STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm, Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 27 September 1993.
Present were Councilmembers John V. Duck, Michael A. Ford,
David E. Bishop, Jeanette Puckett, and Layton Overstreet; City
Attorney Marion E. Wynne and City Clerk Evelyn P. Phillips.
Mayor James P. Nix was absent.
Mayor Pro Temp Michael A. Ford presided in the absence
of Mayor Nix.
There being a quorum present, Mayor Pro Temp Ford called
the meeting to order. Minutes of the 13 September 1993 regular
session were duly approved.
A public hearing was held as advertised on a Lounge Liquor
License application by Sally Bradley, dba THE W.B.A.R., to
be located at 17070 Scenic Highway 98 in Point Clear. A large
group was present to oppose the issuance of the license.
Mr. Champ Lyons presented a petition with 23 signatures asking
that the license not be approved. Several other residents
of the area spoke against the license giving noise, traffic,
and inadequate parking as reasons for their opposition. No
one spoke in favor of the application; Ms. Bradley was not
present. Councilman Bishop moved to deny approval of the license.
Seconded by Councilman Duck, motion passed unanimously.
Councilman Duck introduced in writing Ordinance No. 946,
an ordinance to annex the property of Rosilyn Stanton,
19168 South Ingleside, and Jim & Beatrice Lymous, 673 South
Ingleside. In order to take immediate action, Councilwoman
Puckett moved to suspend the rules. Seconded by Councilman
Overstreet, motion to suspend passed unanimously by the following
vote: AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -
none. Councilman Duck then moved for final adoption of
Ordinance No. 946. Seconded by Councilman Bishop, motion to
final adopt passed unanimously by the following vote: AYE -
Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none.
Councilman Bishop introduced in writing Ordinance No. 947,
an ordinance to annex the property of Elliott H. Powe, 19550
South Ingleside, and Charles & Sharon Clark, 19519 Greeno Road.
In order to take immediate action, Councilman Duck moved to
suspend the rules. Seconded by Councilman Overstreet, motion
to suspend passed unanimously by the following vote: AYE -
Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none.

Councilman Bishop then moved for final adoption of Ordinance
No. 947. Seconded by Councilman Duck, motion to final adopt
passed unanimously by the following vote: AYE -Duck, Ford,
Bishop, Puckett, and Overstreet. NAY -none.
Councilwoman Puckett introduced in writing Ordinance
No. 948, an ordinance to annex four residential lots owned
by Herbert 0. and Ruth L. Pierce, located on the east side
of Greeno Road immediately south of Fairhope Memory Gardens.
In order to take immediate action, Councilman Bishop moved
to suspend the rules. Seconded by Councilman Overstreet, motion
to suspend passed unanimously by the following vote: AYE -
Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none.
Councilman Duck then moved for final adoption of Ordinance
No. 948. Seconded by Councilman Bishop, motion to final adopt
passed unanimously by the following vote: AYE -Duck, Ford,
Bishop, Puckett, and Overstreet. NAY -none.
Councilman Overstreet introduced in writing Ordinance
No. 949, an ordinance to annex the property of Hoyt B. and
Ina E. Foster, 20971 Bishop Road. In order to take immediate
action, Councilman Duck moved to suspend the rules. Seconded
by Councilman Overstreet, motion to suspend passed unanimously
by the following vote: AYE -Duck, Ford, Bishop, Puckett, and
Overstreet. NAY -none. Councilman Bishop then moved for final
adoption of Ordinance No. 949. Seconded by Councilman Duck,
motion to final adopt passed unanimously by the following vote:
AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none.
Councilwoman Puckett introduced in writing Ordinance
No. 950, an ordinance to annex the property of Robert G. and
Sue M. Eubanks, located in Montrose Village, Lot 3 of Oak Lane
Subdivision. In order to take immediate action, Councilman
Duck moved to suspend the rules. Seconded by Councilman Over-
street, motion to suspend passed unanimously by the following
vote: AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -
none. Councilman Bishop then moved for final adoption of
Ordinance No. 950. Seconded by Councilman Overstreet, motion
to final adopt passed unanimously by the following vote:
AYE -Duck, Ford, Bishop, Puckett, and Overstreet. NAY -none.
Councilwoman Puckett introduced in writing, and moved for
the adoption of, the following resolution. Seconded by
Councilman Overstreet, motion passed unanimously:

WHEREAS, The City of Fairhope, Alabama is eligible to apply for and receive grant funds
under the Community Development Block Grant program as made available under Title I of the
Housing and Community Development Act of 1974, as amended, as administered by the U.S.
Department of Housing and Urban Development and the Alabama Department of Economic and
Community Affairs, and
WHEREAS, all local governments who desire to apply for and receive grant funds for eligible
activities are required to develop, adopt, and follow a "Citizen Participation Plan" that meets all
of the requirements of the Act and adopted policies of the Alabama Department of Economic and
Community Affairs, and
WHEREAS, previously adopted "Citizen Participation Plans" may not meet correct requirements
and policies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairhope, Alabama,
as follows:
Section 1. That all previously adopted "Citizen Participation Plans", adopted to comply with
requirements of the Housing and Community Development Act of 1974, as amended, are hereby
recorded.
Section 2. That the City of Fairhope, Alabama hereby adopts a revised "Citizen Participation
Plan" that conforms to current requirements of the Housing and Community Development Act of
1974, as amended, and policies of the Alabama Department of Economic and Community
Affairs, said "Plan" on file in the office of the City Clerk and available for
public inspection.
Section 3. That said "Plan" remain in force and effect for all activities
conducted under programs and projects made available by provisions of
the Act until such time said "Plan" may be caused to be rescinded, re-
vised or amended.
PASSED, ADOPTED, AND APPROVED this 27th Day of September, 1993.
