STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 28 March 1994.
Present were Mayor James P. Nix; Councilmembers John
V. Duck, Michael A. Ford, Jeanette Puckett, and Layton
Overstreet; City Attorney Marion E. Wynne and City Clerk
Evelyn P. Phillips. Councilman David E. Bishop was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 7 March 1994 regular session
were duly approved.
A public hearing was held as advertised on the rezoning
request by Floyd & Deidre Shepard of 606 South Ingleside,
to change a one -acre parcel on the west side of South
Ingleside between Middle Street and Twin Beech Road from
R1 Residential to R6 Mobile Home Park, No one present was
opposed to the rezoning. The Planning & Zoning Commission
recommends approval of the request. After discussion,
Councilman Duck introduced Ordinance No. 956 in writing,
an ordinance to rezone the property as requested. In order
to take immediate action, Councilman Duck moved to suspend
the rules. Seconded by Councilwoman Puckett, motion to
suspend passed unanimously by the following vote: AYE -
Duck, Ford, Nix, Puckett, and Overstreet. NAY -none.
Councilman Duck then moved for final adoption of Ordinance
No. 956. Seconded by Councilman Overstreet, motion passed
unanimously by the following vote: AYE -Duck, Ford, Nix,
Puckett, and Overstreet. NAY -none.
Councilman Overstreet introduced in writing, and moved
for the adoption of, the following resolution. Seconded
by Councilman Ford, motion passed unanimously:

RESOLUTION NO. 444-94
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor James P. Nix is hereby authorized to
execute a contract between the City and ADVANCED TANK AND
CONSTRUCTION COMPANY of Pell City, Alabama, in the amount
of $365,000.00 for a poured -in -place Two Million Gallion
Stormwater Storage Tank, to be constructed as per the speci-
fications of, and under the supervision of, Volkert & Associates,
Inc., as the City's engineering consultant.
ADOPTED THIS 28TH DAY OF MARCH, 1994.

Councilwoman Puckett introduced in writing, and moved
for the adoption of, the following resolution. Seconded
by Councilman Overstreet, motion passed unanimously:
RESOLUTION NO. 445-94
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that Mayor James P. Nix is hereby authorized to
execute a contract between the City and BRUNSON-NICHOLS
CONSTRUCTION COMPANY of Andalusia, Alabama, for the construction
of a pump station wet well, as per the specifications of, and
under the supervision of, Moore Engineering Company, as the
City's engineering consultant, in the amount of $56,000.00.

Council reviewed an application for a Club Liquor License
by Neil Liechty, dba THE HOMESTEAD GRAND VICTORIAN RESTAURANT,
924 Plantation Boulevard. Application notice was advertised
as required. No one present was opposed to the license.
There was police approval of the applicant. Councilman
Ford moved to approve the license. Seconded by Councilman
Duck, motion passed unanimously.
Councilman Ford moved to approve up the $3,000.00 expense
money for five or six volunteer firemen to attend Fire College.
Seconded by Councilman Overstreet, motion passed unanimously.
Councilman Duck moved to authorize the writing off of
$16,442.00 uncollectible utility accounts for the year
1990-1991. Seconded by Councilwoman Puckett, motion
passed unanimously.
Councilman Ford, representing the Recreation Board,
presented a request for a 4-Wheel Vehicle with dump attachment
and a Frontend Mower. The cost for both is estimated to
be $15,000.00. After discussion, Councilman Overstreet
moved to authorize the Board to request bids on this equip-
ment. Seconded by Councilman Ford, motion passed unanimously.
Council took the following action on bids:

It is suggested to accept the low bid of MAGNOLIA ELECTRIC, INC., Fairhope,
Alabama.
The largest amount of PVC Conduit used by the City is 2-1/2 inch and 3 inch,
This would make Magnolia Electric the low bidder. They will keep PVC in stock for
the City if they receive the bid. This will eliminate the City having to •warehouse
PVC Conduit.
All specifications have been met by Magnolia Electric.

Councilman Ford moved to accept the low bid by Magnolia
Electric, Inc., provided all specifications are met. Seconded
by Councilman Duck, motion passed unanimously.
Councilwoman Puckett moved to accept the 1992-1993
Audit as prepared and presented by Hartmann, Blackmon, and
Kilgore, P.C. Seconded by Councilman Duck, motion passed
unanimously.

Billing Superintendent James Gillespie advised the Council
that he, our computer programmer, and Compass Bank are working
on an Electronic Transfer Utility Bill Payment System. After
discussion, Councilman Overstreet moved to authorize this
system, with the City absorbing the minimal service charges.
Seconded by Councilman Duck, the motion passed by the following
vote: AYE -Duck, Nix, Puckett, and Overstreet. NAY -none.
ABSTAIN -Ford.
Mayor Nix made a statement concerning Political Signs.
He reminded the public that no signs are allowed on public property
or public rights -of -way, and no signs are to be placed until
30 days before any election. He asked the media to publicize
this because any political signs in violation of these
ordinances will be removed by city personnel. The Mayor
asked that all politicians cooperate to avoid getting upset
during the upcoming campaigns.
Supt. Tim Kant advised that all the construction around
town is rapidly filling up the landfill with building debris.
He requested that a committee be appointed to determine
what can be done to stem the flow. Mayor Nix appointed
Councilmembers Duck (chairman) and Ford to work with Supt.
Kant on this matter and report to Council their findings.
Councilwoman Puckett moved to hear the following business
not on the Agenda. Seconded by Councilman Ford, motion
passed unanimously:
On 21 December 1993, Council accepted a low bid from
Steber Chevrolet for two police cars with a natural gas
fuel system installed. They have now been advised that
the cars cannot be manufactured with this system installed.
Steber requests that they be allowed to fulfill the order
with cars having a standard gas system as they were also
the low bidder on this. Councilman Duck moved to authorize
the change. Seconded by Councilman Ford, motion passed
unanimously.
The City Team, led by Councilman Ford, captured the
First Runner -Up trophy at the Egg -Olympics last weekend
during the Centennial Celebration's Spring Fling festivities.
The Fairhope Courier team took First Prize.
The Council and the Planning & Zoning Commission are
to meet informally to discuss how best to protect the quality
of life in Fairhope in the face of the current unusual rate
of growth. The meeting should be as early as next week.
Meeting was duly adjourned at 6:12 pm.
