCROFT STREET wESTTo318 MAGNOLIA AVENUE (KEN SLADE'S OFFICE). SECTION STREET FROM 55 N. SECTION STREET (OLD SOUTHERN VERANDA) SOUTH APPROXIMATELY TO GREERS/FOOD TIGER. FAIRHOPE AVENUE FROM BANCROFT STREET WEST TO THE BARRICADES SET AT SUMMIT STREET. CHURCH STREET FROM THE INTERSECTION OF FAIRHOPE AVENUE TO DE LA MARE STREET. DE LA MARE STREET FROM CHURCH STREET TO SECTION STREET. CHURCH STREET NORTH FROM THE INTERSECTION OF FAIRHOPE AVENUE TO THE ENTRY OF THE PUBLIC PARKING ENTRANCE FOR THE PURPOSE OF LOCATING ONE-HALF OF THE FOOD COURT BOOTHS, PERMITTING A SMOOTHER FLOW OF TRAFFIC AND OPEN AREAS IN FRONT OF THE MERCHANTS LOCATED THERE. AND JOHNSON AVENUE FROM SECTION STREET EAST TO BANCROFT STREET. COUNCILMEMBER FORD MOVED TO AUTHORIZE THE SALE OF SURPLUS VEHICLES AND EQUIPMENT OWNED BY THE CITY OF FAIRHOPE. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED THAT ATTORNEY DAVID SHEPHARD HAS ARRIVED. A PUBLIC HEARING WAS HELD ON THE DEMOLITION OF THE BUILDING LOCATED AT 5 1 NORTH SECTION STREET, MR. SHEPHARD STATED THAT ALL APPROPRIATE PETITIONS TO MOVE THE CASE TO CIRCUIT COURT AND TO SALE THE PROPERTY HAVE BEEN FILED. ONE OF THE LIVING HEIRS OF THIS PROPERTY IS INCOMPETENT AND THE GUARDIAN OF THIS INDIVIDUAL DID NOT FILE AN ANSWER TO THE PETITIONS. MR. SHEPHARD FURTHER STATED THAT ADVERTISING FOR THE SALE OF THE PROPERTY WILL TAKE PLACE DURING THE MONTH OF JUNE, 1 998. THE PROPERTY WILL BE SOLD BY BIDS INSTEAD OF A PUBLIC SALE. AFTER THE BID OPENING, THE ACTUAL SELLING OF THE PROPERTY MAY BE PROLONGED. THE MAYOR STATED THAT HE IS IN AGREEMENT TO ALLOW ADDITIONAL TIME FOR THE DEMOLITION. AFTER FURTHER DISCUSSION. COUNCILMEMBER DUCK MOVED TO PUT OFF ON TAKING ANY ACTION FOR 90 DAYS, BUT THE PARKING LOT MUST BE CLEARED OF ROCKS IMMEDIATELY AND KEPT CLEARED. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. 2154 27 APRIL 1 998 ONE 5-YEAR TERM ON THE PERSONNEL BOARD. COUNCILMEMBER FORD MOVED TO REAPPOINT SHEP SHEPHARD. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY ONE 2-YEAR TERM ON THE AIRPORT BOARD. COUNCILMEMBER PUCKETT MOVED TO REAPPOINT ANDY HUGGINS. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY ONE 3-YEAR TERM ON THE ORGANIC SCHOOL BOARD. COUNCILMEMBER DUCK MOVED TO REAPPOINT MAYMOSS PARKER.
