ONE WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE
22 SEPTEMBER 199/ REGULAR MEETING, AND 29 SEPTEMBER 1997 SPECIAL
MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
THE EASTERN SHORE CHAMBER OF COMMERCE PRESENTED THE MAYOR WITH
A CERTIFICATE, THANKING THE CITY FOR THEIR SUPPORT DURING THE ANNUAL ARTS
AND CRAFTS FESTIVAL. THE ESCC FESTIVAL HAS BEEN SELECTED AS ONE OF THE
200 BEST SHOWS IN THE UNITED STATES BY SUNSHINE ARTIST MAGAZINE READERS.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED ORDINANCE TO
AMEND THE ZONING ORDINANCE. COUNCILMEMBER DUCK INTRODUCED IN WRITING
ORDINANCE No. 1022. THE PLANNING AND ZONING COMMISSION RECOMMENDS
APPROVAL OF THIS ORDINANCE. THE ORDINANCE WILL CHANGE PROPERTY OWNED
BY DENNIS BYRNE AND CHARLES INGERSOLL LOCATED AT 19690 GREENO ROAD
FROM R-5 HIGH DENSITY MULTI -FAMILY TO B-2 GENERAL BUSINESS. NO ONE
PRESENT WAS OPPOSED TO THE AMENDMENT. IN ORDER TO TAKE IMMEDIATE ACTION
COUNCILMEMBER JONES MOVED TO SUSPEND THE RULES. SECONDED BY
COUNCILMEMBER QUINN, MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY
THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -
NONE. COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT MAYOR JAMES P. NIX IS HEREBY AUTHORIZED TO EXECUTE A
LEASE BETWEEN THE CITY AND ALLTEL MOBILE COMMUNICATIONS, INC.
ALLOWING ALLTEL MOBILE COMMUNICATIONS, INC. TO LEASE SPACE ON TWO OF
THE CITY'S WATER TANKS - ONE AT COUNTY ROAD 3 AND YENNE ROAD AND THE
SECOND ON NICHOLS STREET. ORIGINAL 5-YEAR TERM OF LEASE TO BE
1 2,000.00 PER YEAR, PER TANK, WITH FOUR 5-YEAR RENEWAL OPTIONS WITH
INCREASING RATES, PER TANK.

WHEREAS, THE DEVELOPERS OF RIVER MILLS SUBDIVISION, UNIT I, A SUBDIVISION RECORDED IN
THE PROBATE RECORDS OF BALDWIN COUNTY, ALABAMA AT SLIDE 1 54 1 -B, ARE DESIROUS OF
HAVING THE UTILITIES THEREIN ACCEPTED FOR MAINTENANCE BY THE CITY OF FAIRHOPE, ALABAMA,
AND;
WHEREAS, ALTHOUGH NO MAINTENANCE BOND WAS POSTED AS PROVIDED BY CHAPTER 19 OF THE
FAIRHOPE CODE OF ORDINANCES, THE TWO-YEAR MAINTENANCE PERIOD HAS RUN WITHOUT INCIDENT,
AND;
WHEREAS, THE CONSIDERATION FOR MAINTENANCE OF STREETS AND DRAINAGE IS INAPPROPRIATE
FOR WANT OF PROPER PROCEDURE AS SET OUT IN SECTION 1 1 -49-80 AND 1 1 -49-8 1. CODE OF
ALABAMA, 1975, AND;
WHEREAS, THE DEVELOPER REPRESENTS THAT CONDITIONS OF APPROVAL BY THE FAIRHOPE
PLANNING HAVE BEEN MET;
NOW, THEREFORE BE IT RESOLVED BY THE Cf1Y COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, THAT THE ELECTRIC, WATER, SEWER, AND GAS MAINS AND THE SEWAGE LIFT STATION IN
RIVER MILLS UNIT ONE BE AND HEREBY ARE ACCEPTED FOR CITY MAINTENANCE; FACILITIES THEREIN
ARE HEREBY EXPRESSLY EXCEPTED FROM ANY DUTY TO MAINTAIN BY THE CITY OF FAIRHOPE UNTIL

REPRESENT THE CITY OF FAIRHOPE IN THE NATION IN BLOOM COMPETITION. THE
CITY DID NOT WIN. HOWEVER, IT WAS A HONOR FOR THE CITY TO HAVE BEEN
INVITED.
