STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 8 August 1994.
Present were Councilmembers John V. Duck, Michael A. Ford,
David E. Bishop, Jeanette Puckett, and Layton Overstreet; City
Attorney Marion E. Wynne and City Clerk Evelyn P. Phillips.
Mayor James P. Nix was absent.
Mayor Pro Temp John V. Duck presided in the absence of
Mayor Nix.
There being a quorum present, Mayor Pro Temp Duck called
the meeting to order. MPT Duck advised that the father of
Mayor Nix's wife, Anne, had passed away unexpectedly the prev-
ious day. The Mayor and his wife are in North Carolina with
her family. MPT Duck asked the Council and audience to join
him in a moment of silent prayer for Anne and family.
Minutes of the 25 July 1994 regular session were
duly approved.
Council reviewed a Package Store Liquor License application
by James G. Frichter, dba THE TOBACCO SHACK located in the
Eastern Shore Plaza shopping center on US 98. No one present
was opposed to the license. Advertising was done. There was
police approval of the applicant. After discussion, Council-
man Overstreet moved to approve the issuance of the license.
Seconded by Councilman Ford, motion passed unanimously.
Michelle Janasek, public relations director, for the
Fairhopers Community Park Group, asked for permission to close
Satsuma Street, between Pier & Pecan Avenues, on Thursday,
25 August 1994, from 5:30 - 8:30 pm, to hold a fund-raising
event. She reported the residents have been contacted and
have no objection, and ingress and egress will be possible.
The Group has also gotten police approval. No alcoholic
beverages will be served. After discussion, Councilman Bishop
moved to approve the request. Seconded by Councilman Ford,
motion passed unanimously.
Council discussed a written request from Thomas Hospital
to hold an employee picnic & volleyball tournament on the North
end of the Beach which would be closed to the public, on
Saturday, 10 September 1994, from 10:00 am to 4:00 pm. Concern
about setting a precedent,which will probably be followed by
many similar requests, was expressed by Councilman Bishop.

Councilman Ford felt the North Beach should not be closed due
to heavy year-round public usage. The British Car Club event
was discussed, the North Beach was closed for that but only
to vehicular traffic. After discussion, Councilman Bishop moved
to have the Mayor write a letter to Thomas Hospital and advise
the North Beach cannot be closed to the public, but it is
available on a First Come -First Served basis as usual; also
the South Beach could be closed for them if they so desire.
Seconded by Councilwoman Puckett, motion pass unanimously.
Attorney James (Jim) Smith, representing the Medical Clinic
Board East, sent a written request that the following Board
Members be re -appointed, each to a six -year term:
Thad Ingram
Charles Langham
John T. Jones
Councilman Overstreet placed these names in nomination. There
being no other nominations, Councilwoman Puckett moved to close
the nominations and re -appoint the members as requested.
Seconded by Councilman Bishop, motion passed unanimously.
Eastern Shore Marine, Inc., advised by hand -delivered
written letter, that they would like to exercise their option
to renew the "Boatyard" lease dated 24 August 1984. After
some discussion, Councilman Ford moved to take the request under
advisement, due to his and other members of the Council not
having had time to fully study the lease, and make a decision
at the next regular meeting. Seconded by Councilwoman Puckett,
motion passed unanimously.
The purchasing department reported that they had requested
bids from four contractors, Asplundh Tree Company of Saginaw,
AL; Gary Ickes Tree Service of Silverhill, AL; H&H Tree Service
of Gadsden, AL; and Big John's Tree Service of Fairhope; for
bids to clear brush, limbs, and trees from the City rights -
of -way for the Electrical Department. Only one contractor
responded, Asplundh Tree Company bid $27.50/hour for labor and
$9.50/hour for equipment rent. It was recommended to accept
this bid. Councilwoman Puckett introduced in writing, and moved
for the adoption of, the following resolution. Seconded by
Councilman Overstreet, motion passed unanimously:
RESOLUTION NO. 458-94
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That Mayor James P. Nix is hereby authorized to exe-
cute a contract with ASPLUNDH TREE EXPERT COMPANY of Saginaw,
AL, for clearing all City rights -of -way under direction of the
Electrical Department; at a rate of $27.50/hour for labor and
$9.50/hour for equipment rent.
ADOPTED THIS 8TH DAY OF AUGUST, 1994.

Councilman Overstreet moved to pay bills as presented.
Seconded by Councilwoman Puckett, motion passed unanimously.
There being no further business, meeting was duly
adjourned at 6:42 pm.
