Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND WILLIAM H. JONES; AND CITY ATTORNEY MARION E. WYNNE, AND DEPUTY CITY CLERK GENIECE W. JOHNSON. CITY CLERK EVELYN P. PHILLIPS WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE 13 JANUARY 1997 REGULAR SESSION AS WRITTEN. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. MS. PEGGY VANOVER OF BALDWIN COUNTY ELECTRIC MEMBERSHIP CORPORATION PRESENTED THEIR BUSINESS LICENSE CHECK. THE CHECK $8,530.79, REPRESENTS A PERCENTAGE OF BCEMC'S BUSINESS REVENUES IN THE POLICE JURISDICTION. MR. TOM DEKLE ADDRESSED THE COUNCIL TO CONSTRUCT A PIER AT THE FOOT OF WHITE AVENUE, BETWEEN MUNICIPAL PIER AND MILLER PIER. THE CITY ATTORNEY RECOMMENDS RESEARCHING THIS ISSUE. COUNCILMEMBER FORD MOVED THAT THEY RESEARCH MR. DEKLE'S REQUEST, SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER BISHOP INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. 27 JANUARY 1997 RESOLUTION NO. 556-97 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, THAT MAYOR JAMES P. NIX IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT BETWEEN THE CITY AND THE U.S. DEPARTMENT OF ENERGY (SEPA) FOR THE PURCHASE OF ELECTRICAL POWER, EFFECTIVE DATE TO BE 30 SEPTEMBER 1996, AND TO RUN TO MIDNIGHT ON 30 SEPTEMBER 2016. DULY APPROVED AND ADOPTED THIS 27TH DAY OF JANUARY 1997, JAM s P. Nix, MAYOR ATTEST -.- 62 VrJL EVELYN P. HILLIPS, CITY CLERK COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILCMEMBER JONES, MOTION PASSED UNANIMOUSLY. RESOLUTION NO. 557-97 WHEREAS, WGN TV CHICAGO IS ONE OF THE MOST POPULAR CHANNELS ON CABLE DUE TO ITS WELL-ROUNDED LINEUP OF ENTERTAINMENT, NEWS, SPORTS, AND CHILDREN'S PROGRAMMING; AND WHEREAS, WGN TV CHICAGO WILL CARRY CHICAGO CUBS, AND CHICAGO WHITE SOX BASEBALL GAMES, BOTH LOCALLY AND ON SATELLITE DURING THE 1997 SEASON, AND THEY WILL ALSO BROADCAST MANY CHICAGO BULLS BASKETBALL GAMES; THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, THAT THE MAYOR IS HEREBY AUTHORIZED TO ADVISE THE LOCAL CABLE COMPANY TCI OF THE GULF PLAINS OF THE OPPOSITION OF THIS BODY OF ELECTED REPRESENTATIVES OF THE PEOPLE TO THE DROPPING OF WGN TV CHICAGO FROM THE LOCAL CABLE SYSTEM. DULY APPROVED AND ADOPTED THIS 27TH DAY OF JANUARY 1997, JAMES1 P. NIX, MAYOR ATTEST EVELYN P. ILLIPS, CITY CLERK IM 27 JANUARY 1997 COUNCILMEMBER FORD REPORTED THAT WE ARE GOING TO CONTINUE RECYCLING AND WE NEED MORE PEOPLE TO PARTICIPATE IN THE RECYCLING PROGRAM. MAYOR NIX OPENED THE FLOOR FOR NOMINATIONS TO FILL A THREE- YEAR TERM ON THE ORGANIC SCHOOL BOARD. COUNCILMEMBER PUCKETT NOMINATED MR. JEFFERY R. CARR. THERE BEING NO OTHER NOMINATIONS, COUNCILMEMBER FORD MOVED TO CLOSE THE NOMINATIONS. COUNCILMEMBER DUCK MOVED TO APPOINT MR. CARR. SECONDED BY COUNCILMEMBER BISHOP, MOTION PASSED UNANIMOUSLY. MAYOR NIX OPENED THE FLOOR FOR NOMINATIONS TO FILL TWO THREE- YEAR TERMS ON THE PARK AND TREE COMMITTEE. CONCILMEMBER JONES NOMINATED DR. HOWARD WULFF AND MR. TOM ELLIS. THERE BEING NO OTHER NOMINATIONS, COUNCILMEMBER BISHOP MOVED TO CLOSE THE NOMINATIONS. SECONDED BY COUNCILMEMBER DUCK. COUNCILMEMBER DUCK MOVED TO APPOINT DR. WULFF AND MR. ELLIS. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. MAYOR NIX OPENED THE FLOOR FOR NOMINATIONS TO FILL TWO POSITIONS FOR A TWO-YEAR TERM ON THE HARBOR BOARD. COUNCILMEMBER JONES NOMINATED MR. DAVID CURTIS AND MR. RANDY SMITH. THERE BEING NO OTHER NOMINATIONS, COUNCILMEMBER FORD MOVED TO CLOSE THE NOMINATIONS. SECONDED BY COUNCILMEMBER DUCK COUNCILMEMBER BISHOP MOVED TO APPOINT MR. CURTIS AND MR. SMITH. SECONDED BY COUNCILMEMBER •PUCKETT, MOTION PASSED UNANIMOUSLY. MAYOR NIX STATED THAT HE HAD RECEIVED AN ATTORNEY GENERAL OPINION REGARDING THE EASTERN SHORE ART CENTER AND CHAMBER OF COMMERCE REQUEST TO PROHIBIT UNAUTHORIZED PARTICIPANTS IN THE OUTDOOR ART SHOW. THE MAYOR READ EXCERPTS FROM THE OPINION STATING THE PROHIBITING OF UNAUTHORIZED PARTICIPANTS IN THIS ANNUAL EVENT IS NOT PROTECTING THE CITY'S INTEREST, BUT IS PROTECTING THE SPONSORS' INTEREST.
