HomeMy WebLinkAbout07-25-1994 Regular Meeting1586 STATE OF ALABAMA COUNTY OF BALDWIN 4 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 25 July 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 11 July 1994 regular session were duly approved with the following request by Councilwoman Puckett: *** Councilwoman Puckett stated she meant to include an autho- rization resolution for the Mayor to execute a contract with an engineering consultant on the FAA grant business brought up at the 11 July 1994 regular session. Councilwoman Puckett then introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 456-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE that Mayor James P. Nix is hereby authorized to execute a contract for professional services between the City and BARGE, WAGGONER, SUMNER, AND CANNON, as consulting engineers, on the FAA Grant Project for the Fairhope Airport Board. ADOPTED THIS 25TH DAY OF JULY, 1994. _A-/ At,test Ja es P. Nix, Mayor City Jerk Councilman Ford introduced in writing, and moved for the adoption of, the following resolution. Seconded by Council- man Duck, motion passed unanimously: 25 July 1994 1587 RESOLUTION NO. 457-94 WHEREAS, the City of Fairhope is concerned about retaining a quality lifestyle for its citizens and visitors; and WHEREAS, the retention of greenbelts and pedestrian ways for aesthetic quality and recreational use is desirous and deemed in the best interest of the City; and WHEREAS, the widening of US Highway 98 (Greeno Road) has resulted in additional right-of-way, and has created a severe need for a pedestrian way for some of the section between Fairhope Park and the new Fairhope High School; and WHEREAS, said pedestrian -way, if landscaped and provided with appropriate lighting and benches, will provide a means for access to recreation, shopping, and the aesthetic quality of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, as follows: Section 1. That the City of Fairhope make application to the Alabama Department of Transportation for a grant made available under the Intermodal Surface Transportation Efficiency Act for up to $300, 000.00 for the development of a pedestrian way along the recently widened US Highway 98 (Greeno Road). Section 2. That the City of Fairhope hereby commits local match in cash or in -kind services of 20%. Section 3. That James P. Nix, in his capacity as Mayor is hereby authorized and directed to execute all required documents relating to the application and grant awards process. Phillips, Cit6 Clerk Councilman Bishop moved for final adoption of Ordinance No. 962, an ordinance introduced in writing at the last reg- ular meeting, amending the City Code by increasing the issu- ance fee and the non-compliance penalty on Business Licenses to $5.00 and $500.00. Seconded by Councilman Ford, motion passed unanimously. 25 July 1994 1588 Councilman Overstreet moved to authorize the Mayor to execute a 99-year lease with the Fairhope Single Tax Cor- poration on the property at 10 North Summit Street, the "old Library Building". Seconded by Councilman Bishop, motion passed unanimously. Departmental Projects Reports: Water & Sewer Superintendent Mike Rejczyk reported the Side Stream Storage Tank job has been delayed, due to the two -week rain, but is about 30% complete. The Drying Beds job is on schedule, foundations begun this week. The relocation of utilities on the US 98 widening job has been affected by the rains. The water lines are now about 85% complete, and the sewer lines are about 98% complete. Gas Department Superintendent Steve Seay reported the re- location of the gas lines on the US 98 job is on schedule. Electric Department Superintendent Aaron Norris was absent due to family illness. Mayor Nix gave his report, stating that the old power lines have all been transferred on the US 98 job, and the new lines are in service. The Welcome Center sent a report stating, since opening on 3 October 1993, some 41,139 persons have signed the guest register. All 50 States, the District of Colombia, and 39 foreign countries are listed. Of the 50 States, Alabama leads, with 156 towns, Illinois is next, with 119 towns, and Florida has 99 towns. Under Old Business, Mayor Nix advised that he had been con- tacted by the State ABC Board concerning the Beer On/Off Premises License application by Harold Bracy at 19616 Young Street which the Council considered in regular session on 27 June 1994. At that meeting, no one made a motion to approve or to disapprove the application. The ABC Board requested a reconsideration of this application with a concluding recommendation of approval or disapproval. After some discussion, Councilwoman Puckett moved to disapprove the application. Seconded by Councilman Duck, motion passed unanimously. Meeting was duly adjourned at 5:45 pm. Jam s P.
