Notice is hereby given of a special meeting of the
City Council of the City of Fairhope, Alabama, to
be held at the Fairhope Municipal Complex on
Friday, 14 February 1997, for the purpose of
business pertaining to the resignation of Council -
member David E. Bishop and the appointment of his
successor. Meeting to be at 5:00 pm.
CONSENT TO HOLDING OF MEETING
The undersigned members of the City Council of the
City of Fairhope, Alabama, do hereby acknowledge
service of the Notice and Call of Special Meeting
hereinabove set forth and do hereby consent to
the holding of such meeting at such time and in
such place and for the purpose set forth therein.

SESSION AT 5:00 P.m.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL
CHAMBER; 16 I NORTH SECTION STREET; FAIRHOPE, ALABAMA
36532; ON FRIDAY, 14 FEBRUARY I997.
PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS
JOHN V. DUCK, MICHAEL A. FORD, JEANETTE PUCKETT, AND WILLIAM
H. JONES; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN
P. PHILLIPS.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE
MEETING TO ORDER. THE PURPOSE OF THIS MEETING WAS TO DO
BUSINESS PERTAINING TO THE RESIGNATION OF COUNCILMEMBER DAVID
E. BISHOP; AND TO APPOINT HIS SUCCESSOR.
MAYOR NIX OPENED BY STATING COUNCILMEMBER BISHOP HAD
RENDERED HIS RESIGNATION IN WRITING AND HAD MADE IT EFFECTIVE ON
10 FEBRUARY 1 997. MR. BISHOP STATED HE FELT HE SHOULD TAKE
THIS ACTION DUE TO HIS SON, JODY BISHOP, BEING A CANDIDATE FOR
THE POSITION OF MUNICIPAL JUDGE. MR. BISHOP WANTED THERE TO
BE NO POSSIBILITY OF ANY CONFLICT OF INTEREST, AND WANTED HIS
SON TO HAVE THE OPPORTUNITY TO SERVE THE CITY AS HE,
COUNCILMEMBER BISHOP, HAS DONE SINCE 1972, THE FIRST OF HIS
SIX TERMS AS A MEMBER OF THE COUNCIL. MR. BISHOP WAS ELECTED
UNOPPOSED TO THIS, HIS SEVENTH TERM, AS HE WAS IN 1984,
1 988, AND 1992. (JODY WAS APPOINTED JUDGE ON FEB. I OTH.)
MAYOR NIX EXPLAINED, IN A SITUATION LIKE THIS, MOST
COUNCILMEMBERS WOULD PREFER TO HOLD AN ELECTION AND HAVE THE
PUBLIC FILL THE VACANCY; HOWEVER, STATE LAW FORBIDS THIS. THE
VACANCY MUST BE FILLED BY COUNCIL APPOINTMENT. MAYOR NIX
OPENED THE FLOOR FOR NOMINATIONS. COUNCILMEMBER PUCKETT
NOMINATED DEBBIE WHITE QUINN. THERE BEING NO OTHER
NOMINATIONS, COUNCILMEMBER DUCK MOVED TO CLOSE THE
NOMINATIONS AND TO APPOINT MRS. QUINN BY ACCLAMATION.
SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY.
THE MEETING WAS DULY ADJOURNED AT 5:06 P.M.
