PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS. NO ONE WAS ABSENT. A QUORUM BEING PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE THE MINUTES OF THE 1 4 APRIL 1 997 REGULAR SESSION. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. MAYOR NIX READ A PROCLAMATION MAKING I MAY 1997 "LAW DAY". COUNCILMEMBER DUCK MOVED TO APPROVE THE PROCLAMATION. SECONDED BY COUNCILMEMBER PUCKETT. MOTION PASSED UNANIMOUSLY. A PUBLIC HEARING WAS HELD AS ADVERTISED ON ANNEXING AND ZONING THE DENNIS FRODSHAM PROPERTY, AT 730 SOUTH MOBILE STREET, IN TWO PARCELS: "A" TO BE R2 SF MEDIUM DENSITY RESIDENTIAL AND "B" TO BE R3 SF HIGH DENSITY RESIDENTIAL. THERE WAS NO ONE PRESENT OPPOSED TO THE ZONING OR THE ANNEXATION. THERE WAS APPROVAL BY THE PLANNING & ZONING COMMISSION. AFTER DISCUSSION, COUNCILMEMBER QUINN INTRODUCED ORDINANCE NO. 10 I O IN WRITING, AN ORDINANCE TO ANNEX AND ZONE THE PROPERTY. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMEMBER DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER JONES, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER FORD THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 10 10. SECONDED BY COUNCILMEMBER QUINN, MOTION TO FINAL ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK INTRODUCED ORDINANCE NO. 10 1 1 IN WRITING, AN ORDINANCE TO ANNEX THE JOHN H. KING PROPERTY, 9235 GAYFER AVENUE EXTENSION. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMEMBER PUCKETT MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER JONES, MOTION 2020 28 APRIL 1997 TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 10 1 I . SECONDED BY COUNCILMEMBER JONES, MOTION TO FINAL ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY - NONE. COUNCILMEMBER FORD MOVED TO APPROVE A REQUEST BY THE ALABAMA SPORTS FESTIVAL ASSOCIATION TO USE THE BEACH ROAD FOR A ROLLER BLADE RACE ON JUNE 29, 1997, AT 6:00 A.M. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER FORD REQUESTED A TRANSFER OF $ 10,000.00 FROM THE RECREATION CAPITOL IMPROVEMENTS FUND TO THE RECREATION OPERATING FUND TO COVER OPERATING EXPENSES. AFTER DISCUSSION, COUNCILMEMBER JONES SECONDED THE MOTION. MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED AN OPENING FOR A 5-YEAR TERM ON THE LIBRARY BOARD. COUNCILMEMBER PUCKETT MOVED TO REAPPOINT FRANK BOEHM. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED THAT DICK SANDERSON'S TERM ON THE PLANNING & ZONING COMMISSION HAS EXPIRED. MR. SANDERSON DOES NOT WANT TO BE REAPPOINTED. MAYOR NIX NOMINATED RICHARD (DICK) CHARLES FOR THE 6-YEAR TERM. SO MOVED BY COUNCILMEMBER DUCK. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER JONES MOVED TO APPROVE CHANGE ORDER #3 ON THE GROUND & PIPE TECHNOLOGIES CONTRACT (WWTP UPGRADE) WHICH WILL RESULT IN A $262.30 INCREASE AND AN ADDITIONAL 45 CONSTRUCTION DAYS. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCIL DISCUSSED A REQUEST FROM BEATTY PEARSON FOR A STOP SIGN ON PECAN AVENUE AT THE LIBERTY STREET INTERSECTION. MAYOR NIX TURNED THE REQUEST OVER TO THE STREET COMMITTEE (CHAIRMAN JONES, WITH COUNCILMEMBERS DUCK & FORD) FOR RESEARCH AND A RECOMMENDATION AT THE NEXT REGULAR MEETING. COUNCIL TOOK THE FOLLOWING ACTION ON BIDS: 2021 26 APRIL 1997 Identification: "HEATING & COOLING - GYM. VOLANTA" Bids to be opened on: April 21, 1997 Time: 1:30 p.m. BAY AIRE, INC. 10-Days Fairhope, AL $24,960.00 "Lennox" System INGERSOLL'S REFRIGERATION $28,497.00 5-Working Days Fairhope, AL "Coleman Luxaire" System DOWSEY HEATING -AIR CONDITIONING NO BID Fairhope, AL BATCHLER HEATING & AIR CONDITIONING NO RESPONSE Mobile, AL CHARLES STEWART Bay Minette, AL NO RESPONSE It is recommended to accept the low bid of BAY AIKL, INU, Fairhope, AL for the total price of $24,960.00 with all specifications being met. Tim Kant, Public Works Supt. Wayne Smith, Purchasing Agent COUNCILMEMBER DUCK MOVED TO ACCEPT THE LOW BID BY BAY AIRE, INC., PROVIDED ALL SPECIFICATIONS ARE MET. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. THE NEXT TWO BIDS, CARPET AND TILE, WERE DISCUSSED TOGETHER, AS THE COUNCIL WAS TO CHOOSE WHICH MATERIAL WOULD BE USED. THE RECREATION BOARD RECOMMENDED THE 22-OZ CARPET BECAUSE THIS WOULD ALLOW ANOTHER SPORT, SOCCER, TO BE PLAYED INSIDE. THIS CARPET IS HIGHLY RECOMMENDED OVER THE 20-OZ BY SEVERAL 2024 28 APRIL 1997 SCHOOLS USING BOTH CARPET -WEIGHTS. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. THE COUNCIL DISCUSSED BEGINNING A PROGRAM FOR HELP ON UTILITY BILLS FOR INDIGENTS. A SPACE WOULD BE PROVIDED ON EACH UTILITY BILL FOR CUSTOMERS TO INDICATE AN AMOUNT TO BE PLACED IN AN "INDIGENT FUND". THIS WOULD BE VOLUNTARY. A COMMITTEE OF THREE: A CITY REPRESENTATIVE, A REPRESENTATIVE FROM THE ECUMENICAL MINISTRIES, AND A REPRESENTATIVE FROM THE MINISTERIAL ASSOCIATION, WOULD ADMINISTER THE PROGRAM. COUNCILMEMBER FORD MOVED TO GO AHEAD WITH THE COMMITTEE AND HAVE UTILITY BILLING SUPERVISOR JAMES GILLESPIE SERVE AS THE CITY'S REPRESENTATIVE. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. MAYOR NIX ADVISED THAT HE HAD BEEN NOTIFIED BY THE EASTERN SHORE CHAMBER OF COMMERCE THAT THEY WILL NO LONGER SPONSOR OR ORGANIZE THE ANNUAL FAIRHOPE CHRISTMAS PARADE. AFTER SOME DISCUSSION, COUNCILMEMBER QUINN VOLUNTEERED TO CHAIR A COMMITTEE, MEMBERS TO BE OF HER CHOICE, TO SEEK A NEW SPONSOR AND REPORT AS SOON AS POSSIBLE. MR. Tim JACKSON ADDRESSED THE COUNCIL ABOUT HIS CONCERN FOR THE WOODEN PIERS ALONG THE MUNICIPAL BEACH. THEY ARE PARTICULARLY SLIPPERY, DUE TO ALGAE, AND POSE A THREAT TO THE COMMUNITY. MR. JACKSON FEELS THEY SHOULD BE REPLACED WITH SLAG OR CONCRETE. MAYOR NIX TURNED THE MATTER OVER TO THE RECREATION COMMITTEE (FORD, CHAIRMAN, WITH DUCK AND PUCKETT) AND GENERAL SUPT. PHIL RUTHERFORD FOR STUDY AND TO MAKE A REPORT ON THEIR FINDINGS AS SOON AS POSSIBLE. THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 6:02 P.M.
