HomeMy WebLinkAbout06-13-1994 Regular Meeting1568 STATE OF ALABAMA 0 COUNTY.,OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 13 June 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 25 May 1994 regular session were duly approved. Council reveiwed an application for a Beer On/Off Premises License by Harold I. Bracy, dba HAROLD'S, at 19616 Young Street. No one present was against the license. Mr. Bracy was not present. There was a "Not Approved" by the police on the appli- cation, however, Chief Anderson was present and said the questions he had had been satisfactorily resolved. A question came up about whether a license was denied in the past for this location. After some discussion, Councilman Overstreet moved to hold the application over until the next regular session. Seconded by Councilwoman Puckett, motion passed unanimously. Council reviewed an application for a Beer On/Off license and a Wine On/Off license by Donna L. Becker, dba JUS' GUMBO, INC., 2 South Church Street. No one present was opposed to the licenses. There was police approval of the applicant. Councilman Ford moved to approve the application. Seconded by Councilman Overstreet, motion passed unanimously. Councilman Bishop introduced in writing, and moved for the approval of, the following resolution. Seconded by Councilman Duck, motion passed unanimously: (Res. No. 453-94 on the following page.....) 13 June 1994 1569 RESOLUTION NO. 4,s-,3 - 9 WHEREAS, the Owners of River Oaks S/D Unit One are desirous of having streets and utilities located therein accepted for maintenance by the City Council, and; WHEREAS, the General Superintendent of the City represents that the physical improvements in the nature of streets, drainage and utilities have been installed in substantial conformity with City requirements, and; WHEREAS, the City has received Engineer's Certified As - built Plans, test reports and lateral locations substantially as required by Chapter 19 of the Code of Ordinances, and; WHEREAS, the owners have provided to the City Clerk their personal bond for maintenance of streets and utilities as required by the City's codes and regulations, and; WHEREAS, the River Oaks Unit One Plat having been recorded in the Probate Records of Baldwin County, Alabama at Slide No. W6-cs-A1) delineates the streets therein as public ways; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the said streets and the utilities within said River Oaks S/D Unit One be and the same hereby are accepted for public maintenance subject to the bond posted. This resolution of acceptance shall not obligate the City of Fairhope to maintain any utility or drainage facilities outside the limits of the right-of-way of the public street, whether or not such may be located within dedi ated easements. Dortch, C. Mitchell, C. Tucker, R. Sanders, E. Bright, J. Hobbs, J. Overbea, and L. Perine as per their petitions. In order to take immediate action, Council- woman Puckett moved to suspend the rules. Seconded by Councilman Bishop, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 960. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE - Duck, Ford, Bishop, Nix, Puckett, and Overstreet. /Vqy_ 1V0,v8. Seconded by Councilwoman Puckett, motion passed unanimously. 13 June 1994 1575 Police Chief Anderson came before the Council with a request that the Beach be closed to vehicular traffic at 8:30 pm Saturday and Sunday nights during the summer. He reported there is a lot of vandalism and complaints aboutovernight weekend visitors. After discussion, Councilman Duck moved to approve the request. Seconded by Councilman Ford, motion passed unanimously. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Duck, motion passed unanimously.
