HomeMy WebLinkAbout02-28-1994 Regular Meeting1531 STATE OF ALABAMA 0 COUNTY OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 28 February 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 14 February 1994 regular session were duly approved. Baldwin County Commissioner Wendy Allen presented a check to the City for $4,168.48, our share of the Gas & Oil Severance Tax. Ms. Allen also -advised that the County has approved certain county roads for resurfacing, including County Road 27. Council reviewed a request by Mr. Arthur E. Draper for per- mission to construct a set of steps on city property -- from the top of the bluff at 617A North Mobile Street down to the beach. Mr. Draper submitted a drawing and a list of materials to be used. After discussion, Councilwoman Puckett moved to approve the request. Seconded by Councilman Bishop, motion passed unanimously. It has become necessary to trade a small wedge of city property at the Golf Course for a small wedge belonging to Do -teen, Inc. City property measures 2712.78 sq ft and the Do-Leen property is 2452.93 sq ft. Exchanging these small parcels will obviate moving a cart path near Hole No. 2. Councilman Overstreet moved to authorize the Mayor to execute the Deed of Exchange with Do-Leen, Inc. Seconded by Councilman Ford, motion passed unanimously. A Declaration of Vacation of a utility easement was presented by the Fairhope Single Tax Corporation and their leaseholders on Lots 16, 15A and 15B, Pecan Trace Subdivision. After discussion, Councilman Ford introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilman Duck, motion passed unanimously: (Res. No. 440-94 on next page....) 28 February 1994 1532 RESOLUTION NO. 440-94 WHEREAS, there exists upon Lots 16, 15A, and 15B of Pecan Trace Subdivision of lands of the Fairhope Single Tax Corporation (Slide 1323-A, Baldwin County Probate Records) a certain drainage and utility easement, 20 feet in width; and WHEREAS, said easement is ten feet wide on the north side of Lot 16 and ten feet wide on the south side of Lots 15A and 15B; and WHEREAS, the Owners of the Lands and of the Leasehold Interest therein have petitioned the City of Fairhope to assent to vacation of the said easement; and WHEREAS, there is no public need for or public purpose to be served by the continuance of said easement; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the City's assent be and hereby is granted for filing for record the said Declaration of Vacation of the said easement as provided by law. Nix, Mayor City C1 rk Councilwoman Puckett moved to reschedule the next regular Council meeting from March 14 back to March 7 due to several members planning to attend the National League of Cities con- vention in Washington, D.C., from March 12 to 16. Seconded by Councilman Overstreet, motion passed unanimously. Meeting will be at same time and place, in the Council Chamber at 5:30 pm. Councilman Duck moved to proclaim the 6th of March, 1994, as Leon Lett Day in the City of Fairhope. Mr. Lett is a local football player who is now playing for the National NFL Champs, the Dallas Cowboys. Seconded by Councilman Overstreet, motion passed unanimously. Council took the following action on bids on sixty fiberglass utility poles for use in subdivisions by the electric department: 28 February 1994 1533 CITY OF FAIRHOPE P.O. Seconded by Councilman Duck, motion passed unanimously. 28 February 1994 1534 Street Superintendent Tim Kant made a brief report on the Morphy Avenue bridge replacement and widening project. Bridge work is nearly complete, widening should be complete for the resurfacing work to begin the first of April. Meeting was duly adjourned at 5:46 pm. ame$ P. Nix, Mayor
