RESOLUTION NO. 587-98
WHEREAS, THE CITY OF FAIRHOPE, ALABAMA IS DESIROUS OF OBTAINING
FUNDING MADE AVAILABLE THROUGH THE ALABAMA DEPARTMENT OF TRANSPORTATION
UNDER THE TRANSPORTATION ENHANCEMENT PROGRAM (ISTEA) FOR THE PURPOSE OF
CONSTRUCTING A LANDSCAPED AND STREETSCAPED PEDESTRIAN/BIKE TRAIL ALONG THE
RIGHT-OF-WAY OF U.S. HIGHWAY 98 WITHIN THE CITY LIMITS OF THE CITY, AND
WHEREAS, LOCAL FINANCIAL PARTICIPATION IS A REQUIREMENT FOR PROPOSAL
CONSIDERATION, AND PROOF OF COMMITMENT IS REQUIRED.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA, AS FOLLOWS:
SECTION I . THAT THE CITY OF FAIRHOPE, ALABAMA, SUBMIT A PROPOSAL FOR
FUNDING CONSIDERATION TO THE ALABAMA DEPARTMENT OF TRANSPORTATION FOR FY
1998 TRANSPORTATION ENHANCEMENT FUNDING IN THE AMOUNT OF $200,000.00
FOR THE PURPOSE OF CONSTRUCTING A PEDESTRIAN WAY / BIKE WAY ALONG THE RIGHT-
OF-WAY OF U.S. HIGHWAY 98 WITHIN THE CITY LIMITS OF THE CITY OF FAIRHOPE.
SECTION 2. THAT THE CITY OF FAIRHOPE, ALABAMA, HEREBY COMMITS THE AMOUNT
OF $50,000.00 (20%) IN LOCAL FUNDS FOR THE PURPOSE OF CONSTRUCTING THE
$250,000.00 PROJECT.

ASSENTING TO THE VACATION OF
THE DRAINAGE AND UTILITY EASEMENT
A RESOLUTION
THAT LEONARD G. TEEL AND MARY JO TEEL, HUSBAND AND WIFE, HEREINAFTER
REFERRED TO AS "TEEL" ARE THE OWNERS OF LOT 2, IDLEWILD PHASE ONE, AND ROBERT
S. WHITEHEAD, III AND KATIE P. WHITEHEAD, HUSBAND AND WIFE, HEREINAFTER
REFERRED TO AS "WHITEHEAD" ARE THE OWNERS OF LOT 3, IDLEWILD, PHASE ONE, AND,
ABK DEVELOPMENT LIMITED LIABILITY COMPANY, HEREINAFTER REFERRED TO AS "ABK"
ARE THE OWNERS OF LOT 5, 6, 7, AND 8, IDLEWILD, PHASE ONE, AND ARE THE OWNERS
OF ALL OF THE PROPERTY ABUTTING ON THAT PORTION OF THE FOLLOWING DESCRIBED
PROPERTY, TO -WIT:
LOT 2, IDLEWILD, PHASE ONE, AS RECORDED ON SLIDE 1593-B, IN THE OFFICE
OF PROBATE RECORDS, BALDWIN COUNTY, ALABAMA.
AND

AND THE SAID OWNERS OF BOTH LOTS HAVE FILED A PETITION WITH THE CITY
COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, REQUESTING THAT SAID CITY COUNCIL GIVE
AN ASSENT TO THE VACATION OF THE TEN (1 O) FOOT UTILITY EASEMENT ALONG THE NORTH
PROPERTY LINE OF LOT 2, IDLEWIDE, PHASE ONE AND THE TEN ( 1 O) FOOT UTILITY
EASEMENT ALONG THE SOUTH PROPERTY LINE OF LOT 3, IDLEWILD, PHASE ONE, AS
DESCRIBED IN SAID PETITION. THE PETITIONERS TEEL AND WHITEHEAD HAVE DISCUSSED THE
PROPOSED VACATION OF SAID UTILITY EASEMENTS WITH PETITIONER ABK AS DEVELOPER OF
IDLEWILD, PHASE ONE AND AS OWNER OF THE REMAINING UNSOLD LOTS OF IDLEWILD, PHASE
ONE AND ABK HAS NO OBJECTION TO SAID VACATION BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, AS FOLLOWS:
THAT IT IS IN THE PUBLIC INTEREST THAT THE VACATION OF THE ABOVE DESCRIBED
PROPERTY BE GRANTED AND THAT SAID VACATION WILL NOT DEPRIVE AND WILL IN NO WAY BE
DETRIMENTAL TO THE CITY OF FAIRHOPE OR OTHER PROPERTY OWNERS. THAT THE CITY
COUNCIL OF THE CITY OF FAIRHOPE DOES ASSENT TO THE VACATION OF THE TEN ( 1 O) FOOT
UTILITY EASEMENT DESCRIBED AS FOLLOWS, TO -WIT:

CLUB LIQUOR LICENSE BY ROBERT RAYMOND HOEB, DBA THE LAST NACHO,
LOCATED AT 19344 SCENIC HIGHWAY 98. MR. HOEB WAS PRESENT. HOP
ALLEN EXPRESSED THAT HE DISAGREE WITH ANY RESTAURANT REQUESTING A
CLUB LIQUOR LICENSE JUST SO ALCOHOL CAN BE SOLD ON SUNDAYS.
THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMEMBER DUCK
MOVED TO APPROVE THE ASSURANCE OF THE LICENSE. SECONDED BY

MIKE REJCZYK, WATER & SEWER SUPERINTENDENT REPORTED THAT
THE NEW WATER WELL IS READY FOR OPERATION UPON APPROVAL FROM
ADEM, AND THE NEW SEWER PLANT IS 85% COMPLETE.
COUNCILMEMBER MIKE FORD STATED THAT HE SPOKE WITH THE
BUILDING OFFICIAL BOD LUNSFORD REGARDING THE STATUS OF THE PLAN
UNIT DEVELOPMENT, AND LEARNED THAT THE PUB IS BEING WORKED ON, BUT
IS NOT FAR ENOUGH ALONG TO GIVE A PROGRESS REPORT.
AARON NORRIS REPORTED THAT A GENERATOR WAS INSTALLED AT THE
NEW SEWER PLANT, AND THAT THE MAYOR GOLF TOURNAMENT WILL TAKE
PLACE 24 APRIL 1998.
