COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 p.m.; Fairhope Municipal Complex Council Chamber;
161 N. Section Street; Fairhope, Alabama 36532; on
Mondav, 25 October 1993.
Present were Mayor James P. Nix; Councilmembers Michael
A. Ford, David E. Bishop, Jeanette Puckett, Layton Overstreet,
John V. Duck; City Attorney Marion E. Wynne and Acting City
Clerk Betty Rivenbark.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 October, 1993 regular session were
duly approved.
Mayor Nix informed the council of a letter of request from
the Centennial Committee to block off the streets on December 31st
starting at 7:00 AM in the morning in orderAset up 6 stages and
bring in 80 cars and the light and sound equipment that will be
needed for that evening. The area she is talking about is Fair -
hope Avenue from Bancroft to Church Street and Section Street
from Magnolia to just past Johnson Street; Church Street from
Magnolia to just past DeLa Mare Street.The question was asked
about this being an inconvenience to the downtown merchants
and how did they feel about it, that we needed to see how
they would react to this closing. David Ed Bishop moved to
take this under advisement for further study, consult the
merchants and maybe have an answer by the next meeting. Layton
Overstreet seconded and motion passed unanimously.
A letter from the Downtown Merchants Assoc. was considered
requesting two hour parking restrictions. Mayor Nix said with
council approval he would like to appoint a committee with Council-
man Overstreet, Mike Ford and Phil Rutherford to study the situation
and see what signs they deem appropriate and report back.
Mike Ford moved to approve committee appointment as requested,
Jeanette Puckett seconded and motion carried unanimously.
Councilman Ford introduced Ordinance No. 951 in writing,
an ordinance to annex the property of Edna G. and Joseph W.
Petties, Jr., located on South Ingleside, one parcel contain-
ing some 2.78 acres. In order to take immediate action Council-
man Overstreet moved to suspend the rules. Seconded by Council-
woman Puckett, motion to suspend passed unanimously by the follow-
ing vote: AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -
none. Councilman Duck then moved for final adoption of Ordinance
No. 951. Seconded by Councilwoman Puckett, motion to finally
adopt passed unanimously by the following vote: AYE -Duck, Ford,
Bishop, Puckett, and Overstreet. NAY -none.

Council reviewed an application for a Club Liquor License
by David Head, General Partner of H/M Partners, for ROCK CREEK
CLUB, 140 Clubhouse Drive. There was police approval and no one
present was opposed. Councilman Overstreet moved to grant appli-
cation as requested, Councilman Ford seconded and motion carried
unanimously.
Council reviewed an application for a Beer Off -Premises
license and a Wine Off -Premises license for WILLIAM E. BARTON
DBA THE SUPER STOP located at 7022 Twin Beech Road(formerly Pencils
& Crickets). There was police approval and no one was present to
oppose the application. Councilman Ford moved to approve this
as requested, Councilman Duck seconded and motion carried unanimously.
The Council took the following action on bids:

Annual Bid on approximately 500 -DUAL CHECK VALVE ASSEMBLYS to be
used by the City Water Dept. Same price to be in effect for the period of one (1)
year.

Birmingham, Alabama for the price of $10.80 each with all specifications being
met. Mike Rejczyk, Water & Sewer Supt. and Wayne Smith Pur. Agt.
Councilwoman Puckett moved to accept the low bid provided all
specifications are met. Councilman Ford seconded and motion
carried unanimously.

It was reported that on the Water Meter Bids seven bids were
mailed out and only two bids received and one did not meet
specifications. Discussion led to a motion by Councilman Over-
street to reject all bids and go out on bids again. Councilman
Ford seconded the motion and it carried unanimously.
On the Gas Meter bids the following action was taken:

Bids to be opened on: -September 27 1993
at: 10:30 AM.
Residential Gas Meters to be used by the City of Fairhope Gas System. Price will
be good for the period of one (1) year. (Meters are to be purchased as needed).

For the Electric Department bids were taken on #12 Tracking Wire
and the following action was taken.after Mayor Nix explained that
this wire would be used by the gas, water and electric departments:

Mayor Nix mentioned that the city had been contacted by the
YMCA of Mobile and they wished to make a proposal to the city
to build a 20,000 square foot facility in Fairhope for the
eastern shore provided we lease them the land. Mayor Nix
said they would need 5 acres and could possibly be given land
out by pool area at the Volanta ballpark. He said they will
build it, man it and operate it for Fairhope and the Eastern
Shore. He said this would not take the place of the plans
for the Adult Recreation Center or the plans for the young
people that we are still working on but it would definitely
fill a need. He said a 6 lane pool is planned with a running
track around the court, all enclosed. He said they will have
a fund raiser to raise the funds but they need a commitment
from us. Mike Ford said we will lose several fields that we
are using now, that we are using all available space we have,
that we will have to double our efforts to get more parkland,
but, he knows it will be a tremendous asset for the City of
Fairhope. Further discussion led to Councilman Ford moving
that we agree with the concept and objectives and further
direct the mayor to negotiate an agreement and lease and
when finalized to come back to the council with what worked
out. Councilman Bishop seconded thO motion and it carried
unanimously.
There being no further business, meeting was duly adjourned.
