STATE OF ALABAMA 0 COUNTY OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday. 13 December 1993. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 22 November 1993 regular session were duly approved. Mr. Charles Lake, representing the Eastern Shore Chamber of Commerce, presented awards for winning entries in the annual Christmas Parade held on December 3rd. Honorable Mention went to the R.J. Tuberville family, the Make -A -Wish Foundation, and the P.C. Net, Inc., group. The Hoover Group took Third Place, Paw's Country & Western Dance Club took Second Place, and First Place went to Jubilee Ace Hardware Company. Councilman Ford presented a request from the Recreation Board: The two batting cages at Volanta Park have deteriorated beyond any further repairs and have to be replaced. The Board estimates the cages can be constructed for approximately $8,500.00 and would like Council approval to use up to that amount of Recreation Improvement funds for that purpose. After discussion, Councilman Overstreet moved to approve the request. Seconded by Councilman Duck, motion passed unanimously. Councilman Bishop moved to approve Change Order #4, in- creasing H.O. Weaver's contract on Division "A", (Rock Creek), 193-'94 Public Improvements Assessments project, by $10,350.00. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix opened the floor for nominations for a 5-year term on the Library Board. Councilman Overstreet nominated Frank Boehm. There being no other nominations, Councilwoman Puckett moved the nominations be closed and Mr. Boehm be appointed by acclamation. Seconded by Councilman Overstreet, motion passed unanimously. Councilwoman Puckett moved to authorize advertisements for construction bids on the Morphy Avenue Improvement project. Seconded by Councilman Duck, motion passed unanimously. 13 December 1993 1514 Council took the following action on bids: FOR APPROXIMATELY 700 WATER METERS Vendor Price each Delivery Alabama Water Works Mobile $ 31.00 15 days Schlumberger Inds Roswell, Ga $ 28.00 30 days Delta Munc Supply Decatur, Ga $ 31.50 30 days Consolidated Pipe Birmingham $ 24.94 15-30 days Reed Meter Repair of Semmes replied with a No Bid; and there was no response from Central Pipe Supply of Jackson, MS; Davis Meters of Pensacola, FL; and G & C Supply of Atwood, TN. It is recommended to accept the low bid of $24.94 by Consolidated Pipe of Birmingham. --M. Rejczyk, Water Dept. --W. Smith, Purch. Agt. After discussion, Councilman Ford moved to accept the low bid by Consolidated Pipe, provided all specifications are met. Seconded by Councilman Overstreet, motion passed unanimously. Councilman Duck introduced in writing, and moved for the adoption of, the following resolution. Seconded by Council- woman Puckett, motion passed unanimously: (Res. No. 435-93 on following page......) 13 December 1993 1515 RESOLUTION NO. 435-93 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT SAID GOVERNING BODY WILL HEAR AND RULE ON ANY WRITTEN OBJECTIONS PRESENTED AGAINST THE PUBLIC IMPROVEMENTS ASSESSMENTS BY THE FOLLOWING RULES AND REGULATIONS: 1. Each property owner of record will be sent a notice, by Certified Mail, advising of the date, time, and place of the Public Hearing, in addition to the required notice placed in a newspaper of general circulation in the City. 2. Said notice -by -letter shall be mailed not less than 20 days prior to the date of the Public Hearing. 3. At the Public Hearing, the Governing Body will read and rule upon any and all written objections to the assessments. 4. The Governing Body will determine whether or not an objection proves that property value has not been increased to the value of the assessment, and will rule as to any decreased assessment amount. 5. If the Governing Body determines to reduce an assessment, they will also resolve source of revenue to replace the amount of decreased assessment revenue, if this should be necessary for Bond repayment. 6. Once the Governing Body rules upon any and all objections, they will set the assessments by duly adopting the proper resolution setting forth the assessment for each lot or parcel of assessed property (by reference to the Assessments Roll Book) and no lot or parcel will afterward be sub- divided in any way without the full or remaining balance of its assessment, plus any accrued interest, being first paid in full. Nix, Mayor Attest Evelyn Phillips, City erk 13 December 1993 1516 Councilman Bishop introduced an ordinance in writing establishing a No Smoking policy in all City -owned buildings or structures. This ordinance will be given final consideration at the next regular session. Under old business, Council discussed the request from the Centennial Committee to barricade certain streets in the down- town area for the New Year's Eve special celebration presented at the 25 October 1993 session. The request is to block all vehicular traffic on Section Street from Magnolia Avenue to Morphy Avenue; on Church Street from Magnolia Avenue to just south of Delamar Avenue; on Fairhope Avenue from Bancroft Street to Church Street; and on Johnson Avenue from Bancroft Street to Section Street; beginning at 7:00 am, Friday, December 31st, to 7:00 am, Saturday, New Year's Day. The New Year's Eve Celebration is the first event planned by the Committee for the Centennial Year of 1994. Each of the closed street areas will represent a different decade, with appropriate cars, clothes, displays, and sound stages for bands to perform that period's music. The request to close the streets all day is to provide the time needed to set the stages, etc., for the event which starts at 6:00 pm on New Year's Eve. Council delayed action on this request in order to coordinate with the downtown mer- chants who will be affected by the closed streets. It was reported that the Committee and the merchants have worked out a plan to accommodate necessary access -ways. Councilman Bishop moved to grant the Centennial Committee request. Seconded by Councilman Ford, motion passed unanimously. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Overstreet, motion passed unanimously. Mayor Nix reported the State Department of Transportation project on widening Greeno Road (US 98) was moving along very well and people are just going to have to be patient for a while longer. The unsightlyness and the inconvenience is the price of progress. Mr. Norris, Electrical Department, reported that street lights along the project will be replaced as soon as possible. A Mr. Whittaker asked what decision has been made con- cerning the YMCA proposal and was advised no decision has been made. There being no further business, meeting was adjourned at 5:55 pm. ■ s P.
