HomeMy WebLinkAbout01-24-1994 Regular Meeting1525 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope Municipal Complex Council Chamber; 161 N. Section Street; Fairhope, Alabama 36532, on Monday, 24, January, 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and Acting City Clerk Betty Rivenbark. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 10 January 1994 regular session were duly approved. Mayor Nix announced an opening on the Board of Adjust- ments & Appeals for 1 3 year term. John Duck moved to re- appoint Peyton Walker, seconded by Councilman Ford. Council- woman Puckett moved that the nominations be closed and Mr. Walker be appointed by acclamation. Councilman Overstreet seconded and motion passed unanimously. Mayor Nix advised that we had gotten a new agreement from the Municipal Workers Compensation Fund, Inc., that if we implement it would mean an extra 5% off the rate we are currently paying. Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: RESOLUTION NO.439-94 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized and directed to execute that certain agreement dated 1 February 1994 between the CITY and MUNICIPAL WORKERS COMPENSATION FUND, INC., for the purposes of providing statutory benefits prescribed by the Alabama Workers Compensation Law for em- ployees of the City. ADOPTED THIS24th DAY OF January, 1994. 24 January 1994 1526 Councilman Ford introduced Ordinance No. 954 in writing, an ordinance to annex the property of Robert M. Phillips, located on Scenic Hwy 98(former Barr property) in Battles Wharf, one parcel containing some 1.646± acres. In order to take immediate action Councilman Duck moved to suspend the rules. Seconded by Councilwoman Puckett motion to suspend passed unanimously by the following vote: AYE - DUCK, FORD, BISHOP, PUCKETT, and OVERSTREET. NAY- NONE. Councilwoman Puckett then moved for final adoption of ORDINANCE No. 954. Seconded by Councilman Duck, motion to finally adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none. Mayor Nix said there were other annexation petitions pending, but, they were not contiguous at this time and we could not annex until they are contiguous. Mayor Nix said we had recently experienced several accidents at Oberg Rd. and Morphy Ave. intersection and he had asked Councilman Overstreet and Gen. Supt. Ruther- ford to look into it. That we had a flashing light at this corner and had cleaned off the corners of any brush that might be impeding the vision at the corners. Council- man Overstreet reported that he and Mr. Rutherford had gone out and surveyed the situation and that in their opinion a four-way stop sign should be installed. He further put in the form of a motion installing a 4-way stop sign at this corner. Councilman Duck seconded and motion carried unanimously. Mayor Nix reported that we are removing the bridge at the East end of Morphy Avenue and replacing it and we have plans to widen the road on either side 1 ft. Hopefully this will help the situation. Councilman Bishop questioned if our actions conflicted with the County and Mayor Nix responded no, this is totally in the City. The Council took the following action on a Greens - mower bid for the Golf Course: Results of bid on next page....... 24 January 1994 Identification: "GREENSMOWER- GOLF COURSE' Bids to be opened on: January 4. 1994 at: 1 0 AM To replace Greensmower at Golf Course . 1527 BID SENT TO: BID AMOUNT. Mobile, AL NO BID GRAVLEY OF MOBILE Mobile, AL NO BID It is suggested to accept the low bid of BUNTON CO, (THIGPEN DISTRIBUTING, INC.) Louisville, KY for the price of $9,886.00 with all specifications being met. Tom Mitchell, Wayne Smith, Golf Course Supt. Purchasing Agent Councilwoman Puckett moved to accept the low bid provided all specifications are met. Councilman Overstreet seconded and motion carried unanimously. The council questioned the huge difference in prices and Wayne Smith told them that they did not know, but, we now had 2 Buntons now and Tom Mitchell said they had been good mowers. 24 January 1994 1528 Mayor Nix reported the problems that we are having at the sewer plant during tremendously heavy rains and said we need to upgrade our facility for more capacity and he is requesting that the Council act on this need. Further discussion led to a motion being made by Councilman Bishop to allow the Mayor to have the engineering work done and go out on bids on a 2 million gallon storage tank for the sewer plant. Councilman Duck seconded and motion carried unanimously. Along with this upgrade, Mayor Nix said there has been new technology developed on sludge drying beds and that we had included in the budget getting sludge beds and we should act on this now. Councilman Ford moved to allow the Mayor to have the engineering work done and go out on bids on sludge beds as needed. Councilwoman Puckett seconded and motion carried unanimously. The Mayor mentioned the huge pipes that are being installed on Greeno Road that will help our problem of infiltration that we had in the past. The Spring Fever Chase Association had written a letter requesting permission to use the city streets and the park west of the Colonial Inn for race registration on March 19, 1994, the day of their race this year along with the Arts & Crafts Festival also planned at that time. They said they will work with the police in coordinating the event. They have done this for several years and there has been no problems. Councilman Ford moved to approve their requests. Councilman Bishop seconded and motion carried unanimously. There being no further business, meeting was duly adjourned.
