STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 22 August 1994.
Present were Mayor James P. Nix; Councilmembers John V.
Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and
Layton Overstreet; City Attorney Marion E. Wynne and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 8 August 1994 regular session
were duly approved.
Council considered an application for a Club Liquor
License by William Paul Cadenhead, dba SNEAKERS, located on
County Road 32 next to Odom's Car Sales. Proof of Publication
was presented and there was police approval of the applicant.
A group of people was present to oppose the license. The
Pastor of the First Pentacostal Church advised that they
owned seven acres across the road from Mr. Cadenhead's
proposed Club, and they did not want this type of establish-
ment next door to their church. Citizens who live in a
mobile home park on Lee Circle were also present to oppose
the license because of noise, traffic, and drunk drivers.
Mr. Cadenhead said he would not open up on Sundays and would
put up a privacy fence. He also said he planned to have a live
band on Friday and Saturday nights. Councilman Bishop moved
to deny the application. Seconded by Councilwoman Puckett,
motion passed unanimously.
Council discussed renewing the Boatyard Lease as requested
by Eastern Shore Marine, Inc. The term would be for another
ten years, to 31 August 2004. Councilman Duck moved to renew
the lease. Seconded by Councilman Overstreet, motion passed
unanimously.

Councilman Bishop moved to accept the low bid by Baldwin Pole
and Piling Company, at $4,540.00 total cost, provided all speci-
fications are met. Seconded by Councilman Ford, motion passed
unanimously.

Councilwoman Puckett moved to accept the low bids of $58.55
on 3000# mix and $62.47 on 4000# mix by Reynolds Brothers.
Seconded by Councilman Duck, motion passed unanimously.

Councilman Ford moved to hear the following business not
on the Agenda. Seconded by Councilman Duck, motion passed
unanimously:
The Mayor advised that the US Treasury Department requests
that recipients of forfeited assets (through participation in
drug cases) sign a Federal Equitable Sharing Program Agreement.
The Agreement sets out how the assets are obtained, and how
the assets are to be used. Councilman Duck moved to autho-
rize the Mayor to sign the Agreement. Seconded by Councilman
Ford, motion passed unanimously.
A lady representing the Baha'i Faith presented each of the
councilmembers with a copy of The Promise of World Peace.
Tim Kant, Public Works Superintendent, advised Council of
several new requirements by State Agencies which will result
in our building a canopy over the garbage transfer station and
chute.
Garbage will be picked up as usual on Labor Day, trash and
recycling routes will be run one day late.
There being no further business, meeting was duly adjourned
at 5:55 pm.
