STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Mondav, 10 October 1994.
Present were Mayor James P. Nix; Councilmembers John V.
Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and
Layton Overstreet; City Attorney Marion E. Wynne and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 26 September 1994 regular session
and of the 29 September 1994 special session were duly approved.
Councilman Bishop introduced in writing, and moved for
the adoption of, the following resolution. Seconded by Council-
man Duck, motion passed unanimously:
RESOLUTION NO. 462-94
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby
authorized to execute a contract between the CITY
and PROFESSIONAL PETROLEUM SERVICES, INC., 1119 Lucerne
Drive, Mobile, AL 36608. The City will purchase
Natural Gas from PPS, Inc.

Councilman Duck introduced in writing, and moved for
adoption of, the following resolution,. Seconded by
Councilman Overstreet, motion passed unanimously:

RESOLUTION NO. 463-94
BE IT RESOLVED by the Mayor and Council of the City of
Fairhope, Alabama, that the proposed Budget presented
and reviewed this loth day of October, 1994, be hereby
approved and adopted for FY 1994-1995; and
BE IT RESOLVED that the Annual Salaries of City Per-
sonnel shall be as shown on a list entitled "Annual
Salaries of All City Personnel - Resolution No. 463-94";
said list filed in the Office of the Mayor, of the City
Clerk, and of the Personnel Director; and
BE IT FURTHER RESOLVED that the Mayor be authorized to
enter into a contract with the Eastern Shore Chamber
of Commerce to promote the City of Fairhope. The con-
tract shall be for one (1) year, 1 October 1994 -
30 September 1995, but may be cancelled at any time.
Contract shall call for a payment to the Eastern Shore
Chamber of Commerce of $125.00 per month from the
General Fund and $125.00 per month from each of the
Utility Funds; or $6,000 for the one-year term.

Councilwoman Puckett moved to authorize the Water & Sewer
Department to sell a Gorman -Rupp T-3 Lift Station by sealed
bids, to be opened at 10:00 am, Monday, October 24th, with
a $10,000.00 minimum bid. Seconded by Counilman Overstreet,
motion passed unanimously.
Council discussed a request from Jubilee Music, Inc., to
close one block each on Fairhope Avenue, Church Street, and
DeLaMar Avenue, including the intersections of Fairhope &
Church, and of Church & DeLaMar, for the fourth annual
"Carols for Charity" event on Saturday, 10 December, from
6:30pm to 9:00 pm. The police department was asked to check
these areas and make a report before the Council takes action.

It is recommended to accept the low bid by McConnell
Automotive for a total of $54,495.00 --W. Smith, Purch Agt
Councilman Bishop moved to accept the low bid by McConnell
Automotive for the three trucks, provided all specifications
are met. Seconded by Councilman Ford, motion passed
unanimously.

It is recommended to accept the low bid, for both 89-Plus
Unleaded Gasoline and #2 Low Sulfer Diesel, from Fletcher

Councilman Duck moved to accept the low bids by Fletcher
Oil, provided all specifications are met. Seconded by
Councilman Ford, motion passed unanimously.
Mayor Nix opened the floor for nominations for a six -year
term on the Planning & Zoning Committee. Councilman Over-
street nominated Mrs. Debora Quinn for reappointment. There
being no other nominations, Councilman Duck moved to close

the nominations and reappoint Mrs. Quinn by acclamation.
Seconded by Councilman Bishop, motion passed unanimously.
Street Superintendent Tim Kant reported that approxi-
mently 53% of our citizens are participating in our
recycling program. So far this year, over One Million
Pounds of paper has been processed.
Fire Chief Kevin Hempfleng announced Fire Prevention
Week begins today. The volunteer firemen are visiting
area schools, giving fire safety tips.
Councilman Overstreet moved to pay bills as presented.
Seconded by Councilman Duck, motion passed unanimously.
Meeting was duly adjourned at 5:45 pm.
