SESSION AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL
CHAMBER; 1 6 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA
36532; ON MONDAY, 12 MAY 1997,
PRESENT WERE MAYOR NAMES P. Nix; COUNCILMEMBERS JOHN
V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT,
AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE AND CITY
CLERK EVELYN P. PHILLIPS. NO ONE WAS ABSENT.
A QUORUM BEING PRESENT, MAYOR NIX CALLED THE MEETING TO
ORDER. COUNCILMEMBER JONES MOVED TO APPROVE THE MINUTES OF
THE 28 APRIL 1 997 REGULAR SESSION. SECONDED BY
COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING ON A PETITION TO VACATE AN ALLEY WAS
HELD AS ADVERTISED. THE 20-FOOT ALLEY IS LOCATED IN HAWTHORNE
GLENN SUBDIVISION, PHASE ONE, AND THE ABUTTING OWNERS ARE
ALBERT W. KEY, FAIRHOPE SINGLE TAX CORPORATION, AND MORPHY
GROUP LIMITED. AFTER DISCUSSION, COUNCILMEMBER DUCK
INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE
FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER QUINN,
MOTION PASSED UNANIMOUSLY. NO ONE PRESENT WAS OPPOSED TO
THE VACATION:

A RESOLUTION VACATING AN ALL
IN HAWTHORNE GLENN SUBDIVISION PHASE ONE
WHEREAS, ALBERT W. KEY, MORPHY GROUP LIMITED, AND THE FAIRHOPE SINGLE TAX
CORPORATION, BEING ALL OF THE ABUTTING PROPERTY OWNERS OF A 20-FOOT ALLEY, LOCATED
IN HAWTHORNE GLENN SUBDIVISION, PHASE ONE, FAIRHOPE, ALABAMA, AS HEREINAFTER
DESCRIBED, WHICH SAID ALLEY IS NOT NOW IN USE NOR WILL IT EVER BE USED AS SUCH, DO
HEREBY DESIRE THE SAME BE VACATED AND DO BY THESE PRESENTS FILE THIS PETITION WITH THE
MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, TO VACATE SAID 20-FOOT ALLEY
DESCRIBED AS FOLLOWS:
ALL OF THAT CERTAIN 20-FOOT ALLEY WHICH IS 285 FT LONG RUNNING
EASTERLY FROM THE EAST SIDE OF HAWTHORNE CIRCLE ALONG THE
NORTH SIDE OF LOTS 27-A THROUGH 24 OF HAWTHORNE GLENN
SUBDIVISION, PHASE ONE, AND THE SOUTH SIDE OF LOT 28 OF SAID
SUBDIVISION AND VACANT LAND ADJACENT THERETO. ALL IN THE CITY OF
FAIRHOPE, ALABAMA, AS SHOWN ON A RESUBDIVISION OF LOTS 24-26
OF SAID SUBDIVISION RECORDED AT SLIDE 1 5 1 2-A IN THE BALDWIN
COUNTY PROBATE OFFICE.
WHEREAS, THE CITY OF FAIRHOPE HAS ACCEPTED THE SAID DECLARATION OF VACATION AND HAVE
DETERMINED THAT THE SAID ALLEY IS NOT NOW IN USE NOR WILL IT EVER BE IN USE AS AN ALLEY;
THEREFORE BE IT RESOLVED THAT THE CITY OF FAIRHOPE MAYOR AND COUNCIL DO BY THESE
PRESENTS ASSENT TO THE DECLARATION OF VACATION, AND IT BE, AND THE SAME IS, HEREBY
VACATED IN ACCORDANCE WITH TITLE 23-4-20, CODE OF ALABAMA, 1975, AS AMENDED.
ADOPTED THIS 1 2TH DAY OR MAY, 1997.

MAYOR NIX PRESENTED A PROPOSAL FROM THE BALDWIN
COUNTY HUMANE SOCIETY FOR CONSIDERATION. THE CITY AND THE
BALDWIN HUMANE SOCIETY (BHS) ARE DISCUSSING BUILDING A
COOPERATIVE ANIMAL SHELTER THAT WILL BE STAFFED BY BOTH
ORGANIZATIONS. A POLICY AND PROCEDURE MANUEL MUST BE
PREPARED, CONSTRUCTION COSTS WILL BE PRORATED, AND
THE PERSONNEL WILL BE CITY EMPLOYEES, BHS EMPLOYEES AND
VOLUNTEERS. COUNCILMEMBER PUCKETT MOVED TO APPROVE THE
CONCEPT AND ASKED THAT A PROGRESS REPORT BE MADE AS SOON AS
POSSIBLE. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER DUCK MOVED TO AUTHORIZE MAYOR NIX TO
EXECUTE AN ASSIGNMENT OF LEASE, ASSIGNING THE PCS SITE
AGREEMENT OF 1 211 7/96 BETWEEN THE CITY AND MOBILE TRI-STATES
L.P. To DIGIPH PCS, INC. THE ASSIGNMENT CONFORMS WITH THE
REQUIREMENTS OF PARAGRAPH FIVE (S) OF SAID AGREEMENT.
SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.

COUNCIL REVIEWED A REPORT FROM VOLKERT & ASSOCIATES ON
BIDS TAKEN ON PHASE IV UPGRADE --SITE GRADING, DRAINAGE, AND
CLARIFIERS --ON THE WASTEWATER TREATMENT PLANT. THERE WAS ONLY
ONE BID ON THE CLARIFIERS - Jim HOUSE & ASSOCIATES AT
$ 1,0 1 7,393.00 - AND VOLKERT RECOMMENDED ACCEPTANCE OF
THIS BID. SO MOVED BY COUNCILMEMBER JONES. SECONDED BY
COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. THERE WERE
NINE BIDS ON THE SITE GRADING & DRAINAGE, RANGING FROM
$84,803.50 UP TO $ 1 70,3 1 5.00. VOLKERT RECOMMENDED
ACCEPTANCE OF LOW BID OF $84, 803.50 BY JAMES BROTHERS
EXCAVATING. SO MOVED BY COUNCILMEMBER JONES. SECONDED BY
COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER FORD REPORTED FOR HIS COMMITTEE ON THE
BOAT RAMPS. THE PROBLEM SEEMS TO BE DUE TO THE SLIPPERINESS
OF THE RAMPS ---A NATURAL PHENOMINUM WHICH IS GOING TO OCCUR
NO MATTER WHAT IS DONE. COUNCILMEMBER FORD SAID THEY WERE
GOING TO TRY SOME REPAIRS THAT SHOULD CUT DOWN ON THE
SLIPPERY RAMP SURFACE, BUT IF THAT DOES NOT WORK, THE ONLY
ALTERNATIVE WILL BE TO REMOVE THE RAMPS COMPLETELY.
COUNCILMEMBER FORD MOVED TO GO AHEAD WITH THE SEVERAL
REPAIR -SUGGESTIONS AT THIS TIME. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.
COUNCILMEMBER PUCKETT MOVED TO PAY BILLS AS PRESENTED.
SECONDED BY COUNCILMEMBER JONES, MOTION PASSED
UNANIMOUSLY.
WATER SUPERINTENDENT MIKE REJCZYK REPORTED WE MAY HAVE
A NEW WELL. THERE HAVE BEEN FOUR FAILED ATTEMPTS. HE SHOULD
KNOW IN ABOUT TWO WEEKS IF THE NEW SITE PASSES ALL THE TESTS.
THERE BEING NO OTHER BUSINESS, MEETING WAS DULY
ADJOURNED AT 6:02 O'CLOCK P.M.
