PRESENT WERE MAYOR NAMES P. Nix; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, AND JEANETTE PUCKETT; CITY
ATTORNEY MARION E. WYNNE AND CITY CLERK GENIECE W. JOHNSON.
WILLIAM H. JONES WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE
27 OCTOBER 1 997 REGULAR MEETING, AND 3 NOVEMBER 1 997 SPECIAL
MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER FORD INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
PUCKETT, MOTION PASSED UNANIMOUSLY.

WHEREAS, the Owners of Belle Chase Subdivision Phase 2,
are desirous of having the streets and the utilities
therein accepted for maintenance by the City Council in
order that building permits may lawfully issue, and;
WHEREAS, the General Superintendent of the City represents
that the physical improvements in the nature of streets,
drainage and utilities have been installed in substantial
conformity with City requirements, and;
WHEREAS, the City has received Engineer's Certified As -
built Plans, test reports and lateral locations
substantially as required by Chapter 19 of the Code of
Ordinances, and;
WHEREAS, the performance bond of contractor under the
special assessments program has been conditioned upon
warranty of materials and workmanship for a period of
two years after acceptance of streets, and;
WHEREAS, the Plat of said Belle Chase Subdivision Phase 2
which has been recorded in the Probate Records of Baldwin
County, Alabama at Slide No. 1770-A, delineates thereon
the subject streets therein as public ways;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the said streets and the
utilities within said Subdivision be and the same hereby
are accepted for public maintenance subject to the bond
posted and repair of broken curb radius. This resolution
of acceptance shall not obligate the City of Fairhope to
maintain any utility or drainage facilities outside the
limits of the right-of-way of the public street, whether
or not such may be located within dedicated easements.

THE COUNCIL AGREED TO INCREASE THE FRANCHISE FEES FOR TCI OF
THE GULF PLAINS FROM 3.00 % TO 3.09%. THIS WILL MEAN ADDITIONAL
INCOME FOR THE CITY. THE INCREASE COMES AFTER THE FIFTH CIRCUIT
COURT RULED TO REVERSE THE FEDERAL COMMUNICATIONS COMMISSIONS
(FCC) DECISION WHICH STATES: `THAT FRANCHISE FEES COLLECTED FROM
CABLE CUSTOMERS ARE NOT GROSS REVENUES SUBJECT TO FRANCHISE
FEES. THEREFORE, IN COMPLIANCE WITH THIS COURTS INTERPRETATION OF
FEDERAL LAW, TCI OF THE GULF PLAINS WILL INCLUDE FRANCHISE FEES
COLLECTED FROM CUSTOMERS IN GROSS REVENUES FOR THE PURPOSE OF
CALCULATING FRANCHISE FEE PAYMENTS AS OF SEPTEMBER 22, 1 997.
MR. CHARLES SOMAN AT 50 PADDOCK DRIVE ADDRESSED THE
COUNCIL REQUESTING PERMISSION TO ERECT A SIGN AT THE ENTRANCE OF
PADDOCK DRIVE. THE SIGN WILL READ PADDOCK ESTATE. THE SIGN WILL BE
PLACED AND MAINTAINED AT THE EXPENSE OF MR. SOMAN. A PETITION OF
SOME 46 RESIDENTS ARE IN FAVOR OF THE SIGN. FOUR RESIDENTS ARE
OPPOSED, AND ONE RESIDENT REMAINS NEUTRAL. MRS. NANCY ALLEN
STATED THE FOUR RESIDENTS WHO ARE AGAINST THE SIGN EXPRESSED THAT
THEY DID NOT HAVE PRIOR INPUT IN THIS DECISION. COUNCILMEMBER PUCKETT
MOVED FOR THE APPROVAL OF PLACING THE SIGN, UNDER ONE CONDITION THE
CITY WILL REMOVE THE SIGN IF ANY PROBLEMS SHOULD OCCUR. SECONDED
BY COUNCILMEMBER QUINN. MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER DUCK MOVED TO APPROVE THE REQUEST OF THE
EASTERN SHORE ART CENTER TO HOLD THEIR ANNUAL OUTDOOR ART SHOW
ON MARCH 20, 2 1 , AND 22, 11998, ON OAK STREET, FROM BANCROFT TO
SECTION STREET, AND UP SECTION STREET ONE-HALF BLOCK PAST EQUALITY
STREET. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO APPROVE THE REQUEST OF THE
EASTERN SHORE OPTIMIST CLUB TO USE THE LOT ON SECTION STREET FOR
THEIR ANNUAL CHRISTMAS TREE SALE. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.

COUNCILMEMBER FORD MOVED TO GRANT THE REQUEST OF FIRST
FEDERAL MORTGAGE TO USE APPROXIMATELY THREE FEET OF THE CITY
EASEMENT TO THE LEFT OF ALTOS BUILDING (SOUTH SIDE), TO EXTEND AND
FACILITATE A SINGLE LANE DRIVE THROUGH. UNDER THE FOLLOWING
CONDITIONS: FIRST FEDERAL MORTGAGE AGREES IN WRITING THAT THEY WILL
MOVE THEIR DRIVE THROUGH UPON THE CITY'S REQUEST, AND THAT THEY WILL
MAINTAIN THE DRIVE THROUGH. SECONDED BY COUNCILMEMBER DUCK,
MOTION PASS UNANIMOUSLY.

COUNCILMEMBER FORD COMMENDED THE FAIRHOPE FOOTBALL TEAM
FOR A JOB WELL DONE FRIDAY NIGHT. THE FAIRHOPE PIRATES DEFEATED THE
FOLEY LIONS 1 4- 1 3. THE PIRATES WILL HOST THE PRATTVILLE LIONS
FRIDAY, 14 NOVEMBER 1 997 IN THE FIRST PLAYOFF GAME.
MR. BEN CRUITT ASKED IF THE COUNCIL HAD DECIDED ON HIS REQUEST
OF 27 OCTOBER 1 997 MEETING. THE MAYOR STATED THAT MR. CRUITT'S
REQUEST IS STILL UNDER CONSIDERATION.
THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE COUNCIL
THE MEETING WAS DULY ADJOURNED AT 6: I I PM.
