HomeMy WebLinkAbout04-25-1994 Regular Meeting1552 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 25 April 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 11 April 1994 regular session were duly approved. Ms. Vivian Sisco addressed the Council on the subject of the next Centennial Celebration event --"Celebrate the Bay" -- scheduled for Saturday, May 28th, from 7:00 am to 11:00 pm. There will be games, tournaments, fishing, swimming, aerobics, hot air balloon rides, live music, Miss Fairhope Centennial Beauty Contest, Shakespeare -In -The -Park, a seafood feast, and a sunset street dance and concert. Ms. Sisco requested approval of the following three items: (1) No beach admission charge, (2) No traffic in park area (by placing barricades at top of hill on Fairhope Avenue),and (3) permission to play music to 11:00 pm. After much discussion, Councilman Bishop moved to approve all three requests provided (1) passes be given to those boat owners berthed at the --Pier Marina for access and parking at Oval, (2) passes be given to handicapped for access to Oval, (3) some responsible person be present to have the music turned down after 10:00 pm A requested, and (4) traffic arrangements be co-ordi- nated with Police and Volunteer Firemen. Seconded by Councilman Overstreet, motion passed unanimously. Councilman Overstreet had a written request from Value Auto Parts Company, Fairhope Laundry, and Shutts Seafood Store on Fairhope Avenue requesting the 2-hour parking signs in front of their locations be changed to 15-minute parking. Councilman Overstreet said he, Councilman Ford, and Supt. Rutherford met and discussed the request, visited the area, and it is their recommendation that the request be denied due to the inability to enforce the shorter time limit and they also felt the change would not be in the best interest of the public. Councilman Overstreet made the motion to deny the request. Seconded by Councilwoman Puckett, motion passed unanimously. 25 April 1994 1553 Council discussed the ordinance requested from the City Attorney at the last regular session pertaining to the re- quirements needed to handle the debris being generated on the many building sites in town. Attorney Wynne had prepared the ordinance and Councilman Duck introduced it. Final consideration will be given the ordinance at the next regular session. Councilman Bishop introduced Ordinance No. 957, an ordi- nance providing for the continuity of existing uses on US 98 (Greeno Road) abutting Alabama Department of Transportation Project No. DE-0019(802), and within the corporate limits of the City. In order to take immediate action, Councilman Duck moved to suspend the rules. Seconded by Councilman Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Council- woman Puckett then moved for final adoption of Ordinance No. 957. Seconded by Councilman Overstreet, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Overstreet introduced in writing, and moved for the adoption of, the following resolution. Seconded by Council- man Duck, motion passed unanimously: PROCEDURE FOR HOLDING SPECIAL MEETINGS OF THE CITY COUNCIL RESOLUTION NO. 447-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: 1. Special meetings may be held at the call of the Mayor, or at the call of any two councilmembers, by serving notice on each member of the Council not less than forty-eight hours before the time set for such special meeting. 2. Said notice is also to be posted on the doors of the Muni- ciple Complex for the same forty-eight hour period. 3. Those members of the media who regularly attend our Council Meetings will also be given the same forty-eight hour notice; any members of the media who do not regularly attend meetings will be given notice if notice is requested. 4. "Notice" may be written or oral; delivered by mail, hand, tele- phone, computer, or facsimile machine. 5. Any special meeting called with less than a forty-eight hour notice will be due to an emergency situation, and the media will be notified at the same time each member is notified. ADOPTED THIS 25TH DAY(OF APRIL, 1994. Attest _ Jam s P. Nix, Mayor 25 April 1994 1554 The floor was opened for nominations for a five-year term on the Library Board. Councilman Duck nominated Mr. Earl Hilliard. There being no other nominations, Councilwoman Puckett moved to close the nominations and appoint Mr. Hilliard by acclamation. Seconded by Councilman Overstreet, motion passed unanimously. Council took the following action on bids: 1994 STREET RESURFACING Vendor Acme Asphalt Co Cost Delivery Mobile $67,234.97 10 days Mobile Asphalt Co Saraland $64,429.15 5 days Temco, Inc., Mobile, Walton & Company, Mobile, made no response. HO Weaver & Sons, Mobile, American Asphalt Maintenance Company, Daphne, made no bid. It is recommended to accept the low bid by Mobile Asphalt Company of Saraland at $64,429.15.--T.Kant--W.Smith Streets Purch Agt Councilwoman Puckett moved to accept the low bid by Mobile Asphalt Company, provided all specifications are met. Seconded by Councilman Bishop, motion passed unanimously. Mayor Nix mentioned that the utility electronic transfer payment system is now ready. Anyone interested may drop by City Hall and sign up. Mrs. Nancy Hall, President of Fairhope First, asked if the Council Agenda could be printed in the newspaper before Council meetings. She was advised that Agendas are available at City Hall each Friday afternoon at 4:00 pm preceding the 2nd and 4th Monday of each month. Mrs. Hall also asked the Council to take a stand opposing certain developments along Highway 225. She was advised that the Council will consider it given the proper information and having the question placed on the Agenda for action prior to the meeting.
