HomeMy WebLinkAbout12-27-1994 Regular Meeting1620 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Tuesday, 27 December 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 12 December regular session were duly approved. Mayor Nix awarded eleven certificates to the first Fair - hope Volunteer Firemen to spend 160 hours of classroom and field training to achieve the degree of "Certified Firefighter". Present were Chief Kevin Hempfleng, Lt. John Saraceno, Safety Officer Frank Boehm, Bill Benton, Greg Burroughs, Matt Creel, Ty Northrop, Joe Odom, and Steve Seay. Not present were Will Barnett, Tommy McDonald, and Magnolia Springs firefighter Charles Blake. The Eastern Shore Chamber of Commerce representatives failed to show up to present awards for the Christmas Parade floats. Council considered a petition to have the name of "Greeno Lane" changed to "Lloyd's Lane". After discussion, Councilman Bishop introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Duck, motion passed unanimously: RESOLUTION NO. 470-94 WHEREAS, a petition requesting a name change of a public way has been duly received by this body; and WHEREAS, an investigation reveals that all affected property owners, or their representatives, have signed said petition, showing their agreement of its request; NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the public way here- tofore known as "Greeno Lane" shall henceforth be known as "Lloyd's Lane" as per the petitioners' request. Nix, Mayor (�" City Clerk 27 December 1994 1621 Council discussed a Restaurant Liquor License application by Lydia Newman Myers, dba MINT JULEP'S, located at 422 South Section Street. This location was new to the Council and they were not sure where the restaurant will be located. Councilman Duck asked that the application be held up until the next regular session.* Councilman Ford moved to approve the request for a Restaurant Liquor License by Michael Vo, dba TWIN DRAGONS RESTAURANT, 18223 Scenic Highway 98. This application due to a change of ownership only. Mayor Nix advised that a letter opposing the license was received from Mr. A. G. Gottschall, 11 Magnolia Trace, stating the area was predominantly residential and he did not want any problems such a license might develop. Councilman Ford stated the restaurant is located next to his business office and there have been no problems under the prev- ious and current owners. Police also reported no trouble calls or complaints. There was police approval of the applicant. Motion to approve was seconded by Councilwoman Puckett, motion passed unanimously. * At this time, it was noted that applicant Lydia N. Myers had arrived. Council again considered her application for a Restaurant Liquor License when she explained MINT JULEP'S would be located in the new courtyard being developed by Bessie Mont- gomery, Town & Country clothing shop. Councilwoman Puckett moved to approve the application. There was police approval of the applicant. Seconded by Councilman Overstreet, motion passed unanimously. Mr. Al Beech, Director of Sales & Services, Teledyne Con- tinental Motors of Mobile, (TCM), was introduced by Ms. Sue Mason, chairman of the Airport Board. TCM is interested in leasing the airport and operating it as its Fixed Base Operator as stated in Section 5 of the FBO's minimum standards. After some discussion, Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 471-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to negotiate a Lease Agreement between the City and its Airport Board, and TELEDYNE CONTINENTAL MOTORS, 2000 Ninth Street, Mobile, Alabama 36601; allowing TCM to establish an aeronautical activity at the Fairhope Municipal Airport. Phillips, V ty Clerk 27 December 1994 1622 Councilman Bishop moved to reject all bids received on Gas Meters due to some information being left out of the requests for bids. The bid request will be sent out again asap. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix announced the recent lawsuit filed against the City by Walter Woodrow alleging illegal annexations and attempted voter dilution to prevent African -American representation on the City Council has been dismissed "with prejudice", which means it cannot be reentered.
