PRESENT WERE COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS. MAYOR JAMES P. NIX WAS ABSENT. IN THE ABSENCE OF MAYOR NIX, MAYOR PRO TEMP MICHAEL A. FORD PRESIDED. THERE BEING A QUORUM PRESENT, MAYOR PRO TEMP FORD CALLED THE MEETING TO ORDER. MAYOR PRO TEMP FORD AND THE OTHER MEMBERS WELCOMED NEWLY -APPOINTED MEMBER QUINN COUNCILMEMBER DUCK MOVED TO APPROVE THE MINUTES OF THE 10 FEBRUARY REGULAR SESSION AND THE 1 4 FEBRUARY SPECIAL SESSION AS WRITTEN. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. COUNCIL WAS PRESENTED WITH A PETITION, CONTAINING APPROXIMATELY 40 SIGNATURES, PROTESTING OPEN-AIR BURNING IN THE EASTERN SHORE MOBILE HOMES PARK AREA. THE PROTESTERS ARE ASKING FOR LEGISLATION TO BAN ALL OPEN-AIR BURNING, STATING THE TOXIC FUMES AFFECT NOT ONLY THOSE WITH RESPIRATORY AILMENTS BUT THOSE WHO HAVE NOT YET BEEN DIAGNOSED WITH SUCH AILMENTS. AFTER SOME DISCUSSION, THE PROTESTERS WERE TOLD THEIR SUGGESTIONS WOULD BE GIVEN TO A COMMITTEE COMPOSED OF FIRE CHIEF DUKE SMITH, CITY OFFICIAL BOB LUNSFORD, AND A COUNTY COMMISSION REPRESENTATIVE, WHO WOULD REPORT WHAT STEPS MIGHT BE TAKEN TO RELIEVE THE SITUATION JUST AS SOON AS POSSIBLE. THE PROTESTERS LIVE OUTSIDE THE CITY CORPORATE LIMITS MR. RON HAYES, ROSA ACRES SUBDIVISION, ADDRESSED THE COUNCIL ON JUVENILE PROBLEMS, MR. HAYES BELIEVES IMMEDIATE ACTION WILL HEAD OFF ANY WORSENING OF LOCAL PROBLEMS. SEVERAL ACTS OF VANDALISM IN ROSA ACRES HAVE BROUGHT THIS MATTER TO MR. HAYES' ATTENTION AND HE HAS TWO SUGGESTIONS TO OFFER: (I ) SET UP A COMMUNITY COMMITTEE, TO WORK CLOSELY WITH PUBLIC OFFICIALS AND POLICE, TO STUDY THE PROBLEMS AND COME UP WITH SOLUTIONS; AND (2) TO GO BACK TO HAVING THE POLICE WALK A BEAT IN THE NEIGHBORHOODS AS THEY ONCE USE TO DO. MAYOR PRO TEMP FORD THANKED MR. HAYES AND SAID HIS SUGGESTIONS WILL BE TAKEN UNDER ADVISEMENT. 1991 24 FEBRUARY 1997 COUNCILMEMBER DUCK INTRODUCED IN WRITING ORDINANCE NO. 1006, AN ORDINANCE TO CONTROL THE USE AND OPERATION OF CERTAIN WHEELED VEHICLES WITHIN AND UPON THE PUBLIC RECREATIONAL PARK LANDS AT THE VOLANTA AVENUE PARK. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMEMBER PUCKETT MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER JONES, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE - DUCK, QUINN, FORD, PUCKETT, AND JONES. NAY -NONE. COUNCIL - MEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1006. SECONDED BY COUNCILMEMBER JONES, MOTION TO FINAL ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, QUINN, FORD, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER PUCKETT INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY: RESOLUTION NO. 560-97 BE IT RESOLVED by the City Council of the City of Fairhope that the City enter into an agreement with the State of Alabama Department of Transportation for: To relocate gas mains along US Highway 31, at its intersection with Alabama Highway 59, (State Highway Project No. NHF 193(14), revised 2/97, which agreement is before the Council, and that the agreement be executed in the name of the City, by its Mayor, for and on its behalf and that it be attested by the City Clerk and the seal of the City affixed thereto. BE IT FURTHER RESOLVED that upon the completion of the execution of the agreement by all parties, that a copy of such agreement be kept on file by the City Clerk.
