PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK GENIECE W. JOHNSON. ON ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER QUINN MOVED TO APPROVE MINUTES OF THE 1 2 JANUARY 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. MS. PEGGY VANOVER OF BALDWIN COUNTY ELECTRIC MEMBERSHIP CORPORATION PRESENTED THEIR BUSINESS LICENSE CHECK. THE CHECK $8,569.48, REPRESENTS A PERCENTAGE OF BCEMC'S BUSINESS REVENUES IN THE POLICE JURISDICTION. MR. CRAIG RYAS ADDRESSED THE COUNCIL ASKING IF THE COUNCIL WOULD RECONSIDER THEIR DECISION ON DENYING THE REZONING OF THE TRIANGLE. CRAIG FEELS THAT SINGLE FAMILY ZONING IS NOT RIGHT FOR THE ENTRANCE OF FAIRHOPE. AFTER SOME DISCUSSION, MAYOR NIX STATED THAT THE ISSUE WAS DEAD AND THAT THE DYAS FAMILY COULD NOT COME BACK TO THE COUNCIL FOR ONE YEAR. A PUBLIC HEARING WAS HELD AS ADVERTISED ON THE REQUEST OF A CLUB LIQUOR LICENSE BY EDWARD E. NELSON, DBA THE GRILL AT QUAIL CREEK, LOCATED AT 1 984 1 QUAIL CREEK DRIVE. MR. NELSON PRESENTLY HAS A BEER ON/OFF-PREMISES LICENSE AT THIS LOCATION. MR. NELSON WAS PRESENT. NO ONE PRESENT WAS OPPOSED TO THE LICENSE. THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMEMBER FORD MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. 2121 26 JANUARY 1 998 COUNCIL REVIEWED AN APPLICATION FOR A RESTAURANT LIQUOR LICENSE BY JAMES MICHAEL PAIR, DBA FAIRHOPE INN AND RESTAURANT, LOCATED AT 63 SOUTH CHURCH STREET. MR. PAIR WAS PRESENT. NO ONE PRESENT WAS OPPOSED TO THE LICENSE. THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMEMBER DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER PUCKETT MOVED TO APPROVE THE REQUEST FROM MOBILE BAY NATIONAL ESTUARY PROGRAM TO SUPPORT THE IMPROVEMENT AND PROTECTION OF WATER QUALITY AND ENHANCE LIVING RESOURCES. ALL THE CITIES BORDERING THE BAY ARE BEING ASKED TO SUPPORT THIS PROJECT. THE CITY OF FAIRHOPE IS ASKED TO PAY $ 2, 750.00. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. THE FAIRHOPE ROTARY CLUB ADDRESSED THE COUNCIL ASKING IF THEY COULD HOLD AN ANNUAL MUSIC FESTIVAL ON MAY 9, 1998 FROM 1 0:00 AM - 7:00 PM. THE FOLLOWING DOWNTOWN STREETS WOULD BE CLOSED IF THEIR REQUEST IS GRANTED: CHURCH STREET FROM MORPHY AVENUE TO FAIRHOPE AVENUE, FAIRHOPE AVENUE FROM CHURCH STREET TO SECTION STREET, SECTION STREET FROM FAIRHOPE AVENUE TO DE LA MARE STREET, AND THE ENTIRE DE LA MARE STREET. THE ROTARY CLUB ALSO REQUEST PERMISSION TO SALE BEER DURING THE FESTIVAL. PROCESSES FROM THIS EVENT WILL BENEFIT THE FAIRHOPE BOYS AND GIRLS CLUB, BALDWIN COUNTY SCHOOLS, CIVIC ORGANIZATIONS, AND LOCAL CHARITIES. MAYOR NIX STATED THAT HE HAD RESERVATION ABOUT ALLOWING THE SALE OF BEER DURING THIS EVENT. COUNCILMEMBER DUCK MOVED TO HOLD THE ROTARY CLUBS REQUEST OVER UNTIL A SURVEY CAN BE CONDUCTED BY THE CHAMBER OF COMMERCE TO GET THE INPUT OF THE DOWNTOWN MERCHANTS, AND MOVED TO APPROVE THE ROTARY CLUB TO HAVE THEIR FESTIVAL AT THE MUNICIPAL PARK IF THE DOWNTOWN AREA WAS NOT APPROVED. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. MR. BILL DAVENPORT REQUESTED TO BE ON THE AGENDA, BUT WAS NOT PRESENT. MR. HARRY COURTMAN, REPRESENTING MR. TONY CHAVERS ADDRESSED THE COUNCIL REQUESTING THE OPENING OF THE CHANNEL AT FLY CREEK. THE CHANNEL WAS FILLED WITH SILT BY HURRICANE DANNY. COUNCILMEMBER JONES MOVED TO APPROVE THE REQUEST TO MAKE THE WHOLE CHANNEL ASSESSABLE AT FLY CREEK. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. 2122 26 JANUARY 1 998 COUNCILMEMBER FORD MOVED TO APPROVE INSURANCE COVERAGE ON THE FOLLOWING VOLUNTEER FIRE PERSONS: TOMMY BOZEMAN, LORRY ARD, DANNY COLLELI, BRIAN NEWMAN, AND BILLY RAY JOHNSTON. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. COUNCIL TOOK THE FOLLOWING ACTION ON BIDS: Identification: "PVC CONDUIT" Bids to be opened on: January 7. 1998 at: 11:00 a.m. Annual PVC Conduit Bid. SIZE CONDUIT. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED THAT THE HOUSING REHABILITATION PROGRAM IS NOW OPEN CITY-WIDE. ALL CITIZENS IN FAIRHOPE THAT ARE INTERESTED MAY REQUEST ASSISTANCE, PROVIDED ALL OTHER ELIGIBILITY REQUIREMENTS ARE MET. THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 6:23 PM.
