HomeMy WebLinkAbout05-25-1994 Regular Meeting1563 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 25 May 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 9 May 1994 regular session were duly approved. Councilman Bishop introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Overstreet, motion passed unanimously: RESOLUTION NO. 450-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to execute an extension of Contract No. 89-00-1501-738 between the City and the US DEPARTMENT OF ENERGY, SOUTHEASTERN POWER ADMINISTRATION, from 1 June 1994 to 30 November 1994, all terms and conditions to remain the same. Seconded by Council- woman Puckett, motion passed unanimously: RESOLUTION NO. 451-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to execute a contract between the City and the BOYS & GIRLS CLUB OF GREATER MOBILE, INC., by which the City will pay a total of $19,600 in three monthly installments, first payment on 1 June 1994, for the operation of the Fairhope Unit of the Baldwin County Boys and Girls Club. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 452-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to execute the necessary paperwork to finalize a loan between the City and SOUTHTRUST BANK OF BALDWIN COUNTY in principal amount of $200,000.00; to be repaid in five annual payments, at an annual interest rate of 3.5%. This debt to be a General Obligation of the City of Fairhope, and the funds are to be used for the City's share of the construction costs of CENTENNIAL HALL. ADOPTED THIS 25TH DAY OF MAY, 1994. s P. Nix, Mayor Mayor Nix opened the floor for nominations to the Parking Authority. This appointment is to complete the term (to January, 1995) of the late Jack Lucey. Councilwoman Puckett nominated Prissy Wilkins. There being no other nominations, Councilman Overstreet moved to close the nominations and appoint Ms. Wilkins by acclamation. Seconded by Councilman Bishop, motion passed unanimously. Councilman Bishop moved to reappoint Elouise Benford for another five-year term on the Library Board. Seconded by Counciman Ford, motion passed unanimously. Council took the following action on bids: FOR TURNOUT GEAR USED BY VOLUNTEER FIREMEN: (see tabulation of bids on following pages) Councilwoman Puckett moved to accept the bid by Sunbelt Fire Equipment as recommended, provided all specifications are met. N U-1 Uri 25 May 1994 1567 Council reviewed the Restaurant Liquor License application by Jimmy T. Barkley, Jr., dba the IN SEASON RESTAURANT, at 205 Fairhope Avenue, which was held over from the previous regular session. Mr. Barkley informed the Council that he would have no outside music, operating hours would close at 9:30 pm, Monday through Thursday, and 10:30 pm on the week- end. The garbage would be contained in a shed with five - days -per -week pickup. There was police approval of the applicant. A neighbor, Mr. Privitt, presented a petition with 17 names of neighboring residents who did not wish the license to be approved. After some discussion, Councilwoman Puckett moved to deny approval of the license. Seconded by Councilman Overstreet, motion passed unanimously. Councilman Bishop introduced ORDINANCE NO. 959 in writing, an ordinance to annex the property of Robert J. Bousson at 23360 Main Street in the Village of Montrose. In order to take immediate action, Councilman Overstreet moved to suspend the rules. Seconded by Councilman Duck, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Bishop then moved for final adoption of ORDINANCE NO. 959. Seconded by Councilman Duck, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Michael A. Ford was recently named a Paul Harris Fellow by the Fairhope Rotary Club; and was awarded the Saint Ignatius Award by Spring Hill College for being the Outstanding Mobile Area Alumnus.
