COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 24 October 1994.
Present were Mayor James P. Nix; Councilmembers John V. Duck,
Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton
Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 10 October 1994 regular session were
duly approved.
Council reviewed Ms. Denise Lores' request to place a
canopy over the entrance to Professional Health Care Services,
Inc., at 410 Fairhope Avenue. A sketch showed the supports
would leave room for passage along the sidewalks and were set -back
to not block parking in front of building. Councilman Ford moved
to approve the request. Seconded by Councilman Duck, motion
passed unanimously.
Councilman Bishop introduced in writing, and moved for
the adoption of, the following resolution. Seconded by Council-
woman Puckett, motion passed unanimously:
RESOLUTION NO. 464-94
WHEREAS, the owners of ROCK CREEK ESTATES, UNIT THREE, are
desirous of having streets and utilities located therein
accepted for maintenance by the City; and
WHEREAS, the Public Works Director of the City represents
that the physical improvements in the nature of streets,
drainage, and utilities have been installed in substantial
conformity with City requirements; and
WHEREAS, the City has received Engineer's Certified As -Built
Plans, test reports and lateral locations substantially as
required by Chapter 19, City Code of Ordinances; and
WHEREAS, the owners have provided to the City Clerk their
personal bond for maintenance of streets and utilities as
required by the City's codes and regulations; and
WHEREAS, the Rock Creek Estates Unit Three plat, having been
recorded in the Baldwin County Probate Records at Slide No.
1480-B/1481-A. delineates the streets therein as public ways;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRHOPE, ALABAMA, THAT the said streets and the utilities

(continuing Res. No. 464-94:)
within said Rock Creek Estates Unit Three be and the
same hereby are accepted for public maintenance sub-
ject to the bond posted. This resolution of acceptance
shall not obligate the City of Fairhope to maintain any
utility or drainage facilities outside the limits of
the right-of-way of the public streets, whether or not
such facilities may be located within dedicated easements.
ADOPTED THIS 24 DAY OF OCTOBER, 1994.

Councilman Duck introduced in writing, and moved for the
adoption of, the following resolution. Seconded by Councilman
Ford, motion passed unanimously:
RESOLUTION NO. 465-94
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following 1994 Holidays will be observed
by all City Personnel except emergency empooyees:
Veterans Day - Friday, November 11
Thanksgiving - Thursday & Friday
November 24 & 25
Christmas - Close at noon Friday
Close all day Monday
December 23 & 26
New Years Day - Monday, January 2

HOW
Mayor Nix advised that two'$ -year terms had expired on
the Board of Adjustments & Appeals, and opened the floor
for nominations. Councilman Overstreet nominated Joe Petties
and Claude Puckett for reappointment. There being no other
nominations, Councilman Bishop moved to close the nominations
and to reappoint Petties and Puckett by acclamation. Seconded
by Councilman Duck, motion carried by the following vote:
AYE -Duck, Ford, Bishop, Nix, and Overstreet. NAY -none.
ABSTAIN -Puckett.

White House TN; GIM Quality Truck Equipment, Birmingham;
Ingram Equipment, Birmingham; and Teco, Birmingham.
It is recommended to accept the low bid of $61,790.00, on
the Ford F800 Truck with "Ramer" Loader by Moyer Ford.

Councilwoman Puckett moved to accept the low bid by Moyer
Ford Sales, provided all specifications are met. Seconded
by Councilman Duck, motion passed unanimously.

It is recommended to accept the low bid meeting specifications
by Moyer Ford Sales at $63,638.00 on the Ford F800 with
"E-Z Pack" loader. --T. Kant --R. Avritt--W.Smith
Councilman Duck moved to accept the low bid by Moyer Ford,
provided all specifications are met. Seconded by Councilman
Bishop, motion passed unanimously.
Assistant Police Chief James Kinard reported that merchants
and restaurant owners were polled regarding Jubilee Music's
request to close certain areas downtown to vehicular traffic
on Saturday, December loth, from 6:30 pm to 9:00 pm, for
"Carols for Charity", and none of them are opposed. Council-
man Overstreet moved to approve the request so long as the
streets are not blocked any earlier than 6:30. Seconded by
Councilman Duck, motion passed unanimously.
Councilman Ford moved to hear the following items of business
not on the Agenda. Seconded by Councilwoman Puckett, motion
passed unanimously:
Engineer Ack Moore requested permission to advertise for
bids on changing out some sewer force main along Greeno Road
from Nichols to Morphy. This will be a city project, not
part of the highway project. After some discussion, Councilman
Bishop moved to approve the request. Seconded by Councilman
Duck, motion passed unanimously.
Mayor Nix reported that the Lift Station,offered for sale
by sealed bids at last meeting, sold this morning to Kevin
Boone for $10,300.00.
Councilman Ford introduced in writing, and moved for the
adoption of, the following resolution. Seconded by Council-
woman Puckett, motion passed unanimously:

RESOLUTION NO. �61 - 9 Y
WHEREAS, the City of Fairhope is implementing a housing rehabilitation program funded under
Community Development Block Grant No. LR-CM-RR-92-013, and
WHEREAS, the locally adopted program policy provides for waiver of grant ceilings or match
requirements where hardship conditions exist with approval of the City Council, and
WHEREAS, Debra Quaites applied for program participation and required extensive housing
improvements to meet minimum housing quality standards, thus causing the grant maximum to be
exceeded, and
WHEREAS, Debra Quaites demonstrated that she assumed the maximum debt that was made available
to her in order to make the needed repairs to her home.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairhope, Alabama as
follows:
Section I. That the grant ceiling of $9,000.00 be waived for Debra Quaites in order for $11,000.00 in
CDBG assistance to be authorized to match the $5,000.00 provided for privately to make needed
improvements to her home.
Section 2. That this resolution be made a part of the above referenced case file.
