AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
16 I NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
MONDAY, I I AUGUST 1997.
PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND
WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE AND DEPUTY CITY
CLERK GENIECE W. JOHNSON. CITY CLERK EVELYN P. PHILLIPS WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE
28 JULY 1 997 REGULAR SESSION AS WRITTEN. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON THE REZONING
REQUEST BY CARL J. SCHNEIDER CHANGING FROM B4 BUSINESS &
PROFESSIONAL TO B2 GENERAL BUSINESS. MR. SCHNEIDER WAS NOT
PRESENT. THERE WERE SEVERAL PRESENT THAT WERE OPPOSED TO THE
REZONING AND A PETITION WAS TURNED INTO THE PLANNING be ZONING
COMMISSION. THE PLANNING & ZONING COMMISSION RECOMMENDS DENIAL OF
THE REQUEST. COUNCILMEMBER DUCK MOVED TO DENY THE REQUEST.
SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD INTRODUCED IN WRITING ORDINANCE NO.
1020. AN ORDINANCE PROVIDING SPECIAL BUILDING SETBACKS ALONG
PUBLIC ROADS AND HIGHWAYS WITHIN THE CITY OF FAIRHOPE. IN ORDER TO
TAKE IMMEDIATE ACTION COUNCILMEMBER JONES MOVED TO SUSPEND THE
RULES. SECONDED BY COUNCILMEMBER PUCKETT, MOTION TO SUSPEND THE
RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD,
QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER PUCKETT
THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1 020. SECONDED BY
COUNCILMEMBER JONES, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY
BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND
JONES. NAY -NONE.

COUNCILMEMBER DUCK INTRODUCED IN WRITING ORDINANCE NO.
1 02 I . AN ORDINANCE PROHIBITING THE OPERATION OF TRACTOR TRAILERS
UPON PORTIONS OF THE DOWNTOWN AREA IN FAIRHOPE, ALABAMA. IN ORDER
TO TAKE IMMEDIATE ACTION COUNCILMEMBER JONES MOVED TO SUSPEND THE
RULES. SECONDED BY COUNCILMEMBER QUINN, MOTION TO SUSPEND THE
RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD,
QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK THEN
MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 102 1. SECONDED BY
COUNCILMEMBER JONES, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY
BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND
JONES. NAY -NONE.
COUNCIL REVIEWED AN APPLICATION FOR A RESTAURANT LIQUOR
LICENSE BY IRMA R. CORREA, DBA BAHIA, 104 NORTH SECTION STREET.
NO ONE PRESENT WAS OPPOSED TO THE LICENSE. THERE WAS POLICE
APPROVAL OF THE APPLICANT. COUNCILMEMBER DUCK MOVED TO APPROVE
THE LICENSE. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED
UNANIMOUSLY.
COUNCIL TOOK THE FOLLOWING ACTION ON BIDS:
SANITARY SEWER EXTENSION
FROM FAIRHOPE AIRPORT TO
SOUTH BALDWIN ELEMENTARY SCHOOL

COUNCILMEMBER PUCKETT MOVED TO ACCEPT THE LOW BID OF
FAIRHOPE PAVING, PROVIDED ALL SPECIFICATIONS ARE MET. SECONDED BY
COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.

MR. CHARLES H. BLACK, 54 FAIRHOPE AVENUE ADDRESSED THE
COUNCIL WITH CONCERNS ON EROSION CONTROL. MR. BLACK ASK THE
COUNCIL TO PROVIDE INFORMATION ON HOW TO HANDLE STREET RUNOFF AND
BUILDING RUNOFF. HE ALSO ASKED THAT THE COUNCIL PROVIDE THE
RESIDENTS WITH INFORMATION SHOWING HOW THE RESIDENTS COULD REDUCE
EROSION. THE MAYOR ASKED THAT THE STREET COMMITTEE LOOK INTO THIS.
OTHERS STATED THAT KIDS ARE PLAYING ON CLIFF DRIVE. THE MAYOR ASKED
THAT Tim KANT FIND OUT WHERE THE KIDS ARE PLAYING AND CORRECT THIS
PROBLEM BEFORE SOMEONE IS HURT.
COUNCILMEMBER PUCKETT MOVED TO PAY BILLS AS PRESENTED.
SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY.
MS. CLAUDINE MCCLINTOC ADDRESSED THE COUNCIL WITH CONCERNS
OF A TREE THAT WAS BROKEN DURING HURRICANE DANNY, AND DAMAGED THE
CITY'S ELECTRIC LINE. THE ELECTRIC DEPARTMENT CORRECTED THE
PROBLEM WITH THE ELECTRIC LINE. MS. MCCLINTOC FELT THAT THE CITY
SHOULD BE RESPONSIBLE FOR TRIMMING THE WHOLE TREE. THE MAYOR
INFORMED MS. MCCLINTOC THAT THE CITY COULD NOT TRIM TREES ON PRIVATE
PROPERTY, BUT WOULD DO WHAT WAS NECESSARY TO KEEP SERVICE UP.
THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED
AT 6: 10 PM.
