STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 11 April 1994.
Present were Mayor James P. Nix; Councilmembers John V. Duck,
Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton
Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 28 March 1994 regular session
were duly approved.
Council reviewed an application for a Club Liquor License
by Peggy Cahill, dba THE YUCATAN CANTINA, 311 Fairhope Avenue.
No one present was opposed to the license. There was proof
of publication. The police approved the applicant. After
discussion, Councilman Ford moved to approve the license.
Seconded by Councilman Duck, motion passed unanimously.
Councilman Duck introduced in writing, and moved for the
adoption of, the following resolution. Seconded by Council-
man Bishop, motion passed unanimously:

RESOLUTION NO. - /
WHEREAS, the Owners of Rock Creek Estate Unit Two
are desirous of having streets and utilities located
therein accepted for maintenance by the City Council, and;
WHEREAS, the General Superintendent of the City represents
that the physical improvements in the nature of streets,
drainage and utilities have been installed in substantial
conformity with City requirements, and;
WHEREAS, the City has received Engineer's Certified As -
built Plans, test reports and lateral locations
substantially as required by Chapter 19 of the Code of
Ordinances, and;
WHEREAS, the owners have provided to the City Clerk their
Personal bond for maintenance of streets and utilities as
required by the City's codes and regulations, and;
WHEREAS, the Rock Creek Estates Unit Two having been
recorded in the Probate Records of Baldwin County, Alabama
at Slide No. delineates the streets therein as
public ways;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the said streets and the
utilities within said Rock Creek Estates Unit Two be and
the same hereby are accepted for public maintenance
subject to the bond posted. This resolution of acceptance
shall not obligate the City of Fairhope to maintain any
utility or drainage facilities outside the limits of the
right-of-way of the public street, whether or not such may
be located within dedicated easements.

It is suggested to accept the low bid of Beard Equipment Co.
for $8,372.00 which is on the State Bid Contract.--W.Smith
--P. Rutherford, Gen. Supt. Purch. Agt.
Councilwoman Puckett moved to accept the low bid by Beard
Equipment Company, provided all specifications are met,and
that the Recreation Improvements Fund be used to purchase
the mower. Seconded by Councilman Ford, motion passed
unanimously.
Councilman Ford was pleased to announce that, largely due
to the efforts of Recreation Board member Bob Callahan and
Recreation Director Eddie Boyette, Fairhope will host a
national soccer tourney on November 21, 22, and 23, 1994.
Council reviewed a bid report on a stock of 6" PVC pipe
for the Water & Sewer Department. It was noticed that some
of the bids were qualified by stating "truck load lots only."
Councilman Bishop moved to reject all bids and offer the pipe
again, with the specifications stating "any quanity" so all
bids will be on the same level. Seconded by Councilwoman
Puckett, motion passed unanimously.
Councilman Duck moved to authorize the Mayor to apply for
a State Department of Transportation grant to build sidewalks
along US 98 (Greeno Road). The grant is an 807o/20%, with the
City's 207o payable by in -kind services. Seconded by Council-
man Ford, motion passed unanimously.
Councilman Duck reported that his committee (Councilman
Ford and Supt. Tim Kant) had looked into the building -sites

trash situation as requested. They offered the following
suggestions for conserving our landfill space for our
citizens: (a) Builders of single-family dwellings would
be required to haul site trash to Magnolia Landfill , and
(b) Builders of multi -family dwellings would be required
to place a bin or larger holder on site for collection of site
trash before their hauling it to the Magnolia Landfill.
City Attorney Wynne was asked to prepare an ordinance setting
out these new requirements.
Councilman Overstreet moved to pay bills as presented.
Seconded by Councilwoman Puckett, motion passed unanimously.
Mr. Charles Leedecker of Hersey, PA, and 511 Lillian
Circle, asked to address the Council. Mr. Leedecker explained
he had spent many years on the planning & zoning commission
of Hersey, PA, and he would like to make some suggestions
that will help Fairhope, his winter home:
1. Begin now to purchase land for the construction of a
By -Pass around the city.
2. Adopt a policy of public bond sales, even though this is
not required. (Mr. Leedecker was told that all bonds are
by public sale.)
3. Adopt a policy of not providing sewer services outside
the city limits. (Mr. Leedecker was told anyone can hook
on to our system, by law, provided they can pay for running
the lines, tap fees, and so on; also, outside customers
pay higher fees and rates.)
Ms. Sheila Propp, reporter for the FAIRHOPE COURIER, asked
that a copy of the City's annual audit be made available as
a "loaner" if copies can not be given to everyone. It was
explained that the audit was very expensive to reproduce,
therefore copies cannot be given away to all. Ms. Propp also
asked if time could be allotted for questions from the press
at the end of each meeting before adjournment. She was re-
minded that the Mayor, the City Clerk, and councilmembers are
available after the meeting .
Meeting was duly adjourned at 5:56 pm.
