AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
1 6 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
MONDAY, 29 MAY 1 997,
PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY
ATTORNEY MARION E. WYNNE AND DEPUTY CITY CLERK GENIECE W.
JOHNSON. COUNCILMEMBER DEBBIE W. QUINN AND CITY CLERK EVELYN P.
PHILLIPS WERE ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER PUCKETT MOVED TO APPROVE MINUTES OF THE
1 2 MAY 1 997 REGULAR SESSION AS WRITTEN. SECONDED BY
COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER DUCK INTRODUCED IN WRITING ORDINANCE NO.
10 1 2, AN ORDINANCE TO PROTECT THE PUBLIC SAFETY, HEALTH AND
WELFARE OF THE RESIDENTS OF FAIRHOPE, ALABAMA BY FURTHER
REGULATING EXCAVATIONS AND OBSTRUCTIONS IN THE PUBLIC STREETS AND
PUBLIC WAYS BY AMENDING CHAPTER 19 OF THE FAIRHOPE CODE OF
ORDINANCES. IN ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER DUCK
MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER FORD,
MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING
VOTE: AYE -DUCK, FORD, NIX, PUCKETT, AND JONES. NAY -NONE.
COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO.
10 1 2. SECONDED BY COUNCILMEMBER JONES, MOTION TO FINAL ADOPT
PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, NIX,
PUCKETT, AND JONES. NAY -NONE.
BOB LUNSFORD REPORTED ON A DANGEROUS BUILDING LOCATED AT
5 1 NORTH SECTION STREET AND MAGNOLIA AVENUE. THIS IS THE ESTATE OF
HAZEL MARTHA FOSTER AGRON, SURVIVED BY MICHAEL AGRON. MR.
LUNSFORD REQUESTED THAT A PUBLIC HEARING BE HELD AT THE NEXT
REGULAR CITY COUNCIL MEETING. SO MOVED BY COUNCILMEMBER JONES.
SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.

COUNCILMEMBER FORD INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
DUCK, MOTION PASSED UNANIMOUSLY:
RESOLUTION No. 565-97
BE ff RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, THAT MAYOR NAMES P. NIX IS HEREBY
AUTHORIZED TO PURCHASE FOR THE CITY THE NUT -PROCESSING
PLANT PROPERTY ON FAIRHOPE AVENUE AND BANCROFT STREET
FROM MORVIN PARTNERS OF RICHMOND, VIRGINIA FOR THE TOTAL
SUM OF ONE MILLION SEVENTY-FIVE THOUSAND, DOLLARS,
(1,075,000.00) TO BE PAID 1 /3 EACH FROM THE THREE UTILITY
FUNDS.
ADOPTED THIS 29TH DAY OF MAY, 1997.

COUNCILMEMBER JONES AND HIS COMMITTEE (COUNCILMEMBER DUCK,
AND FORD) RESEARCHED THE REQUEST OF MS. BEATTY PEARSON TO PLACE A
STOP SIGN AT PECAN AVENUE AND LIBERTY STREET INTERSECTION.
COUNCILMEMBER JONES REPORTED THAT THE COMMITTEE RECOMMEND THAT A
STOP SIGN NOT BE PLACED AT THIS INTERSECTION, BUT RECOMMENDED THAT
THE POLICE DEPARTMENT MONITOR THE AREA.

SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
MAYOR NIX REPORTED THAT ALL ITEMS ARE NEARING COMPLETION ON
THE WASTE WATER TREATMENT PLANT UPGRADE.

THE RESIDENTS LIVING ON COUNTY ROAD 27 AND TWIN BEECH ROAD
PRESENTED A PETITION AGAINST THE COUNCIL GRANTING THE ISSUANCE OF A
CLUB LIQUOR LICENSE TO WILLIAM HAROLD AVANT, DBA CATAHOULA'S ON 24
MARCH 1997. THE MAYOR STATED THAT DURING THE MEETING OF 24
MARCH 1997 A PUBLIC HEARING WAS HELD WITH REGARD TO THIS LICENSE
AND THERE WAS NO OPPOSITION. THEREFORE THE RESIDENTS NEED TO
ADDRESS THIS MATTER WITH THE STATE BOARD NOT THE CITY.
THERE BEING NO OTHER BUSINESS, MEETING WAS DULY ADJOURNED AT
5:45 PM.
